Notice of the making of this Statutory Instrument was published in
“Iris Oifigiúil” of 10th July, 2015.
WHEREAS I, LEO VARADKAR, Minister for Health, pursuant to section 5 8C(5) (inserted by section 5 of the Health (General Practitioner Service) Act 2014 (No. 28 of 2014)) of the Health Act 1970 (No. 1 of 1970), prior to the making of these regulations, engaged in such consultations as I considered appropriate in accordance with subsections (6) and (8) of the said section 5 8C;
AND WHEREAS I, pursuant to subsection (7) of the said section 58C, consider the amounts and rates prescribed in these regulations to be fair and reasonable having regard to the matters specified in the said subsection (7);
NOW I, LEO VARADKAR, Minister for Health, in exercise of the powers conferred on me by section 5 8C(3) and (4) (inserted by section 5 of the Health (General Practitioner Service) Act 2014 (No. 28 of 2014)) of the Health Act 1970 (No. 1 of 1970), hereby make the following regulations:
1. (1) These Regulations may be cited as the Health Act 1970 (Section 58C) (Payments to Relevant Medical Practitioners) Regulations 2015.
(2) These Regulations shall come into operation on 1 July 2015.
2. In these Regulations “ section 5 8C” means section 5 8C (inserted by section 5 of the Health (General Practitioner Service) Act 2014 (No. 28 of 2014)) of the Health Act 1970 (No. 1 of 1970).
3. The amount specified in column (3) of Schedule 1 opposite a particular reference number in column (1) thereof is prescribed as the payment to be made to relevant medical practitioners in respect of the particular services specified in column (2) thereof and provided by those relevant medical practitioners under agreements referred to in section 58C(1) to the class of eligible persons specified in column (2) at that reference number.
4. The amount specified in column (3) of Schedule 2 opposite a particular reference number in column (1) thereof is prescribed as the payment to be made to relevant medical practitioners in respect of the particular services specified in column (2) thereof at that reference number, provided by those relevant medical practitioners under agreements referred to in section 58C(1).
5. The amount specified in column (3) of Schedule 3 opposite a particular reference number in column (1) thereof is prescribed as the payment to be made to relevant medical practitioners in respect of the particular services specified in column (2) thereof at that reference number, provided by those relevant medical practitioners under agreements referred to in section 58C(1).
6. The amount specified in column (3) of Schedule 4 opposite a particular reference number in column (1) thereof is prescribed as the payment to be made to relevant medical practitioners in respect of the particular services specified in column (2) thereof at that reference point, provided by those relevant medical practitioners under agreements referred to in section 58C(1).
7. The amount specified in column (2) of Schedule 5 is prescribed as the payment to be made to relevant medical practitioners whose practice is eligible for the rural practice allowance specified in column (1) thereof under agreements referred to in section 58C(1).
8. The amount specified in column (3) of Schedule 6 opposite a particular reference number in column (1) thereof is prescribed as the payment to be made to relevant medical practitioners in respect of the particular services specified in column (2) thereof at that reference point, provided by those relevant medical practitioners under agreements referred to in section 58C(1).
9. The amount specified in column (2) of Schedule 7 is prescribed as the payment to be made to relevant medical practitioners in respect of the particular services specified in column (1) thereof at that reference point, provided by those relevant medical practitioners under agreements referred to in section 58C(1).
10. The amount specified in column (3) of Schedule 8 opposite a particular reference number in column (1) thereof is prescribed as the maximum payment to be made to relevant medical practitioners in respect of the particular services specified in column (2) thereof at that reference point, provided by those relevant medical practitioners under agreements referred to in section 58C(1).
11. The amount specified in column (3) of Schedule 9 opposite a particular reference number in column (1) thereof is prescribed as the maximum payment to be made to relevant medical practitioners in respect of the particular locum expenses specified in column (2) thereof at that reference point, payable to those relevant medical practitioners under agreements referred to in section 58C(1).
12. The amount specified in column (3) of Schedule 10 opposite a particular reference number in column (1) thereof is prescribed as the payment to be made to relevant medical practitioners in respect of the particular service specified in column (2) thereof at that reference point, provided by those relevant medical practitioners under agreements referred to in section 58C(1).

These Regulations shall apply to payments in respect of services rendered by general practitioners under the agreement for the provision of services to children under 6 years of age pursuant to the Health (General Practitioner Service Act) 2014 .
