Notice of the making of this Statutory Instrument was published in

I, ALAN KELLY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 2 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014), hereby order as follows:
1. This Order may be cited as the Housing (Miscellaneous Provisions) Act 2014 (Commencement of Certain Provisions) Order 2014.
2. The 15th day of September 2014 is appointed as the day on which the following provisions of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014) come into operation:
(a) Part 1 (sections 1 to 5);
(b) in Part 3, paragraph (d) of section 34;
(c) in Part 4—
(i) section 35,
(ii) section 36, other than in so far as it relates to section 47 of that Act,
(iii) sections 37 to 40,
(iv) section 41, other than subsection (4),
(v) sections 42 and 43,
(vi) sections 45 and 46, and
(vii) sections 49 to 51;
(d) in Part 5—
(i) section 52,
(ii) section 54, other than subsection (1), and
(iii) sections 55 to 58.

EXPLANATORY NOTE
(This note is not part of the Instrument and does not purport to be a legal interpretation)
The main purpose of this commencement order is to bring into operation on 15 September 2014 most of Part 4 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014) relating to the new housing assistance payment scheme. Regulations have also been made under section 50 of the Act providing that, in order to facilitate the introduction of housing assistance, Part 4 of the Act will be applied from 15 September 2014 by certain housing authorities only. The intention is that further Regulations will be made in due course providing for the application by other housing authorities of Part 4 of the 2014 Act.
The order also commences on 15 September 2014 the preliminary and general provisions in Part 1 of the 2014 Act and most of the miscellaneous provisions in Part 5, including amendments to the Social Welfare Consolidation Act 2005 consequent on the introduction of housing assistance and new provisions in respect of data sharing and exchange between housing authorities and specified persons.
