Diseases of Animals (Waste Foods) (Jersey) Order 1958[1]

THE ECONOMIC DEVELOPMENT COMMITTEE, in pursuance of Articles 3, 10 and 42 of the Diseases of Animals (Jersey) Law 1956,[2] orders as follows –

1      Interpretation

In this Order –

“animals” means cattle, sheep, goats and all other ruminating animals and swine;

“approved disinfectant” has the meaning assigned to it in the Diseases of Animals (Approved Disinfectants) (Jersey) Order 1958;[3]

“boiled” means exposed for a period of at least one hour by any process to a temperature of not less than 212° F, and

“boiling” and “unboiled” shall be construed accordingly;

“bones” includes ground green or raw bones;

“poultry” means domestic fowls, turkeys, geese, ducks, guinea-fowl and domestic pigeons and pheasants kept in captivity;

“waste foods” means –

(a)     any meat, bones, offal or other part of the carcase of any animal or of any poultry;

(b)     any broken or waste foodstuffs (including table or kitchen refuse, scraps or waste) which contains or have been in contact with any meat, bones or offal or with any other part of the carcase of any animal or poultry.

2      Exemption of proprietary foodstuffs

(1)    This Order shall not apply to any proprietary foodstuff containing any animal foodstuff, in respect of which the manufacturer thereof holds an effective certificate of exemption from the provisions of this Order granted by or on behalf of the Minister.

(2)    A certificate of exemption shall not be granted by or on behalf of the Minister in respect of any proprietary foodstuff unless the Minister is satisfied that the process of manufacture or preparation thereof includes the boiling of any animal foodstuffs used therein.

(3)    The Minister may at any time revoke any certificate of exemption granted under this Article, and such certificate shall thereupon cease to be effective.

3      Restrictions on acquisition and disposal of unboiled waste foods[4]

(1)    Save in the case of the acquisition of unboiled waste foods by any public or parochial authority in the ordinary course of the collection of refuse, no person shall acquire or dispose of any unboiled waste foods except under and in accordance with the terms and subject to the conditions of a licence granted by or on behalf of the Minister.

(2)    An application for the grant of a licence under this Article shall be in such form as the Minister may require.

(3)    The grant of a licence may be refused in any case where –

(a)     the Minister is not satisfied that the person wishing to acquire the waste foods has adequate facilities for boiling the same; or

(b)     the applicant or the person from whom he or she intends to acquire or to whom he or she intends to dispose of the waste foods has previously been refused a licence or had a licence revoked.

(4)    Unless previously revoked, a licence granted under this Article shall remain in force until the 30th April next following the month in which the licence is issued.

(5)    The Minister may revoke a licence granted under this Article in any case where it appears to the Minister to be expedient so to do by reason of –

(a)     the failure of a person licensed to acquire waste foods to maintain in adequate condition the facilities the person has for boiling the same;

(b)     the breach by a licensee of any condition of the licence or of any provision of this Order; or

(c)     any other relevant circumstances.

4      Prohibition on use of unboiled waste foods for feeding

No person shall use any waste foods to which this Order applies for feeding to animals or poultry unless such waste foods have been boiled.

5      Unboiled waste foods to be kept apart from boiled waste foods, animals and poultry

(1)    No person having the charge or control of any unboiled waste foods to which this Order applies shall permit them to come into contact with boiled waste foods or allow animals or poultry to have access to them:

Provided that no person shall be guilty of any contravention of this Article if the person proves to the satisfaction of the Court that the person took all reasonable steps to prevent the unboiled waste foods from coming into contact with the boiled waste foods and from being accessible to animals or poultry.

(2)    For the purposes of this Article “animals” not restricted by the definition in this Order and “poultry” includes birds of any species.

6      Precautions to be taken in connection with the carriage of waste foods

(1)    Where any bin or other container, or any road vehicle, has on any occasion been used for the carriage of waste foods to which this Order applies, or any vehicle has carried any bin or other container which has been so used, it shall be unlawful to use the bin or other container, or the vehicle, for the carriage of –

(a)     animals or poultry;

(b)     feeding stuffs for animals or poultry (other than waste foods to which this Order applies); or

(c)     any other thing intended to be used for or about animals or poultry,

unless as soon as practicable after each occasion of such use and before being again used the bin or other container, or the vehicle, as the case may be, has been thoroughly disinfected by washing the bin or other container, or the floor, roof and sides of the inside of the vehicle, either with an approved disinfectant or with a solution prepared by dissolving washing soda (sodium carbonate) in water in the proportion of one half pound of washing soda to one gallon of hot water.

(2)    It shall be unlawful to convey any animals or poultry or feeding stuffs (other than waste foods to which this Order applies) for animals or poultry, or any other thing intended to be used for or about animals or poultry in any road vehicle at the same time as that road vehicle is being used for the carriage of waste foods to which this Order applies, or for the carriage of any bin or container which has been used for the carriage of such waste foods and has not after that use been disinfected in accordance with the requirements of paragraph (1).

7      Offences

Any person aiding, abetting, counselling or procuring the commission of any breach of the provisions of this Order shall be guilty of an offence against this Order.

8      Citation

This Order may be cited as the Diseases of Animals (Waste Foods) (Jersey) Order 1958.
