Ethics in Public Office (Designated Positions in Public Bodies) (Amendment) Regulations 2005
I, BRIAN COWEN, Minister for Finance, in exercise of the powers conferred on me by sections 3 and 18 of the Ethics in Public Office Act 1995 (No. 22 of 1995), and in relation to offices prescribed for the purposes of the said section 18 consider it necessary in the public interest to prescribe the offices specified in the following regulations, and after consultation with such other Ministers of the Government as I consider appropriate, hereby make the following regulations:
1. (1) These Regulations may be cited as the Ethics in Public Office (Designated Positions in Public Bodies) (Amendment) Regulations 2005.
(2) These Regulations come into operation on 1 January 2006.
2. The Ethics in Public Office (Designated Positions in Public Bodies) Regulations 2004 ( S.I. No. 698 of 2004 ) are amended by substituting for -
(a) paragraph 6 the following -
“6. The following offices are prescribed for the purposes of section 18(3)(b)(v) of the Act -
(a) office of Director of Public Prosecutions,
(b) office of Appeal Commissioner for the purposes of the Income Tax Acts (within the meaning of the Taxes Consolidation Act 1997 (No. 39 of 1997)),
(c) office of Director of Corporate Enforcement,
(d) office of Information Commissioner,
(e) office of Registrar of Friendly Societies,
(f) office of Ombudsman for Children,
(g) office of Pensions Ombudsman,
(h) office of Chief Science Adviser to the Government,
(i) office of Coimisinéir Teanga,
(j) office of Controller of Patents, Designs and Trade Marks,
(k) office of Defence Forces Ombudsman,
(l) office of Financial Services Ombudsman, and
(m) office of Deputy Financial Services Ombudsman.”, and
(b) the matter in the Schedule the matter in the Schedule to this Regulation.

EXPLANATORY NOTE
(This note is not part of the Instrument and does not purport to be a legal interpretation).
These regulations are made under the Ethics in Public Office Act 1995 (No. 22 of 1995) to apply the provisions of the Act to persons occupying specified positions of employment in the Civil Service. The Regulations designate certain positions in the Civil Service as “designated positions of employment” as defined in Section 18 of the Act. Persons occupying positions designated in these regulations are required, where a registrable interest or interests (as defined in the Second Schedule to the Act) exists, to furnish a statement of registrable interests to the relevant authority for the position (as defined in Section 18 of the Act). If no such registrable interest exists a nil statement is requested.
The relevant authority for each designated position of employment will be specified by the Minister for Finance and will be available in the Standards in Public Office Commission's “Guidelines on Compliance with the Provisions of the Ethics in Public Office Acts 1995 and 2001 - Public Servants (Fourth Edition)”.
