HARBOUR FEES

THE HARBOUR FEES ACT

ORDER
(under section 4 )

(Made by the Minister on the 27th day of June, 1978)

1. This Order may be cited as the Harbour Fees Order, 1978.

2. In this Order-

"alumina ship" means any ship carrying, or entering any port in
Jamaica to load thereat, alumina in bulk;

"bauxite ship" means any ship carrying, or entering any port in
Jamaica to load thereat, bauxite in bulk;

"coasting ship" means any coasting ship, as defined by the Customs
Act, engaged solely or mainly in the coasting trade;

"container ship" means any ship designed or adapted solely for
carrying cargo stuffed in containers or mobile units or both;

"cruise ship" means any ship having a minimum passenger capacity of
one hundred and fifty passengers;

"gypsum ship" means any ship carrying, or entering any port in
Jamaica to load thereat, gypsum in bulk;

"petroleum ship" means any ship carrying, or entering any port in
Jamaica to load thereat, petroleum or petroleum products, or both
in bulk.

3. For the purposes of this Order-

"container" means a container suitable for shipping or storing therein
smaller containers, packages or goods in bulk and which can be
handled intransit as a unit and is of such a size as to require
mechanical handling;

"mobile unity' means a unit on wheels enabling its removal, whether
under its own motive power or otherwise, on being loaded from a
ship to wharf, but does not include containers;

"net tonnage" means in relation to any ship-

(a) the net tonnage of that ship as shown in the certificate of registry
thereof; or

(6) where the Port Authority thinks fit, the net tonnage as determined by
the Port Authority by measurement of that ship to ascertain the
registered tonnage in accordance with the British Merchant Shipping
(Tonnage) Regulations, 1967.

4 4 1 ) Harbour fees payable in respect of entry into a harbour by a ship
Schedule. falling within any category of ships listed in the first column of the Schedule

shall be at the rate specified in relation to that category in the second column of
the Schedule in the currency of the United States of America or the amount in
Jamaican currency equivalent at the current rate of exchange.

(2) For the purposes of this Order "current rate of exchange" means the
selling rate for sight transactions ruling on the day on which payment of the
harbour fees in respect of that vessel is made.

SCHEDULE (Paragraph 4)

Category of ships Rate of Harbour Fees

( I ) Coasting ships - US7.78 per annum

(2) Container ships - On any one visit to Jamaica, USSO. 1600 cents per ton of
the net tonnage of the ship for every port entered, up to
a maximum not exceeding in the aggregate US$0.3 100
cents per ton of the net tonnage.

(3) Cruise ships

(4) Gypsum ships

- US$0.0517 per ton of the net tonnage of the ship on
each visit to Jamaica (irrespective of the number of
ports visited).

- On any one visit to Jamaica, US$0.2500 cents per ton of
the net tonnage of the ship for every port entered, up to
a maximum not exceeding in the aggregate US$0.5000
cents per ton of the net tonnage.

(5) Bauxite and Alumina - On any one visit to Jamaica, US$0.2000 cents per ton of
ships the net tonnage of the ship for every port entered, up to

a maximum not exceeding in the aggregate US$0.4000
cents per ton of the net tonnage.

(6) Petroleum ships - On any one visit to Jamaica, US$0.1800 cents per ton of
the net tonnage of the ship for every port entered, up to
a maximum not exceeding in the aggregate US$0.3600
cents per ton of the net tonnage.

(7) Any other ship - On any one visit to Jamaica, US$0.1900 cents per ton of
the net tonnage of the ship for every port entered, up to
a maximum not exceeding in the aggregate US$0.3700
cents per ton of the net tonnage.
