DECISION OF THE EEA JOINT COMMITTEE

No 27/2010

of 12 March 2010

amending Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 30/2009 of 17 March 2009 (1).

(2)

Annex XX to the Agreement was amended by Decision of the EEA Joint Committee No 150/2009 of 4 December 2009 (2).

(3)

Commission Regulation (EC) No 303/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of companies and personnel as regards stationary refrigeration, air conditioning and heat pump equipment containing certain fluorinated greenhouse gases (3) is to be incorporated into the Agreement.

Commission Regulation (EC) No 304/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of companies and personnel as regards stationary fire protection systems and fire extinguishers containing certain fluorinated greenhouse gases (4) is to be incorporated into the Agreement.

Commission Regulation (EC) No 305/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of personnel recovering certain fluorinated greenhouse gases from high-voltage switchgear (5) is to be incorporated into the Agreement.

Commission Regulation (EC) No 306/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements and the conditions for mutual recognition for the certification of personnel recovering certain fluorinated greenhouse gas-based solvents from equipment (6), as corrected by OJ L 280, 23.10.2008, p. 38, is to be incorporated into the Agreement.

Commission Regulation (EC) No 307/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, minimum requirements for training programmes and the conditions for mutual recognition of training attestations for personnel as regards air-conditioning systems in certain motor vehicles containing certain fluorinated greenhouse gases (7) is to be incorporated into the Agreement.

Commission Regulation (EC) No 308/2008 of 2 April 2008 establishing, pursuant to Regulation (EC) No 842/2006 of the European Parliament and of the Council, the format for notification of the training and certification programmes of the Member States (8) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following points shall be inserted after point 9bc (Commission Regulation (EC) No 1516/2007) of Chapter XVII of Annex II to the Agreement:

Article 2

Article 3

The texts of Regulations (EC) No 303/2008, (EC) No 304/2008, (EC) No 305/2008, (EC) No 306/2008, as corrected by OJ L 280, 23.10.2008, p. 38, (EC) No 307/2008 and (EC) No 308/2008 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 4

This Decision shall enter into force on 13 March 2010, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (9), or on the day of the entry into force of Decision of the EEA Joint Committee No 112/2008 of 7 November 2008 (10), whichever is the later.

Article 5

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
