22 of 1953 An Act to incorporate the Guyana Methodist Trust
Corporation to hold the property in Guyana of the
Methodist Church in the Caribbean and Americas and
for purposes connected therewith.
[14th MAY, 1979]
Short title.
Interpretation
1. This Act may be cited as the Guyana Methodist
Trust Corporation Act.
2. In this Act—
“the Association” means the Methodist Missionary Trust
Association incorporated in England on 31st October,
1933 under the Companies Act 1929;

“the Church” means the Methodist Church in the Caribbean
and the Americas;
“the Committee” means the District Synod or the General
Purposes Committee of the Guyana District;
“the Conference” means the governing body of the Church;
“the Corporation” means the Corporation established by
section 3;
“the Guyana District” means the Guyana District of the
Methodist Church in the Caribbean and the Americas;
“the Missionary Society” means the Methodist Missionary
Society.
“the Ordinance” means the Methodist Missionary Society
(Vesting of Property) Ordinance.
3. (l) There is hereby established a body corporate to
be known as the Guyana Methodist Trust Corporation which
shall consist of not less than four nor more than seven persons
as hereinafter provided.
(2) Subject to this Act and to the Constitution and
Discipline of the Church, the following persons shall be
the members of the Corporation, that is to say, the
Reverend Donald Cedric Henry, President of the Conference,
the Reverend Eric St. Claire Clarke, Secretary of the
Conference, the Reverend Edwin Derick Fitzgerald Vandeyar,
Chairman of the Guyana District, the Reverend George
Newton Frederick, Secretary of the Guyana District and
Harold Barrington Davis, Aubrey Ronald Fitz Bishop and Ella
Barrow being three other members holding office in that
behalf by virtue of their being appointed thereto by the
Committee, and their successors in office.
(3) The Chairman and the Secretary of the Guyana

District shall be the Chairman and the Secretary of the
Corporation, respectively.
4. In the event of the death or absence from Guyana
of any member of the Corporation, all or any of the powers
conferred on the Corporation by this Act may be exercised
by the surviving or remaining members, provided however,
that such powers may not be exercised by less than four
members of the Corporation.
5. A member shall continue in office until his tenure
of office terminates in accordance with the Constitution and
Discipline of the Church.
6. All property in Guyana which before the
commencement of this Act was vested in the Association and
all property in Guyana to which the said Association is
beneficially entitled shall be and the same are hereby vested,
without further assurance, in the Corporation.
7. All property of whatever nature or kind hereafter
bequeathed by will or otherwise acquired by the Church shall
be deemed to be the property of the Corporation.
8. All property vested in or hereafter acquired by the
Corporation shall be held by the Corporation for the use and
benefit of the Guyana District.

(2) Any other document not required by law to be
executed under seal shall be deemed to be duly executed if
signed by a person or persons authorised by the Corporation
so to sign and such person or persons shall be deemed to be
so designated in such document and to be so authorised,

unless the contrary is proved.
10. Any person signing as Chairman, Secretary or
member of the Corporation shall be taken so to be, until the
contrary is proved, and any statement or certificate that any
person named therein is the Chairman, Secretary or member
of the Corporation, or that a document is a true copy of any
document or of any extract from any document or entry in the
books or records of the Corporation purporting to be signed
by the Chairman, the Secretary or a member shall be
admissible as prima facie evidence of the fact of the original
document or entry.
11. Any document or process may be served on the
Corporation by—
(a) delivering it to the Chairman of the Guyana
District or the Secretary of the Corporation;
or
(b) sending it by registered post to the address
of the Corporation.
