Notice of the making of this Statutory Instrument was published in
“Iris Oifigiúil” of 28th September, 2012.
I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving effect to Commission Regulation (EU) No 225/2012 of 15 March 20121 and Commission Regulation (EC) No 669/2009 of 24 July 20092 , hereby make the following regulations:
1. These Regulations may be cited as the European Communities (Food and Feed Hygiene) (Amendment) (No 2) Regulations 2012.
2. The European Communities (Food and Feed Hygiene) Regulations 2009 ( S.I. No. 432 of 2009 ) are amended by—
(a) in Regulation 2(1), substituting for the definition of “Regulation 183/2005” (as amended by the European Communities (Food and Feed Hygiene) (Amendment) Regulations 2012 ( S.I. No. 164 of 2012 )) for the following—
“‘Regulation 183/2005’ means Regulation (EC) No 183/2005 of the European Parliament and of the Council of 12 January 2005 as amended by Regulation (EC) No 219/2009 of the European Parliament and of the Council of 11 March 2009 and Commission Regulation (EU) No 225/2012 of 15 March 2012;”, and
(b) in Regulation 27A(1) (inserted by the European Communities (Food and Feed Hygiene) (Amendment) Regulations 2010 ( S.I. No. 312 of 2010 )) for the following—
“27A.(1) The designated points of entry for the purposes of Article 5 of Commission Regulation (EC) No 669/2009 of 24 July 2009 are—
(a) Dublin Port in respect of animal feed, or
(b) Dublin Airport or Dublin Port in respect of fruit and vegetable products.”.
3. The following are revoked—
(a) European Communities (Feedingstuffs) (Methods of Sampling and Analysis) Regulations 1999 ( S.I. No. 289 of 1999 ),
(b) European Communities (Feedingstuffs) (Methods of Sampling and Analysis) (Amendment) Regulations 2000 ( S.I. No. 288 of 2000 ),
(c) European Communities (Feedingstuffs) (Methods of Sampling and Analysis) (Amendment) Regulations 2004 ( S.I. No. 185 of 2004 ).

EXPLANATORY NOTE
(This note is not part of the instrument and does not purport to be a legal interpretation)
These Regulations update the principal Food and Feed Hygiene Regulations 2009 ( S.I. No 432 of 2009 ) in relation to:
(i) the approval and requirements for establishments placing on the market, for feed use, products derived from vegetable oils and blended fats;
and
(ii) officially nominating import Designated Points of Entry.
