Social Welfare Consolidation Act 2005
(No. 26 of 2005), hereby make the following Regulations:
Citation and construction
1. (1) These Regulations may be cited as the Social Welfare (Consolidated Occupational Injuries) (Amendment) (No. 1) Regulations 2017.
(2) These Regulations and the Social Welfare (Consolidated Occupational Injuries) Regulations 2007 to 2015 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Occupational Injuries) Regulations 2007 to 2017.
Commencement
2. These Regulations come into operation—
(a) in so far as they relate to injury benefit, on 13 March 2017, and
(b) in so far as they relate to disablement pension and disablement gratuity, on 17 March 2017.
Definition
3. In these Regulations “the Principal Regulations” means the Social Welfare (Consolidated Occupational Injuries) Regulations 2007 (

).
Increased rates of benefits and pensions under the occupational injuries scheme
4. The Principal Regulations are amended by—
(a) the substitution of the Schedule set out in Schedule A to these Regulations for Schedule 1 (amended by article 4 the Social Welfare (Consolidated Occupational Injuries) (Amendment) Regulations 2010 (
S.I. No 683 of 2010
)), and
(b) the substitution of the Schedules set out in Schedule B to these Regulations for Schedule 3 (amended by article 4 of the Social Welfare (Consolidated Occupational Injuries) (Amendment) Regulations 2010) (
S.I. No 683 of 2010
)), and Schedule 3A (inserted by article 6 of the Social Welfare (Consolidated Occupational Injuries) (Amendment) (No. 2) Regulations 2011 (
S.I. No 730 of 2011
), subject in respect of the Scales set out in the said Schedule B, to the following provisions—
(i) the rates of pension specified in columns (3) of the Scales shall have effect on and from 17 March 2017 whether the period taken into account by the assessment began on, before, or after that date, and,
(ii) the amounts of gratuity specified in columns (2) of the Scales shall be payable only where the period taken into account by the assessment of the degree of disablement began on or after 17 March 2017.

EXPLANATORY NOTE
(This note is not part of the Instrument and does not purport to be a legal interpretation.)
Section 21 of, and Schedule 1 to, the
Social Welfare Act 2016
provide for an increase in the maximum rate of Injury Benefit payable from 13 March 2017 and for increases in the rates of benefits payable under the Occupational Injuries Benefits Scheme from 17 March 2017. Parts 2-3 of Schedule 1 provide for increases to the maximum rate of Disablement Gratuity and the weekly rates of Disablement Pension where the degree of disablement ranges from 100 per cent to 20 per cent.
These Regulations provide for increases in the rate of Disablement Gratuity and the weekly rates of Disablement Pension where the degree of disablement ranges from 1 per cent to 19 per cent. The rates provided for in Schedule 3 apply in respect of a continuing disablement of between 1 and 19 per cent which arose prior to 1 January 2012. Schedule 3A applies where the disablement occurs after 1 January 2012 and in such a case, Disablement Gratuity and Disablement Pension are payable only where the extent of disablement is greater than 14 per cent.
The Regulations also provide for an increase in the rate of Injury Benefit payable to persons under the age of sixteen. If, in such a case, there is what amounts to full-time employment, or substantially full-time employment, the weekly rate will increase by €5.00 (from €188.00 to €193.00). This is the same rate as the maximum rate payable to an adult. In all other cases the rate will increase by €2.40 (from €89.90 to €92.30).
The rate increases provided for by these Regulations come into effect on 13 March 2017 in the case of Injury Benefit and on 17 March 2017 in the case of Disablement Gratuity and Disablement Pension to coincide with the increases in rates provided for by the
Social Welfare Act 2016
