Diseases of Animals (Importation of Live Fish) (Jersey) Order 1984[1]

THE ECONOMIC DEVELOPMENT COMMITTEE, in pursuance of Articles 1, 3, 6, 13 and 42 of the Diseases of Animals (Jersey) Law 1956,[2] orders as follows –

1      Interpretation

(1)    In this Order –

“eggs” include milt;

“fish” includes shellfish;

“freshwater fish” means any fish living in fresh water;

“Law” means the Diseases of Animals (Jersey) Law 1956;[3] and

“shellfish” includes crustaceans and molluscs of any kind and any spat or spawn of shellfish.

(2)    For the purposes of this Order, and for the purposes of Articles 3 and 6 and Part 4 of the Law, insofar as they apply to the making, administration and enforcement of this Order the definition of “disease” in Article 1 of the Law is extended to include –

(a)     furunculosis;

(b)     bacterial kidney disease (BKD);

(c)     columnaris;

(d)     infectious pancreatic necrosis (IPN);

(e)     viral haemorrhagic septicaemia (VHS);

(f)     whirling disease (Myxosomo cerebralis);

(g)     infectious haematopoietic necrosis (IHN);

(h)     ulcerative dermal necrosis (UDN);

(i)     infectious dropsy of cyprinids (IDC or IAD) in any of its forms including spring viraemia and erythrodermatitis;

(j)     gyrodactylosis; and

(k)     enteric redmouth (ERM).[4]

(3)    The provisions of Article 8 of the Law shall apply to the diseases referred to in paragraph (2).

2      Restriction on importation of live fish and eggs of fish

(1)    Except as provided in paragraph (2), no person shall import or bring into Jersey from any country outside Jersey any live freshwater fish or live eggs of fresh water fish unless such fish or eggs are consigned to a person licensed under this Article.[5]

(2)    Paragraph (1) shall not apply to ornamental tropical fish which at all times have been kept in an aquarium.[6]

(3)    The Minister may grant a licence to any person to have consigned to him or her any live freshwater fish or live eggs of fresh water fish and such licence may be granted subject to such conditions as the Minister thinks fit.

(4)    Any licence granted under this Article may be revoked, suspended or varied at any time by the Minister.

3      Powers of entry and inspection

(1)    An inspector may at any time enter any land or premises to ascertain whether the provisions of this Order are being complied with and may examine and seize for examination any live freshwater fish or live eggs of freshwater fish and water forming part of any consignment of such fish imported into Jersey, whether or not the consignee is the holder of a licence granted under Article 2.

(2)    Where an examination of any fish, eggs or water referred to in paragraph (1) discloses the presence of any disease referred to in Article 1(2) the Veterinary Officer shall serve on the importer of the fish or eggs or on any other person in charge of them a notice directing the destruction or export of the whole or part of the consignment including the water and the container in which the fish were imported.

(3)    The notice referred to in paragraph (2) shall specify the time within which destruction or export shall be effected and the place and manner of destruction in a case where destruction is ordered.

(4)    For the purposes of this Article “land” includes land covered by water.

4      Offences

Any person who contravenes any provision of this Order, or any provision of a licence granted or notice served under any such provision, or who fails to comply with any such provision, or who causes or permits any such contravention or non-compliance, commits an offence against the Law.

5      Citation

This Order may be cited as the Diseases of Animals (Importation of Live Fish) (Jersey) Order 1984.

This Order has been amended by the States of Jersey (Amendments and Construction Provisions No. 3) (Jersey) Regulations 2005. The amendments replace all references to a Committee of the States of Jersey with a reference to a Minister of the States of Jersey, and remove and add defined terms appropriately, consequentially upon the move from a committee system of government to a ministerial system of government
