PRIVATE SECURITY (LICENCE FEES) REGULATIONS 2006
The Private Security Authority, in exercise of the powers conferred on it by section 51 of the Private Security Services Act 2004 , (No. 12 of 2004) and with the consent of the Minister for Justice, Equality and Law Reform, hereby makes the following regulations:

1.     These Regulations may be cited as the Private Security (Licence Fees Regulations 2006.

2.     These Regulations come into operation on the 1st day of September 2006.

3.     In these Regulations -
“Act” means the Private Security Services Act 2004 ;
“applicant” means an individual who is an applicant for a licence;
“Authority” means the Private Security Authority;
“category of licence” means a category of licence referred to in Regulation 4 of the 2006 Regulations;
“individual” has the meaning given to it by the 2006 Regulations;
“licence” means a licence issued to an individual under Regulation 4 of the 2006 Regulations;
“licence fee” has the meaning given to it in Regulation 4.
“2006 Regulations” means the Private Security (Licensing and Qualifications Regulations 2006 ( S.I. No. 468 of 2006 )

4.          Subject to Regulations 5 and 7, the applicant shall pay to the Authority a licence fee which shall be determined by reference to the following table:-

5.           An applicant who applies for more than one licence at the same time shall pay to the Authority the fee prescribed by Regulation 4 less €20.

6.           Where -
(a)        a licence issued by the Authority has not expired,
(b)        the holder of the licence applies to the Authority for a licence in a different category and
(c)        each of the licences relates to a category of security services which may be provided by one of the persons mentioned in paragraph (a) to (h) of the definition of “security service” in section 2(1) of the Act,
a licence fee is not payable in respect of the licence in a different category. The provisions of this paragraph do not apply on renewal of any licence.

7.          Licence fees payable in respect of applications for licences under the 2006 Regulations which are received by 5 p.m. on 1 December 2006 are:
(a)  €75 for a door supervisor (licensed premises) licence;
(b)  €50 for a security guard (static) licence.
provided that the Authority is satisfied that the qualification specified in relation to the applicant in Regulation 5 of the 2006 Regulations is held by him or her on that date.
The Minister for Justice, Equality and Law Reform consents to the making of the foregoing Regulations.
