HOUSING OF LABOUR WORKERS ON SUGAR
ESTATES ACT
ARRANGEMENT OF SECTIONS

1. This Act may be cited as the Housing of Labour
Workers on Sugar Estates Act.
2. In this Act—
“exporter” means any person operating a factory in Guyana
and manufacturing sugar for export;
“labour worker” means—
(a) any person engaged in manual labour in or about
any work incidental to the cultivation of sugar
cane and the manufacture of sugar;

(b) any person employed as a headman, foreman,
sugar boiler, clerk or laboratory assistant or in any
similar capacity in or about any work incidental to
the cultivation of sugar cane and the manufacture
of sugar;
(c) any person engaged in the cultivation of sugar cane
for sale to an exporter;
(d) any worker employed in a distillery or any
duly registered sicknurse and dispenser
employed by an exporter;
(e) any driver of a motor-vehicle used for the
transportation of sugar in bulk for export in bulk
by an exporter;
(f) any person employed as a foreman or clerk or in
any similar capacity in or about any work
incidental to the exportation of sugar in bulk by an
exporter; and

(g) any person employed by the Demerara Sugar
Terminals Limited, not being a person who is -
(i) a director or manager, or such other
person (by whatever name called) who,
in the opinion of the Committee referred
to in section 4, exercises managerial
functions;
(ii) employed in a professional or
administrative capacity or a combination
of both of those capacities;
(h) any person belonging to such class of persons
engaged in the loading of sugar for export as the
Minister may, from time to time, approve for the
purpose by direction in writing.

3. (1) Any lease of immovable property to which this
section applies for a term of twenty-one years or more, or for
any term renewable at the will of the lessee indefinitely, or for
periods which, together with the first term thereof, amount in
all to twenty-one years or more, and any surrender,
assignment or transfer thereof, shall have effect as if such
lease, surrender, assignment or transfer had been passed and
executed before the High Court in the manner specified in
section 13 of the Deeds Registry Act.
(2) This section applies to any lease (including any
surrender, transfer or assignment thereof) granted to any
labour worker—
(a) in respect of any immovable property owned by
the Committee referred to in section 4 or by any
company engaged in the manufacture of sugar or
in the cultivation of sugar cane;
(b) by the State in respect of any immovable property
to which, but for the conveyance to the State of the
title thereto by the Committee or by such a
company, as is mentioned in paragraph (a), the
foregoing provisions of this section would apply.
(3) The parties to a lease, surrender, assignment or
transfer as referred to in subsection (1), shall forthwith
cause such lease, surrender, assignment or transfer, as the
case may be, to be filed as of record in the Deeds Registry and
pay such fees as may be prescribed under the Deeds Registry
Act, save however, that notwithstanding anything to the
contrary in any law the failure to file such a lease, surrender,
assignment or transfer, made prior to the coming into
operation of this section, shall not affect the validity of such
lease, surrender, assignment or transfer.
4. (1) Notwithstanding the provisions of any Act to the
contrary, where any loan has been made by the Committee
from the Fund to a labour worker for the purpose of enabling

repayment of

such worker to erect and own a house on land to which
section 3 applies, or to extend, improve or repair his own
house on such land, the labour worker shall sign a
promissory note and a receipt, and such receipt shall have
effect as an assignment to the Committee of the labour
worker’s right, title and interest in the house and land as
security for the repayment to the Committee of the loan.
(2) In this section—
“the Committee” means the Committee appointed under
section 8 (2) of the Sugar Industry Special Funds Act;
and
“the Fund” means the Sugar Industry Labour Welfare Fund
established by section 2 of the Sugar Industry Special
Funds Act.
