I, SEAN CONNICK, Minister of State at the Department of Agriculture, Fisheries and Food, in exercise of the powers conferred on me by sections 3 and 15 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea-Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 ( S.I. No. 707 of 2007 ) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 2007 ( S.I. No. 705 of 2007 )) and the Agriculture, Fisheries and Food (Delegation of Ministerial Functions) Order ( S.I. No. 303 of 2010 ), hereby make the following regulations:
1. These Regulations may be cited as the Sea-fisheries (Control on fishing for razor clams in Rosslare Harbour) (Amendment) Regulations 2010.
2. The Sea-fisheries (Control on fishing for razor clams in Rosslare Harbour) Regulations 2010 ( S.I. No. 310 of 2010 ) are amended—
(a) by the substitution, for Regulation 4(1) (a), of—
“(a) outside of the hours of 07.00 to 19.00,”,
(b) by the substitution, for Regulation 4(4), of—
“(4) A person shall not have in his or her possession or under his or her control, buy, handle, weigh, transport, process, store, document or sell razor clams caught, landed or transhipped in contravention of this Regulation.”,
(c) by the deletion of Regulation 7, and
(d) by the substitution, for Regulation 8, of—
“8. A person shall not contravene Regulation 4, 5, or 6.”.

The effect of these Regulations is to amend the regulations regulating the razor clam Fishery in Rosslare Harbour, specifically to allow for a modification in the allowed fishing times and the removal of the closing date previously in place for the fishery.
