I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by section 3 (4) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (No. 3 of 1992) hereby make the following regulations:

 1. These Regulations may be cited as the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (Allowances (Amendment) Regulations 2003.

 2. These Regulations are to be taken to have come into operation on the 1 January 2003.

 3. The Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (Allowances) (Amendment) Regulations 1996 ( S.I. No. 315 of 1996 ), are amended by substituting the following for Regulation 7:
“7 (1) Where a member of Dáil Eireann, in respect of whose secretarial assistant accommodation is not provided in Leinster House, incurs expenses——
( a ) in establishing and equipping such accommodation elsewhere than in Leinster House, the appropriate authority shall, following receipt of a claim under paragraph (3) of this Regulation, pay to that member a sum of not more than €8,888.17 in final settlement of the expenses, and
( b ) in maintaining such accommodation otherwise than in Leinster House the appropriate authority shall, following receipt of a claim under paragraph (3) of this Regulation, pay to that member a sum of not more than €8,888.17 per year.
(2) The sum referred to in paragraph (1)(b) of this Regulation shall be paid in tranches of €4,444.08 on 1 January and €4,444.09 on 1 July in each year.
(3) A claim by a member for payment of a sum under this Regulation shall be made to the appropriate authority and shall be made in such form and contain such particulars as the Minister may from time to time direct.
(4) The State shall not provide a member to whom paragraph (1) refers, with accommodation for his or her secretarial assistant in Leinster House, or with any form of assistance (including furniture or equipment other than a printer, computer and software associated with it) towards the provision of accommodation elsewhere than in Leinster House otherwise than under this Regulation.
(5) In this Regulation ‘Leinster House’ includes any office premises provided by the State in the vicinity of Leinster House for use by members of Dáil Eireann.”.
