DECISION OF THE EEA JOINT COMMITTEE

No 102/2004

of 9 July 2004

amending Annex VI (Social security) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

Annex VI to the Agreement was amended by the Agreement on the participation of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Hungary, the Republic of Latvia, the Republic of Lithuania, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic in the European Economic Area signed on 14 October 2003 in Luxemburg (1).

Decision No 189 of 18 June 2003 aimed at introducing a European health insurance card to replace the forms necessary for the application of Council Regulations (EEC) No 1408/71 and (EEC) No 574/72 as regards access to health care during a temporary stay in a Member State other than the competent State or the State of residence (2) is to be incorporated into the Agreement.

Decision No 190 of 18 June 2003 concerning the technical specifications of the European health insurance card (3) is to be incorporated into the Agreement.

Decision No 191 of 18 June 2003 concerning the replacement of forms E 111 and E 111 B by the European health insurance card (4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following points shall be inserted after point 3.64 (Decision No 188) of Annex VI to the Agreement:

‘3.65.

32003 D 0751: Decision No 189 of 18 June 2003 aimed at introducing a European health insurance card to replace the forms necessary for the application of Council Regulations (EEC) No 1408/71 and (EEC) No 574/72 as regards access to health care during a temporary stay in a Member State other than the competent State or the State of residence (OJ L 276, 27.10.2003, p. 1).

3.66.

32003 D 0752: Decision No 190 of 18 June 2003 concerning the technical specifications of the European health insurance card (OJ L 276, 27.10.2003, p. 4).

The provisions of the Decision shall, for the purposes of the present Agreement, be read with the following adaptation:

In accordance with point 3.3.2 of the Annex to the Decision, the European Health Insurance Cards to be issued in the EEA EFTA Member States will not include the European stars. An EEA EFTA Member State should, however, have the possibility to insert the stars at a later stage if need be.

3.67.

32003 D 0753: Decision No 191 of 18 June 2003 concerning the replacement of forms E 111 and E 111 B by the European health insurance card (OJ L 276, 27.10.2003, p. 19).’

Article 2

The texts of Decisions Nos 189, 190 and 191 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 10 July 2004, provided that all the notifications under Article 103 (1) of the Agreement have been made to the EEA Joint Committee (5).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
