The Government, in exercise of the powers conferred on them by sections 3A (inserted by section 40 of the Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 (No. 33 of 2001)), 4, 5 and 8 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (No. 5 of 1998), hereby order as follows:

1.  This Order may be cited as the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (Allowances and Allocations)(Amendment) Order 2006.

2.  In this Order “Principal Order” means the Oireachtas (Allowances to Members and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (Allowances and Allocations) Order 2003 ( S.I. No. 59 of 2003 ).

3.  Article 2 of the Principal Order is amended—
(a)      in paragraph (2) by substituting “beginning on or after 7 November 2002 and ending on or before 6 December 2005” for “beginning on 7 November 2002”, and
(b)     by inserting the following after paragraph (2):
“(3)      There is payable to -
(a)      Tom Kitt, Minister of State at the Department of the Taoiseach, and
(b)      Brian Lenihan, Minister of State at the Department of Health and Children, at the Department of Justice, Equality and Law Reform and at the Department of Education and Science,
as the holder of that position and those positions, respectively an allowance at the rate of €17,698 per year, for any period beginning on or after 7 December 2005 in respect of duties to attend at Government meetings as holders of those positions.”.

4.  Article 6 of the Principal Order is amended—
(a)      in paragraph (2) by substituting “beginning on or after 7 November 2002 and ending on or before 22 February 2005” for “beginning on 7 November 2002”, and
(b)      by inserting the following after paragraph (2):
“(3)      There is payable to a member of the Oireachtas who holds or held the position of chairperson of an Oireachtas sub-Committee specified in column (2) of Part 1 of Schedule 3 at any reference number, an allowance in respect of the member's duties as holder of that position, at the rate per year specified in column (3) of that Schedule opposite that reference number, in respect of any period beginning on or after 23 February 2005 during which the member held that position.”.

5.  Article 9 of the Principal Order is amended—
(a)      in paragraph (2) by substituting “beginning on or after 7 November 2002 and ending on or before 31 December 2004” for “beginning on 7 November 2002”, and
(b)      by inserting the following after paragraph (2):
“(3)      There is allocated to the chairperson of an Oireachtas Committee specified in column (2) of Part 2 of Schedule 3 at any reference number, an annual amount, at the rate per year specified in column (3) of that Schedule opposite that reference number, to enable allowances to be paid, at rates determined by that Committee, to—
(a)      members of the Committee, or
(b)      members of any sub-Committee of the Committee,
other than those holding a position mentioned in section 3 or 4 of the Oireachtas (Allowances to Members) and Ministerial Parliamentary, Judicial and Court Offices (Amendment) Act 1998 (No. 5 of 1998), in respect of the performance of specific duties assigned to them by the Committee or sub-Committee and that relate to its operation, in respect of any period beginning on or after 1 January 2005.”.

6.  The Principal Order is amended by inserting the following Schedule after Schedule 2:
