I, Micheál Martin, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directives 2002/34/EC, 2003/1/EC and 2003/16/EC of the 15 April 2003, 6 January 2003 and 19 February 2003 respectively and to the second paragraph of Article 4 of Directive 2003/15/EC48 of the 27 February 2003, hereby make the following regulations:

1.         These Regulations may be cited as the European Communities (Cosmetic Products (Amendment) (No. 5) Regulations 2003.

2.         These Regulations shall be construed as one with the European Communities (Cosmetic Products) Regulations 1997 (S.I. No. 87 of 1997 ), the European Communities(Cosmetic Products) Regulations 1998 (S.I. No. 213 of 1998 ), the European Communities(Cosmetic Products) (Amendment No. 2) Regulations 2000 (S.I. No. 150 of 2000 ), the European Communities(Cosmetic Products) (Amendment No. 3) Regulations 2000 (S.I. No. 203 of 2000 ) and the European Communities (Cosmetic Products) (Amendment No. 4) Regulations 2004 (S.I. No. 227 of 2000 ) and may be cited together with those Regulations as the

European Communities (Cosmetic Products) Regulations 1997 to 2003.

3.         In these Regulations “the Principal Regulations” mean the European Communities (Cosmetic Products) Regulations 1997 (S.I. No 87 of 1987 ).

4.         The Principal Regulations are amended by —
(a)  the addition to the definition of “the Principal Directive”, in regulation 4(1 thereof of the references “2002/34/EC49 ”, “2003/1/EC50 ” and “2003/16/EC51 ”,
and
(b)  the deletion of sub-paragraph (f) in regulation 7(1) thereof.

5.         The Schedules to the Principal Regulations are amended in the manner set out in the Schedule to these Regulations.

6.         The provisions of these Regulations, as they apply to those substances that are included in the Annex to Commission Directive 2002/34/EC, shall not apply to the sale or supply of cosmetic products to the final consumer until 15th April 2004.
Schedule
1.   Schedule 2 to the Principal Regulations is amended as follows:
(a)  The following new entries are added:

451.       Methyleugenol (CAS No. 95-15-2) except for normal content in the natural essences used and provided that the concentration does not exceed:
(a)  0.01% in fine fragrance
(b)  0.004% in eau de toilette
(c)  0.002% in fragrance cream
(d)  0.001% in rinse-off products
(e)  0.0002% in other leave-on products and oral hygiene products
(b) The entries numbered 293 and 419 are substituted as follows:-
293.       Radioactive substances, as defined by Directive 96/29/Euratom1 laying down basic safety standards for the protection of the health of workers and the general public against the dangers arising from ionising radiation.
419.       From the date referred to in Article 22(1) of Regulation (EC) No 999/2001 of the European Parliament and of the Council2 , the specified risk materials as designated in Annex V to that Regulation and ingredients derived therefrom.
Until that date, the specified risk materials as designated in Annex XI Part A to Regulation (EC) No 999/2001, and ingredients derived therefrom.
However, tallow derivatives may be used provided that the following methods have been used and strictly certified by the producer:
-       transesterification or hydrolysis at at least: 200 °C, 40 bars (40,000 hPa) for 20 minutes (glycerol and fatty acids and esters),
-       saponification with NaOH 12M (glycerol and soap):
-       batch process: at 95 °C for 3 hours, or
-       continuous process: at 140 °C, 2 bars (2 000 hPa) for 8 minutes or equivalent
2.   Part 1 of Schedule 3 to the Principal Regulations is amended as follows:
(a)  The entry in Column b for substance No. 8 is replaced by the following:
“m- and p-Phenylenediamines, their N-substituted derivatives and their salts; N-substituted derivatives of o-Phenylenediamines3 , with the exception of those derivatives listed elsewhere in this Schedule”
(b)  The entries for substances numbered 15b, 15c, 16 and 66 are substituted as set out in the following Table:-

EXPLANATORY NOTE
(This note is not part of the Instrument and does not purport to be a legal interpretation.)
The principal purpose of these Regulations is to up-date the law in relation to the manufacture, marketing and sale of cosmetic products by the implementation of Commission Directives 2002/34/EC, 2003/1/EC and 2003/16/EC relating to cosmetic products.
The purposes of the changes are to improve the safety of cosmetic products being placed on the market. They have been introduced following safety assessments carried out by the EU Scientific Committee on Cosmetic Products and Non Food Products (SCCNFP). Amongst the changes that are being introduced in these Regulations is the prohibition of twenty eight fragrance ingredients that must not be used as such in cosmetic products.
