Notice of the making of this Statutory Instrument was published in
“Iris Oifigiúil” of 8th January, 2010.
The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by sections 8 and 27 of the Wildlife Act, 1976 (No. 39 of 1976) as amended by section 7 of the Wildlife (Amendment) Act, 2000 (No. 38 of 2000) (as adapted by the Environment and Local Government (Alteration of Name of Department and Title of Minister Order 2003 ( S.I. No. 233 of 2003 )) and being satisfied that because of the severity of weather conditions occurring in the State it is desirable, in the interest of conserving wild birds, to make an order under section 27 of the Wildlife Act, 1976 (No. 39 of 1976),

hereby orders as follows:
1. This Order may be cited as the Wildlife Act 1976 (Temporary Suspension of Open Season) Order 2010.
2. The Wildlife (Wild Birds) (Open Seasons) Orders, 1979 to 2003, and this Order may be cited together as the Wildlife (Wild Birds) (Open Seasons) Orders, 1979 to 2010.
3. The hunting of any protected wild bird which is of a species specified in the Schedule to this Order being species each of which is specified in the Wildlife (Wild Birds) (Open Seasons) Order, 1979 ( S.I. No. 192 of 1979 ) as amended by the Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1980 (S. I. No. 229 of 1980); Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1982 ( S.I. No. 266 of 1982 ); Wildlife (Wild Birds) (Open Season) (Amendment) Order, 1984 ( S.I. No. 283 of 1984 ); Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 1985 ( S.I. No. 346 of 1985 ); Wildlife (Wild Birds) (Open Seasons) (Amendment) (No. 2) Order, 1985 ( S.I. No. 347 of 1985 ); Wildlife (Wild Birds) (Open Seasons)

No. 332 of 1998 ); Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 2000 ( S.I. No. 280 of 2000 ); Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 2001 ( S.I. No. 428 of 2001 ) and Wildlife (Wild Birds) (Open Seasons) (Amendment) Order, 2003 ( S.I. No. 394 of 2003 ) is hereby prohibited throughout the State during the period beginning on the commencement of this Order and ending on the 15th day of January, 2010.

Mallard, Teal, Gadwall, Wigeon, Pintail, Shoveler, Scaup, Tufted Duck, Pochard, Goldeneye, Golden Plover, Snipe, Jack Snipe, Woodcock, Canada Goose, Greylag Goose, Ruddy Duck

EXPLANATORY NOTE

The effect of this Order is to suspend temporarily the hunting of wild birds listed in the Schedule during the period mentioned, due to the severity of weather conditions.
