The Government, in exercise of the powers conferred on them by sections 3 (as amended by

section 39

of the

Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001

(No. 33 of 2001) (“Act of 2001”) and

section 8

(5) of the

Houses of the Oireachtas Commission Act 2003

(No. 28 of 2003)), 3A (inserted by section 40 of the Act of 2001), 4 and 8 (as amended by section 43 of the Act of 2001) of the

Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act 1998

(No. 5 of 1998)), hereby order as follows:


1. This Order may be cited as the Oireachtas (Allowances) (Members and Holders of Parliamentary and Certain Ministerial Offices) Order 2017.


2. There is payable to a member of Dáil Éireann who holds or held a position in Dáil Éireann specified in column (2) of Schedule 1 at any reference number, an allowance, in respect of the member’s duties as holder of that position, annually at the rate specified in column (3) of that Schedule opposite that reference number, in respect of any period, beginning on or after 10 March 2016, during which the member held that position.


3. There is payable to a member of Seanad Éireann who holds or held a position in Seanad Éireann, specified in column (2) of Schedule 2 at any reference number, an allowance, in respect of the member’s duties as holder of that position, annually at the rate specified in column (3) of that Schedule opposite that reference number, in respect of any period, beginning on or after 25 April 2016, during which the member held that position.


4. There is payable to a member of Dáil Éireann who holds or held a position as a member of the Houses of the Oireachtas Commission an allowance in respect of the member’s duties as holder of that position, at the rate of €8,740 annually, in respect of any period, beginning on or after 1 July 2016, during which the member held that position.


5. There is payable to a member of Seanad Éireann who holds or held a position as a member of the Houses of the Oireachtas Commission an allowance in respect of the member’s duties as holder of that position, at the rate of €5,989 annually, in respect of any period, beginning on or after 7 July 2016, during which the member held that position.


6. There is payable to—


(a) Finian McGrath, Minister of State at—


(i) the Department of Social Protection,


(ii) the Department of Justice and Equality, and


(iii) the Department of Health,


and


(b) Paul Kehoe, Minister of State at—


(i) the Department of the Taoiseach, and


(ii) the Department of Defence,


for any period beginning on or after 6 May 2016, as the holders of those offices, respectively, who regularly attend meetings of the Government, an annual allowance at the rate of €15,829.


7. There is payable to a member of the Oireachtas who holds or held the position of chairperson of an Oireachtas Committee specified in Schedule 3 at any reference number, an allowance, in respect of the member’s duties as holder of that position, annually at the rate specified in column (3) of that Schedule opposite that reference number, in respect of any period, beginning on or after 20 April 2016, during which the member held that position.


8. The following are revoked:


(a) the Oireachtas (Allowances) (Members and Holders of Parliamentary and Certain Ministerial Offices) Order 2011 (

S.I. No. 347 of 2011

);


(b) the Oireachtas (Allowances) (Chairpersons of Oireachtas Committees and Certain Ministers of State) Order 2015 (

S.I. No. 12 of 2015

).

The annual rates specified in this Order are the current rates applicable following the reductions to remuneration applied from 1 July 2013 under the

Financial Emergency Measures in the Public Interest Act 2013

and will be subject to the provisions of the

Financial Emergency Measures in the Public Interest Act 2015

in due course.
