ENVIRONMENTAL PROTECTION AGENCY (LICENSING) (AMENDMENT) (NO. 2) REGULATIONS, 1996
The Minister for the Environment, in exercise of the powers conferred on him by sections 6 and 82 of the Environmental Protection Agency Act, 1992 (No. 7 of 1992), and by section 3 of that Act as amended by the European Communities (Environmental Impact Assessment) (Amendment) Regulations, 1994, hereby makes the following Regulations:

Citation.
1. These Regulations may be cited as the Environmental Protection Agency (Licensing) (Amendment) (No. 2) Regulations, 1996.

Commencement of licensing of activities.
2. The Environmental Protection Agency (Licensing) Regulations, 1994 ( S.I. No. 85 of 1994 ), are hereby amended by the substitution for article 4 thereof of the following article:—
" 4. (1) The 16th day of May, 1994, shall be the prescribed day for the purposes of section 82(1) of the Act in respect of the classes of activity specified in paragraphs 1, 2, 4, 5, 7, 8, 10 and 11 of the First Schedule to the Act.
(2) The 16th day of May, 1994, shall be the "relevant day" for the purposes of the definition of "established activity" in section 3 of the Act in respect of the classes of activity specified in paragraphs 1, 2, 4, 5, 7, 8, 10 and 11 of the First Schedule to the Act.
(3) The 3rd day of April, 1995, shall be the prescribed day for the purposes of section 82(1) of the Act in respect of the classes of activity specified in paragraphs 3, 12 and 13 of the First Schedule to the Act.
(4) The 3rd day of April, 1995, shall be the "relevant day" for the purposes of the definition of "established activity" in section 3 of the Act in respect of the classes of activity specified in paragraphs 3, 12 and 13 of the First Schedule to the Act.
(5) The 3rd day of September, 1996, shall be the prescribed day for the purposes of section 82(1) of the Act in respect of the classes of activity specified in paragraphs 6 and 9 of the First Schedule to the Act.
(6) The 3rd day of September, 1996, shall be the "relevant day" for the purposes of the definition of "established activity" in section 3 of the Act in respect of the classes of activity specified in paragraphs 6 and 9 of the First Schedule to the Act.".

Revocations.
3. The Environmental Protection Agency (Licensing) (Amendment) Regulations, 1995 ( S.I. No. 59 of 1995 ), and Environmental Protection Agency (Licensing) (Amendment) Regulations, 1996 ( S.I. No. 79 of 1996 ), are hereby revoked.

EXPLANATORY NOTE
These Regulations amend the Environmental Protection Agency (Licensing) Regulations, 1994 ( S.I. No. 85 of 1994 ), for the purpose of prescribing the day on or after which specified classes of activity in the First Schedule to the Environmental Protection Agency Act, 1992 , will require an integrated pollution control licence in accordance with section 82(1) of the Act.
The Regulations also specify the "relevant day" for the purposes of "established activity" in section 3 of the 1992 Act in respect of specified classes of activity in the First Schedule to the Act.
The Regulations revoke Environmental Protection Agency (Licensing) (Amendment) Regulations, 1995 ( S.I. No. 59 of 1995 ), and Environmental Protection Agency (Licensing) (Amendment) Regulations, 1996 ( S.I. No. 79 of 1996 ).
