DECISION OF THE EEA JOINT COMMITTEE

No 1/2005

of 8 February 2005

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 120/2004 of 24 September 2004 (1).

(2)

Commission Decision 2001/183/EC (2) was incorporated into the Agreement by Decision of the EEA Joint Committee No 76/2002 (3).

(3)

Paragraph 2 in the Introductory Part to Chapter I of Annex I foresees that it shall be explicitly stated in relation to the specific act if the acts shall apply to Iceland.

(4)

As Commission Decision 2001/183/EC also shall apply to Iceland, the Agreement should be amended accordingly.

(5)

This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

The following adaptation text shall be added in point 63 (Commission Decision 2001/183/EC) in Part 4.2 of Chapter I of Annex I to the Agreement:

‘This act applies also to Iceland.’

Article 2

This Decision shall enter into force on 9 February 2005, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (4).

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
