HOUSING (SITE SUBSIDY) REGULATIONS 2005
The Minister for the Environment, Heritage and Local Government in exercise of the powers conferred on him by section 5 of the Housing Act 1966 (No. 21 of 1966), as amended by section 24 of the Housing (Miscellaneous Provisions) Act 1992 (No. 18 of 1992) and by section 14 of the Housing Act 1988 (No. 28 of 1988), with the consent of the Minister for Finance, hereby makes the following Regulations:

1.       These regulations may be cited as the Housing (Site Subsidy Regulations 2005.

2.       (1)      In these Regulations, any reference to an article is a reference to an article of these Regulations and any reference to a sub-article is a reference to a sub-article of the article in which the reference occurs.
(2)      In these Regulations -
“affordable house” has the meaning given to it in section 5 of the Housing (Miscellaneous Provisions) Act 2002 (No. 9 of 2002);
“City” has the meaning given to it in section 10 of the Local Government Act 2001 (No. 37 of 2001);
“Dublin Metropolitan Area” means the area comprising the city of Dublin and the counties of Dun Laoghaire-Rathdown Fingal, South Dublin and certain District Electoral Divisions in Kildare, Meath and Wicklow as described as being part of the Dublin Metropolitan Area in the Regional Planning Guidelines for the Greater Dublin Area 2004 - 2016;
“house” has the meaning given to it in section 2 of the Housing (Miscellaneous Provisions) Act 2002 ;
“housing authority” has the meaning given to it in section 23 of the Housing (Miscellaneous Provisions) 1992 as amended by section 16 of the Housing (Miscellaneous Provisions) Act 2002 ;
“low cost site” means a site provided by a housing authority at low cost to assist persons to provide their own housing;
“Minister” means the Minister for the Environment Heritage and Local Government;
“purchaser” means the person or persons to whom an affordable house or a new house under a shared ownership lease or a low cost site is sold;
“shared ownership lease” has the meaning given to it in section 2 of the Housing (Miscellaneous Provisions) Act 1992 as amended by section 16 of the Planning and Development (Amendment) Act 2002 (No. 32 of 2002);
“site subsidy” means a subsidy payable under section 14 of the Housing Act 1988 .

3.       (1)      A site subsidy may be payable by the Minister to a housing authority in respect of an affordable house or a new house provided under a shared ownership lease or a low cost site.
(2)      In the Dublin Metropolitan Area and the cities of Cork Limerick, Waterford and Galway, the amount of the site subsidy payable from 1 January 2006 shall be €50,000 or the cost of the site including acquisition and development costs and excluding building costs, whichever is the lesser.
(3)      Outside the Dublin Metropolitan Area and the cities of Cork, Limerick, Waterford and Galway, the amount of the site subsidy payable from 1 January 2006 shall be €31,800 or the cost of the site including acquisition and development costs and excluding building costs, whichever is the lesser.

These regulations provide for
I.   Payment of a site subsidy; and
II.  Site subsidy amounts payable in cities, the Dublin Metropolitan Area and other areas.
