I, JOAN BURTON, Minister for Social Protection, in exercise of the powers conferred on me by section 4 (amended by section 96 of the Ministers and Secretaries (Amendment) Act 2011 (No. 10 of 2011)) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), and by sections 49 (amended by section 5 of the Social Welfare and Pensions Act 2013 (No. 38 of 2013)) and 60 (amended by section 6 of the Social Welfare and Pensions Act 2013 ) of the Social Welfare

Consolidation Act 2005 , with the consent of the Minister for Public Expenditure and Reform, hereby make the following Regulations:
Citation and construction.
1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 9) (Maternity and Adoptive Benefit) Regulations 2013.
(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2013 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2013.
Commencement.
2. These Regulations come into operation on 6 January 2014.
Maternity and adoptive benefit.
3. The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) are amended—
(a) in article 32(2) by substituting “section 49(1)(a)(iii)” for “section 49(1)(c)”, and
(b) in article 40(2) by substituting “section 60(1)(a)(iii)” for “section 60(1)(c)”.
The Minister for Public Expenditure and Reform consents to the foregoing Regulations.

EXPLANATORY NOTE
(This Note is not part of the Instrument and does not purport to be a legal interpretation.)
Sections 5 and 6 of the Social Welfare and Pensions Act 2013 provide for the alignment of the minimum and maximum rates of Maternity and Adoptive Benefit to a standard rate of €230 per week for new claimants with effect from 6 January 2014.
These Regulations provide for consequential changes to references to certain provisions of the Social Welfare Consolidation Act 2005 which are contained in the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007.
