Artificial Insemination of Domestic Animals (Jersey) Law 1952[1]
A LAW to control the practice of artificial insemination of domestic animals; to control or prohibit the import and export of embryos, ova and semen of particular domestic animals and to provide for matters incidental thereto[2]

1 Interpretation[3]
In this Law –
“cattle” means bulls, cows, heifers and calves;
“domestic animals” means cattle, sheep, goats, swine, horses, cats, dogs, domestic fowls, turkeys, geese and ducks;
“Minister” means the Minister for Planning and Environment;
“officer of the Impôts” means the Agent of the Impôts, a Sub-Agent of the Impôts or any other employee of the Impôts.
2 Control of artificial insemination[4]
(1) The Minister may, by Order, control the practice of artificial insemination of domestic animals.
(2) An Order made by the Minister may, in particular, prohibit, subject to such exemptions as may be specified in the Order, the collection, storage, distribution and sale of the semen of domestic animals, except under the authority of a licence granted by or on behalf of the Minister.
(3) Orders made by the Minster may prescribe fees to be paid in respect of licences granted and other services provided by or on behalf of the Minister under or by virtue of this Law.
3 Import and export of semen
(1) [5]
(2) No person shall import into Jersey –
(a) the embryos, ova or semen of any sheep, goats, swine or horses;
(b) the semen of any cats, dogs, domestic fowls, turkeys, geese or ducks,
except under the authority of a licence granted by or on behalf of the Minister. [6]
(3) No person shall export from Jersey –
(a) the embryos, ova or semen of any sheep, goats, swine or horses;
(b) the semen of any cats, dogs, domestic fowls, turkeys, geese or ducks,
except under the authority of a licence granted by or on behalf of the Minister.[7]
(4) Any officer of the Impôts may seize any embryos, ova or semen with respect to which the officer has reason to believe that an offence against this Article has been committed and may detain such embryos, ova or semen pending the determination of any proceedings instituted in respect of the offence or until the Minister is satisfied that no such proceedings are likely to be instituted, and any embryos, ova or semen so detained shall be detained at the owner’s risk in such place, and in such manner, as the Minister may direct and, if such proceedings as aforesaid result in a conviction, shall be destroyed or otherwise disposed of as the Minister may direct.[8]
4 Provisions as to licences
Any licence granted under this Law may at any time be revoked by the Minister, and may be granted subject to such conditions as may be specified therein.
5 Inspection
Any person authorized in writing in that behalf by the Minister may, on producing the person’s authority enter at all reasonable times –
(a) any premises occupied by the holder of a licence granted under this Law and used for or in connection with any of the purposes authorized by the licence;
(b) any premises where animals are kept to which any Order made under this Law for the time being applies and which have been artificially inseminated;
(c) any premises on which, or in connection with which, the person has reasonable grounds for suspecting that an offence under this Law is being or has been committed,
and may inspect the premises and any animals or articles thereon and carry out such tests or other investigations as the person thinks fit in order to ascertain whether the provisions of this Law or of any Order made thereunder, or the conditions subject to which any licence is granted under this Law, are being complied with, and may, for the purposes of any such test or investigation, require the occupier of the premises, and any person in the employment of such occupier to furnish such information as it is in the occupier’s power to give.
6 Power to obtain information
The Minister and any person authorized by or on behalf of the Minister may require any holder of a licence granted under this Law, to furnish to such authority or person, within such time, and in such manner, as may be specified in such requirements, such returns and other information as may be so required.
7 Offences
If any person –
(a) contravenes or fails to comply with any of the provisions of this Law or of any Order made thereunder, or with any condition subject to which a licence is granted under this Law;
(b) for any of the purposes of this Law, makes any statement which the person knows to be false in a material particular or recklessly makes any statement which is false in a material particular;
(c) refuses or neglects to furnish any return or information which under this Law is required to be furnished, within such time and in such manner as may be so required, or knowingly furnishes any return or information required to be furnished under this Law which is false in any material particular;
(d) fraudulently alters or uses or permits to be fraudulently used any licence granted under this Law; or
(e) hinders or obstructs any person in the exercise of the person’s powers or duties under this Law,
the person shall be liable to a fine not exceeding £100 and, in the case of a second or subsequent offence, to imprisonment for a term not exceeding 3 months either in lieu of or in addition to such a fine.

This Law may be cited as the Artificial Insemination of Domestic Animals (Jersey) Law 1952.
