Having regard to the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council and the Commission on budgetary discipline and improvement of the budgetary procedure(3),

Having regard to preliminary draft amending budget No 7 of the European Union for the financial year 2003 submitted by the Commission on 29 October 2003,

Having regard to draft amending budget No 6 of the European Union for the financial year 2003 established by the Council on 25 November 2003,

COMMISSION

EXPENDITURE

PART B

OPERATING APPROPRIATIONS

Part B appropriations cover operating expenditure directly related to the objective of the relevant programme or action, including expenditure on evaluation and technical and administrative assistance benefiting partners only. Special provisions apply to the following:

- expenditure on technical assistance, studies and information concerning the Structural Funds and the Cohesion Fund is governed by the provisions of Council Regulations (EC) No 1260/1999, (EC) No 1257/1999, (EC) No 1258/1999, (EC) No 1263/1999, (EC) No 2792/1999, (EC) No 1261/1999, (EC) No 1262/1999 and (EC) No 1164/94 as amended by (EC) No 1264/1999,

- expenditure on technical and administrative assistance is authorised if the remarks against the relevant heading expressly provide for this type of expenditure and lay down the expenditure ceiling.

For new programmes or actions, provision will have to be made in the specific legislation governing the relevant programme or action for expenditure on technical and administrative assistance to be charged against Part B and a decision will have to be taken by the budgetary authority laying down the ceiling.

The Commission undertakes to submit a special report to the budgetary authority, when the preliminary draft is drawn up, on the use of the appropriations entered in the B...A headings (see below).

Upon a reasoned request from either arm of the budgetary authority, the Commission must forward all appropriate information, including the results of work carried out by experts, concerning the implementation of programmes or actions.

ADMINISTRATIVE APPROPRIATIONS

The appropriations entered in the B...A headings are intended to finance, inter alia:

- expenditure on technical assistance concerning public authority tasks delegated by the Commission to implementing agencies governed by Community law,

- expenditure on technical and administrative assistance not involving public authority tasks outsourced by the Commission under ad hoc research or service contracts to bodies governed by private law.

The Commission undertakes to inform the budgetary authority about transfers from the main heading (B) to the B...A heading, and vice versa, and to report to it at the end of the financial year on the use of appropriations against the B...A heading.

Implementation:

There must be regular assessment of implementation of all programmes and grants to organisations financed or cofinanced by the operating part of the European Union budget. The budgetary authority must be informed about the results of those assessments, even if this is not expressly provided for in the legal basis.

Recipients of Commission budget allocations are requested to make it perfectly clear to the public that they are receiving financial assistance from the European Union.

SUBSECTION B2

STRUCTURAL OPERATIONS, STRUCTURAL AND COHESION EXPENDITURE, OTHER AGRICULTURAL AND REGIONAL OPERATIONS, TRANSPORT AND FISHERIES

General summary of appropriations (2003 and 2002) and outturn (2001)

STRUCTURAL FUNDS

Article 39 of Council Regulation (EC) No 1260/1999 (OJ L 161, 26.6.1999, p. 1) provides for financial corrections, any revenue from which is entered in Item 6 5 0 0 of the statement of revenue. That revenue may give rise to the provision of additional appropriations, in accordance with Article 18 of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (OJ L 248, 16.9.2002, p. 1), in specific instances where they are necessary to cover risks of cancellation or of reductions in corrections previously decided upon.

Regulation (EC) No 1260/1999 determines the conditions for repayment of an advance without having the effect of reducing the contribution from the Structural Funds towards the assistance concerned. Any revenue from the repayment of advances, which is entered in Item 6 1 5 7 of the statement of revenue, will give rise to the provision of additional appropriations in accordance with Articles 18 and 157 of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (OJ L 248, 16.9.2002, p. 1).

New measures to simplify Structural Funds management must be implemented as soon as possible.

CHAPTER B2-1 0 - OBJECTIVE 1

Measures to combat fraud are funded from Title B5-9.

The programme for peace and reconciliation in Northern Ireland and the border counties of Ireland (Peace II) is to be continued (Decision of Berlin European Council to provide EUR 500000000 for the continuation of the programme). Additionality is to be fully observed. The Commission is to submit an annual report to the European Parliament on this measure.

This appropriation is intended to cover the settlement of commitments entered into, in earlier programming periods, by the three Structural Funds and the FIFG in respect of innovative, preparatory, monitoring or evaluation measures, and any similar technical assistance measures provided for in the Regulations concerned.

It also funds the former multiannual measures, in particular those approved and implemented under the other abovementioned Regulations, which are not covered by the priority Objectives of the Funds.

This appropriation will also be used if necessary to cover financing due under the EAGGF, Guidance Section, the FIFG, the ERDF or the ESF for measures for which the corresponding commitment appropriations are not available or provided for in programming for 2000 to 2006.

In the case of the FIFG, this was expenditure relating to the support and financing of studies and projects relating to the conservation and management of fishery resources and the protection of marine species as well as the relationship between fisheries and the environment, the use of new techniques to improve the cost-benefit ratio of inspections, the formation of producer organisations and the institution of plans for improving the quality of their products, and networking among the various parties involved in the fishing industry using innovative techniques of communication and data exchange, including the running of such networks. The appropriation also covered pilot projects, project assessment, collecting basic data, organising meetings of experts and working groups, as well as assessing, publishing and otherwise disseminating results. Since 2001 the new resource-management support measures have been funded from Article B2-9 0 4.

B7-8 1 1 Contribution to international environmental activities

This appropriation is intended to cover the implementation of the fifth and sixth environmental action programmes, to promote measures and influence international responses to deal with global and transboundary environmental problems and the full and proper integration of environmental concerns into all aspects of the Community's external relations.

It is also intended to cover:

- obligatory and voluntary contributions to a number of international conventions, protocols and agreements, to which the Community is party to and preparatory work for future international agreements involving the Community,

- financial assistance to developing countries and NGOs to participate in work on existing, and preparatory work on future agreements,

- follow-up actions to the ratification and implementation of the Kyoto and Montreal Protocols (climate change and protection of the ozone layer),

- follow-up actions to the 2002 summit on sustainable development (Rio+ 10), and participation work on trade and the environment in the WTO and other international forum including cooperation with international organisations, notably UNEP, UN/CSD, OECD,

- establishment of a strong environmental pillar in the Euro-Med partnership,

- support to the candidate countries for actions that aim at improving the level of transposition, compliance and enforcement of the EU environmental acquis. The support in this field will be channelled through contractors, consultants and international organisations, including the Regional Environmental Centre with full coverage and representation in the candidate countries.

This appropriation is also intended to cover expenditure on grants and service contracts awarded under the Community action programme promoting non-governmental organisations (NGOs) primarily active in the field of environmental protection. The multiannual (2002 to 2006) programme extends the aims of the previous programme to include NGOs in the Balkan countries and candidate countries and acknowledges the importance attached to the role and input of these organisations in coordinating and channelling information and views on new and emerging environmental issues. The part of the programme relating to NGOs in the Community is detailed under Item B4-3 0 6 0.
