Control of Infestation (Potato Root Eelworm) (Jersey) Scheme 1968[1]

THE ECONOMIC DEVELOPMENT COMMITTEE, in pursuance of Article 6 of the Agriculture (Guaranteed Prices and Financial Assistance) (Jersey) Law 1965,[2] orders as follows –

1      Interpretation

In this Scheme –

“Agricultural Chemicals Approval Scheme” means the Scheme operated on behalf of the Agricultural Departments of England, Scotland, Wales, Northern Ireland, the Channel Islands and the Isle of Man by the Agricultural Chemicals Approval Organisation under which proprietary brands of crop protection chemicals are officially approved;[3]

“applicant” means an applicant for a contribution;

“approved material” means a substance specified in the Schedule to the Scheme being in a proprietary formulation approved under the Agricultural Chemicals Approved Scheme and contained in the List of Approved Products and their Uses for Farmers and Growers;[4]

“contribution” means a contribution under this Scheme;

“infested” means infested with potato root eelworm (Heterodera rostockiensis Woll.);

“Law” means the Agriculture (Guaranteed Prices and Financial Assistance) (Jersey) Law 1965;[5]

“List of Approved Products and their Uses for Farmers and Growers” means the statement (as having effect for the time being) containing products approved under the Agricultural Chemicals Approval Scheme and published by the Ministry of Agriculture, Fisheries and Food in the United Kingdom.[6]

2      Contributions in respect of an approved material acquired and used on infested land

(1)    Subject to the provisions of this Scheme, a contribution may be made to an occupier towards the cost of acquiring an approved material for the purpose of controlling an infestation of agricultural land in the occupier’s occupation.

(2)    A contribution shall be made only where the Minister is satisfied –

(a)     that the agricultural land in respect of which an approved material was acquired and used is infested;

(b)     that, having regard to the circumstances of the case, the degree of infestation of the agricultural land is such that the use of an approved material to control the infestation will conduce to the production of better or more abundant crops in the land;

(c)     that an approved material has been used in accordance with the directions of a person authorized by the Minister for the purposes of this Scheme.

(3)    A contribution shall not be made where the cost of acquiring an approved material is less than £5.

3      Procedure for obtaining contributions

(1)    An application for a contribution shall be made in such manner, on such forms and within such time as the Minister may determine.

(2)    A contribution shall not be made where –

(a)     the applicant has failed to comply with a requirement made under Article 11 of the Law; or

(b)     application therefore is made otherwise than in accordance with the provisions of sub-paragraph (1),

and the Minister may in any case refuse payment of a contribution where application is made after 31st January of the year next following that in which an approved material has been used.

4      Calculation of contributions

(1)    Subject to the provisions of sub-paragraph (2), a contribution under this Scheme shall be at such rate as may from time to time be fixed by the Minister, but shall not exceed a sum representing as nearly as may be three fifths of the cost of acquiring an approved material for the purpose of controlling an infestation of agricultural land.

(2)    For the purpose of calculating the amount of contribution, the Minister shall disregard –

(a)     any quantity of an approved material acquired in excess of the quantity specified by a person authorized for the purposes of paragraph 2(2)(c) of this Scheme;

(b)     any charges made for the transport of, or for otherwise dealing with, an approved material after it has left the premises of the vendor;

(c)     any charges made by a vendor for credit facilities afforded by the vendor to an occupier in respect of the purchase of an approved material.

5      Citation

This Scheme may be cited as the Control of Infestation (Potato Root Eelworm) (Jersey) Scheme 1968.

This Scheme has been amended by the States of Jersey (Amendments and Construction Provisions No. 4) (Jersey) Regulations 2005. The amendments replace all references to a Committee of the States of Jersey with a reference to a Minister of the States of Jersey, and remove and add defined terms appropriately, consequentially upon the move from a committee system of government to a ministerial system of government.
