SUPPLEMENTARY PROTOCOL on products within the province of the European Coal and Steel Community

Heads of State of the Contracting Parties to the Treaty establishing the European Coal and Steel Community, hereinafter called "the original Member States".

Heads of State of the Parties acceding to the European Coal and Steel Community, hereinafter called "the new Member States",

All those States being Contracting Parties to the Treaty concerning the accession to the European Economic Community and the European Atomic Energy Community of the Kingdom of Denmark, Ireland, and the United Kingdom of Great Britain and Northern Ireland, signed in Brussels on 22 January 1972, hereinafter called "the Accession Treaty",

HAVE DECIDED to determine by common accord the adjustments to the Agreement on products within the province of the European Coal and Steel Community between the original Member States and Turkey, signed in Brussels on 23 November 1970, which are necessary consequent on the accession of the new Member States to the European Coal and Steel Community, and to this end,

WHO, having exchanged their Full Powers, found in good and due form,

HAVE AGREED AS FOLLOWS:

Article 1

The Kingdom of Denmark, Ireland and the United Kingdom of Great Britain and Northern Ireland hereby become Parties to the Agreement on products within the province of the European Coal and Steel Community between the original Member States and Turkey of that Community, signed in Brussels on 23 November 1970, hereinafter called "the Agreement".

Article 2

The texts of the Agreement, drawn up in the Danish and English languages and annexed to this Protocol, are authentic in the same way as the original texts.

Article 3

The following provision shall be inserted after Article 4 of the Agreement:

"Article 5

The Agreement shall apply to the European territories of the Kingdom of Belgium, of the Kingdom of Denmark, of the Federal Republic of Germany, of Ireland, of the French Republic, of the Italian Republic, of the Grand Duchy of Luxembourg, of the Kingdom of the Netherlands and of the United Kingdom of Great Britain and Northern Ireland and to the other European territories in respect of which a Member State assumes responsibility for external affairs, in accordance with the conditions laid down by the Treaty establishing the European Economic Community, on the one hand, and to the territory of the Republic of Turkey, on the other."

Articles 5 to 8 of the Agreement are renumbered Articles 6 to 9.

Article 4

This Protocol shall form an integral part of the Agreement.

Article 5

1. This Protocol shall be ratified by the Signatory States in accordance with their respective constitutional procedures.

The instruments of ratification shall be exchanged in Brussels.

2. This Protocol shall enter into force on the first day on the month following the day on which the exchange of instruments referred to in paragraph 1 takes place.

Article 6

This Protocol is drawn up in two parts in the Danish, Dutch, English, French, German, Italian and Turkish languages, each of these texts being authentic.

Contracting Parties to the Treaty establishing the European Coal and Steel Community, signed in Paris on 17 April 1951, whose States are hereinafter referred to as "the Member States",

of the one part, and

THE PRESIDENT OF THE TURKISH REPUBLIC,

CONSIDERING that the abovementioned Member States have concluded among themselves the Treaty establishing the European Coal and Steel Community;

CONSIDERING that they have also concluded the Treaty establishing the European Economic Community, Article 232 of which lays down that the provisions of that Treaty shall not affect the provisions of the Treaty establishing the European Coal and Steel Community, in particular as regards the rights and obligations of Member States;

CONSIDERING that the Agreement establishing an Association between the European Economic Community and Turkey does not apply to products within the province of the European Coal and Steel Community;

DESIRING nevertheless to maintain and increase trade in those products between the Member States and Turkey;

HAVE DESIGNATED as their Plenipotentiaries:

WHO, having exchanged their Full Powers, found in good and due form,

HAVE AGREED AS FOLLOWS:

Article 1

In respect of products which come from Member States or Turkey which are within the province of the European Coal and Steel Community, customs duties and charges having equivalent effect and also quantitative restrictions and measures having equivalent effect in force between Member States and Turkey shall, save where measures are taken pursuant to Chapter X of the Treaty establishing the European Coal and Steel Community, be progressively abolished in accordance with the conditions laid down in Article 2 of this Agreement.

Article 2

1. Trade barriers shall be abolished by Member States and by Turkey in accordance with a timetable adopted by mutual agreement of the Contracting Parties.

2. The Contracting Parties shall also determine the terms on which the products referred to in this Agreement shall be eligible for preferential treatment.

Article 3

Turkey shall not, in the fields covered by this Agreement, receive treatment more favourable than that which Member States extend to each other pursuant to the Treaty establishing the European Coal and Steel Community.

Article 4

Consultations shall take place between the Parties concerned in all cases where, in the opinion of one of them, the implementation of the above provisions calls for such consultations.

Article 5

This Agreement shall not affect the provisions of the Treaty establishing the European Coal and Steel Community, or the powers or jurisdiction conferred by that Treaty.

Article 6

The Annex on German internal trade and connected problems shall form an integral part of this Agreement.

Article 7

1. This Agreement shall be ratified by the Signatory States in accordance with their respective constitutional requirements.

The instruments of ratification shall be exchanged at Brussels.

2. This Agreement shall enter into force on the first day of the month following the date on which the instruments of ratification have been exchanged.

Article 8

This Agreement is drawn up in two copies in the Dutch, French, German, Italian and Turkish languages, each of these texts being equally authentic.

In witness whereof, the undersigned Plenipotentiaries have signed this Agreement.

ANNEX on German internal trade and connected problems

THE HIGH CONTRACTING PARTIES,

Taking into consideration the conditions at present existing by reason of the division of Germany,

HAVE AGREED AS FOLLOWS:

1. Since trade between the German territories subject to the Basic Law for the Federal Republic of Germany and the German territories in which the Basic Law does not apply is a part of German internal trade, the application of the Agreement on products within the province of the European Coal and Steel Community requires no change in the treatment currently accorded to this trade.

2. Each Contracting Party shall inform the other Contracting Party of any agreements relating to trade with the German territories in which the Basic Law for the Federal Republic of Germany does not apply, and of any implementing provisions. Each Contracting Party shall ensure that the implementation of such agreements does not conflict with the principles of the Agreement on products within the province of the European Coal and Steel Community, and shall in particular take appropriate measures to avoid harming the economy of the other Contracting Party.

Each Contracting Party may take appropriate measures to prevent any difficulties arising for it from trade between the other Contracting Party and the German territories in which the Basic Law for the Federal Republic of Germany does not apply.

Artikel 1

For de varer fra medlemsstaterne og Tyrkiet, som henhører under Det europæiske Kul- og Stålfællesskab, skal told og afgifter med tilsvarende virkning som told, kvantitative restriktioner og foranstaltninger med tilsvarende virkning, som gælder mellem medlemsstaterne og Tyrkiet - med forbehold af forholdsregler, der måtte blive truffet ved anvendelse af kapitel X i traktaten om oprettelse af Det europæiske Kul- og Stålfællesskab - gradvis afskaffes på de betingelser, der opstilles i artikel 2 i denne aftale.

1. Fjernelse af hindringer for samhandelen skal gennemføres af medlemsstaterne og Tyrkiet i et tempo, der fastsættes efter overenskomst mellem de kontraherende parter.

2. De kontraherende parter bestemmer også de betingelser, hvorpå de i denne aftale omtalte varer skal nyde fordel af præferenceordningen.

Artikel 3

På de områder, som omfattes af denne aftale, kan Tyrkiet ikke indrømmes en behandling, der er gunstigere end den, som medlemsstaterne i henhold til traktaten om oprettelse af Det europæiske Kul- og Stålfællesskab anvender i deres indbyrdes forhold.

Artikel 4

Konsultationer finder sted mellem de interesserede parter i ethvert tilfælde, hvor anvendelse af ovennævnte bestemmelser efter en af parternes mening gør det nødvendigt.

Artikel 5

Denne åftale ændrer hverken bestemmelserne i traktaten om oprettelse af Det europæiske Kul- og Stålfællesskab eller den myndighed og de beføjelser, der følger af denne traktat.

Artikel 6

Bilaget vedrørende den tyske indenrigshandel, og de dermed forbundne problemer er en integrerende del af denne aftale.

Artikel 7

1. Denne aftale ratificeres af signatarstaterne i overensstemmelse med deres respektive forfatningsretlige regler.

Ratifikationsinstrumenterne skal udveksles i Bruxelles.

2. Denne aftale træder i kraft den første dag i den måned, der følger efter datoen for udvekslingen af ratifikationstrumenterne.

Artikel 8

Denne aftale er udfærdiget i to eksemplarer på fransk, italiensk, nederlandsk, tysk og tyrkisk; hver af teksterne har samme gyldighed.

BILAG om den tyske indenrigshandel og de dermed forbundne problemer

DE KONTRAHERENDE PARTER-

Som tager de forhold, der for øjeblikket består på grund af Tysklands deling, i betragtning

ER BLEVET ENIGE OM FØLGENDE BESTEMMELSER:

1. Da samhandelen mellem de tyske områder, for hvilke forbundsrepublikken Tysklands grundlov gælder, og de tyske områder, på hvilke denne grundlov ikke finder anvendelse, er en del af den tyske indenrigshandel, kræver anvendelsen i Tyskland af aftalen om varer, som henhører under Det europæiske Kul- og Stålfællesskab ingen ændring af den bestående ordning for denne handel.

2. Hver kontraherende part underretter den anden part om aftaler vedrørende samhandelen med de tyske områder, på hvilke forbundsrepublikken Tysklands grundlov ikke finder anvendelse og om de bestemmelser, der gælder for gennemførelsen af disse aftaler. De påser, at gennemførelsen ikke sker i strid med principperne i aftalen om varer, som henhører under Det europæiske Kul- og Stålfællesskab, og træffer især egnede foranstaltninger for at undgå, at den anden kontraherende parts økonomi skades.

3. Hver af de kontraherende parter kan træffe egnede foranstalninger med henblik på at forebygge de vanskeligheder, som kan opstå for denne part som følge af den anden kontraherende parts samhandel med de tyske områder, på hvilke forbundsrepublikken Tysklands grundlov ikke finder anvendelse.

Have adopted the following Joint Declarations of the Contracting Parties of the Supplementary Protocol to the Association Agreement between the European Economic Community and Turkey:

1. Joint Declaration on the industrialization of Turkey,

2. Joint Declaration on Article 12 (5) (new) of the Additional Protocol, as amended by Article 3,

3. Joint Declaration on Article 6,

4. Joint Declaration on the application of Article 9 (1),

5. Joint Declaration on the transitional measures provided for in Article 13 (2).

These Plenipotentiaries have agreed that the Declarations annexed hereto shall, in so far as is necessary, be subjected to such internal procedures as are necessary to ensure their validity.

Desiring to resolve certain problems which the enlargement of the Communities presents for Turkey;

Stressing that the aim of the Association Agreement is to promote the continuous and balanced strengthening of trade and economic relations between the Parties, while taking full account of the need to ensure an accelerated development of the Turkish economy and to improve the level of employment and of the living conditions of the Turkish people;

Noting that, in order to raise the standard of living of the Turkish people and to resolve the employment problems created by population growth, the Turkish Government is determined to apply a long-term industrialization policy within the framework of its development plans which will aim to improve the economic and social structure of the country to an extent which will enable it to accede to a community of highly developed countries;

Recognizing that the achievement of the aims of such a policy will serve the ends of the Association Agreement and the common interests defined therein;

Declare that they are resolved to devise and take the measures which, within the framework of the Association Agreement and the Additional Protocol and, where appropriate, of the means provided for in Article 22 (3) of the said Agreement, would seem to be the ones most likely to promote the industrialization of Turkey within the context of its development plan.

Joint Declaration on Article 12 (5) of the Additional Protocol, as amended by Article 3

The Contracting Parties agree that goods which are already in a bonded warehouse, or are being transported for export, or for which there is a firm contract of sale at the time Turkey requests a reintroduction of quotas under Article 12 (5) of the Additional Protocol may not subjected to these quotas.

Joint Declaration on Article 6

The Contracting Parties agree that, at the time of the review provided for in Article 6 of the Supplementary Protocol, account will be taken of the particular objectives and merits of the Association Agreement, on the one hand, and of the characteristics of Turkey's trade with the Member States on the other.

Joint Declaration on the application of Article 9 (1)

The Contracting Parties agree that, subject to the effect to be given by the Community to Article 39 (5) of the Act concerning the conditions of accession and the adjustments to the Treaties, annexed to the Treaty of Accession, as regards the specific duties or the specific part of the mixed duties of the customs tariffs of Ireland and of the United Kingdom, the provisions of Article 9 (1) shall be applied by rounding to the fourth place of decimals.

Declaration on the transitional measures provided for in Article 13 (2)

At the end of 1974 the Association Council will examine the effect on the development of Turkish exports of the transitional measures provided for in Article 13 (2) of the Supplementary Protocol.

They have also adopted the following Interpretative Declarations:

- Interpretative Declaration on Article 25 of the Additional Protocol,

- Interpretative Declaration on the value of the unit of account mentioned in Article 3 of the Financial Protocol.

They have, in addition, taken note of the following Declarations by the Government of the Federal Republic of Germany on the Agreement in respect of products within the province of the European Coal and Steel Community:

1. Declaration on the definition of the expression 'German national';

2. Declaration on the application to Berlin of the Agreement on products within the province of the European Coal and Steel Community.

These Declarations are annexed to this Final Act.

The Plenipotentiaries have agreed that the Declarations annexed to this Final Act shall be subjected to any internal procedures that may be necessary to ensure their validity.

ANNEX

JOINT DECLARATION BY THE CONTRACTING PARTIES ON THE ADDITIONAL PROTOCOL

1. Joint Declaration on the calculation of duties and charges

The Contracting Parties agree that customs duties and charges having equivalent effect which are calculated in accordance with the rules of the Additional Protocol shall be rounded off to the first decimal point.

2. Joint Declaration on Article 12 (2)

The Contracting Parties agree that goods which are already in a bonded warehouse, or are being transported for export, or for which there was a firm contract of sale at the time Turkey notified the Council of Association in accordance with Article 12 (2) of the Additional Protocol, shall be liable to the customs duties applicable before the adoption of measures by Turkey in accordance with that Article.

3. Joint Declaration on Articles 17 (1) and 18 (1)

The duties in the Common Customs Tariff referred to in Articles 17 (1) and 18 (1) of the Additional Protocol are the duties in the Common Customs Tariff which are actually applied at the time of alignment of the Turkish Customs Tariff with the Common Customs Tariff.

4. Joint Declaration on Article 25 (4)

The Contracting Parties declare that in calculating the aggregate value of all the quotas which are to be increased by 10% at regular intervals in accordance with Article 25 (4) of the Additional Protocol, no account shall be taken of the value of imports liberalized by Turkey during the periods referred to in that paragraph.

5. Joint Declaration on Article 27 (2)

The Contracting Parties declare that the provisions of Article 27 (2) of the Additional Protocol shall also apply to non-ferrous metals.

6. Joint Declaration on Article 34

The Contracting Parties agree that preparatory work in respect of the findings to be recorded by the Council of Association, pursuant to Article 34 of the Additional Protocol, may begin one year before expiry of the period of twenty-two years.

7. Joint Declaration on the duties in the Common Customs Tariff referred to in Annexes 2 and 6

The duties in the Common Customs Tariff referred to in Annexes 2 and 6 are the duties in the Common Customs Tariff which are actually applied at the time in relation to the Contracting Parties to GATT.

INTERPRETATIVE DECLARATIONS

Interpretative Declaration on Article 25 of the Additional Protocol

It is understood that importations financed:

(a) with special aid resources connected with specific investment projects;

(b) without allocation of foreign currency;

(c) under the law on the promotion of foreign capital investment;

shall not considered to be made under quotas opened in favour of the Community in accordance with Article 25 ofthe Additional Protocol, and in particular paragraphs 4 and 5 thereof.

Interpretative Declaration on the value of the unit of account in the context of Article 3 of the Financial Protocol

The Contracting Parties declare that:

1. The value of the unit of account used to express the amount mentioned in Article 3 of the Financial Protocol shall be 0 88867088 gram of fine gold.

2. The parity of the currency of a Member State of the Community in relation to the unit of account defined in paragraph 1 shall be the relation between the weight of fine gold contained in the unit of account and the weight of fine gold corresponding to the par value of that currency communicated to the International Monetary Fund. If no par value has been communicated, or if exchange rates differing from the par value by a margin exceeding that authorized by the International Monetary Fund are applied to current payments, the weight of fine gold corresponding to the parity of the currency shall be calculated on the basis of the exchange rate for a currency directly or indirectly expressed in and convertible into gold which is applied in the Member State to current payments, on the day of the calculation, and on the basis of the par value communicated to the International Monetary Fund for that convertible currency.

3. The unit of account defined in paragraph 1 shall remain unchanged throughout the period in which the Financial Protocol is in force. If, however, before the end of that period a uniform proportionate change in the par values of all currencies in relation to gold should be decided by the International Monetary Fund under Article IV, Section 7, of its Articles of Agreement, the weight of fine gold contained in the unit of account shall alter in inverse ratio to that change.

If one or more Member States do not apply the decision taken by the International Monetary Fund as referred to in the preceding subparagraph, the weight of fine gold contained in the unit of account shall alter in inverse ratio to the change decided by the International Monetary Fund. The Council of the European Communities shall, however, examine the situation thus created and shall take the necessary measures, acting by a qualified majority, after receiving a proposal from the Commission and the opinion of the Monetary Committee.

DECLARATIONS BY THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY ON THE AGREEMENT RELATING TO PRODUCTS WITHIN THE PROVINCE OF THE EUROPEAN COAL AND STEEL COMMUNITY

1. Declaration on the definition of the expression 'German national'

All Germans as defined in the Basic Law for the Federal Republic of Germany shall be considered nationals of the Federal Republic of Germany.

2. Declaration on the application to Berlin of the Agreement in respect of products within the province of the European Coal and Steel Community

The Agreement on products within the province of the European Coal and Steel Community shall apply equally to Land Berlin unless the Government of the Federal Republic of Germany makes a declaration to the contrary to the other Contracting Parties within three months.

Disse erklæringer udgør bilag til denne slutakt.

DE KONTRAHERENDE PARTERS FÆLLES ERKLÆRINGER MED HENSYN TIL TILLÆGSPROTOKOLLEN

1. Fælles erklæring om beregning af told og afgifter

De kontraherende parter er enige om, at told og afgifter med tilsvernde virkning, som told som beregnes i overensstemmeldse med bestmmelserne i tillægsprotokollen, afrundes til første decimal.

2. Fælles erklæring om artikel 12, stk. 2

De kontraherende parter er enige om, at varer, der på tidspunktet for meddelelsen til Associeringsrådet i henhold til artikel 12, stk. 2 i tillægsprotokollen allerede befinder sig på toldoplag eller er under transport med henblik på udførsel, eller som er genstand for en fast salgskontrakt, skal underkastes den told, der var gældende før indførelsen af de foranstalninger, som Tyrkiet træffer i henhold til samme artikel.

3. Fælles erklæring om artikel 17, stk. 1 og artikel 18, stk. 1

Den i artikel 17, stk. 1, og i artikel 18, stk. 1, omtalte told ifølge den fælles toldtarif er den told ifølge den fælles toldarif, der faktisk anvendes på det tidspunkt, hvor den tyrkiske toldtarif tilpasses den fælles toldtarif.

4. Fælles erklæring om artikel 25, stk. 4

De kontraherende parter erklærer, at ved beregningen af den samlede værdi af alle de kontingenter, der regelmæssigt skal forøges med 10% i henhold til artikel 25, stk. 4, i tillægsprotokollen, bør der ikke tages hensyn til værdien af de indførsler, som Tyrkiet har liberaliseret i løbet af de i samme stk. anførte tidsrum.

5. Fælles erklæring om artikel 27, stk. 2

De kontraherende parter erklærer, at bestemmelserne i artikel 27, stk. 2, i tillægsprotokollen også finder anvendelse på ikke-jernholdige metaller.

6. Fælles erklæring om artikel 34

De kontraherende parter er enige om, at forberedelsesarbejderne til de konstateringer, som Associeringsrådet skal foretage i henhold til artikel 34 i tillægsprotokollen, kan påbegyndes et år før udløbet af perioden på toogtyve år.

7. Fælles erklæring om tolden i den fælles toldtarif, anført i bilag 2 og 6

Den i bilag 2 og 6 omtalte told ifølge den fælles toldtarif er den told ifølge den fælles toldtarif, der faktisk er gældende på ethvert tidspunkt over for de kontraherende parter i GATT.

FORTOLKENDE ERKLÆRINGER

Fortolkende erklÆring til artikel 25 i tillægsprotokollen

Det er vedtaget, at indførsler, der gennemføres:

a) ved særlige bistandsmidler knyttet til bestemte investeringsprojekter,

b) uden valutatildeling,

c) inden for rammerne af loven om fremme af investeringer af udenlandsk kapital,

ikke kan medregnes i det kontingent, der er åbnet for Fællesskabet i henhold til artikel 25 i tillægsprotokollen, særlig stk. 4 og 5.

Fortolkende erklæring om regningsenhedens værdi omtalt i artikel 3 i finansprotokollen

De kontraherende parter erklærer, at:

1. Værdien af den regningsenhed, der er anvendt til at udtrykke det i artikel 3 i finansprotokollen nævnte beløb, er på 0,88867088 gram fint guld.

2. Valutapariteten for en medlemsstat i Fællesskabet i forhold til den i stk. 1 definerede regningsenhed er forholdet mellem vægten af fint guld indeholdt i denne regningsenhed og vægten af fint gult svarende til den paritet, der for denne valuta er anmeldt til Den internationale Valutafond. I mangel af en anmeldt paritet, eller såfremt der til løbende betalinger anvendes kurser, der adskiller sig fra pariteten med en margin, som er større end den, der er godkendt af Valutafonden, skal vægten af fint gult svarende til valutaens paritet beregnes på basis af den kurs, der anvendes af medlemsstaten til de løbende betalinger på beregningsdagen for en valuta, som direkte eller indirekte er fastslået og konvertibel med guld på basis af den for denne konvertible valuta over for Valutafonden anmeldte paritet.

3. Regningsenheden som defineret i stk. 1 forbliver uændret i hele finansprotokollens gennemførelsesrid. Hvis der imidlertid før dennes udløb træffes beslutning om en ensartet ændring af alle velutaers paritet over for guld af Den internationale Valutafond i medfør af artikel 4, afd. 7, i dens vedtægter, vil vægten af fint guld for regningsenheden ændre sig omvendt proportionalt med denne ændring.

Hvis en eller flere medlemsstater i Fællesskabet ikke bringer den af Den internationale Valutafond i første afsnit omtalte beslutning i anvendelse, vil regningsenhedens vægt af fint guld ændre sig omvendt proportionalt med den af Den internationale Valutafond besluttede ændring. Imidlertid vil Rådet for Det europæiske Fællesskab undersøge den opståede situation og på forslag fra Kommissionen og efter udtalelse fra Det monetære Udvalg træffe de nødvendige foranstalninger med kvalificeret flertal.

ERKLÆRINGER FRA REGERINGEN FOR FORBUNDSREPUBLIKKEN TUSKLAND VEDRØRENDE AFTALEN OM VARER, SOM HENHØRER UNDER DET EUROPÆISKE KUL- OG STÅFÆLLESSKAB

1. Erklæring om begrebet »tyske statsborgere«

Som statsborgere i forbundsrepublikken Tyskland forstås alle tyskere, således som dette begreb er defineret i dens grundlov.

2. Erklæring vedrørende anvendelsen af aftalen om varer, som henhører under Det europæiske Kul- og Stålfællesskab

Aftalen om varer, som henhører under Det europæiske Kul- og Stålfællesskab, finder tilsvarende anvendelse på Land Berlin, forudsat at regeringen for forbundsrepublikken Tyskland ikke inden tre måneder har fremsat en modstridende erklæring.
