DECISION OF THE EEA JOINT COMMITTEE

No 15/2005

of 8 February 2005

amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 179/2004 of 9 December 2004 (1).

(2)

Regulation (EC) No 1592/2002 of the European Parliament and of the Council of 15 July 2002 on common rules in the field of civil aviation and establishing a European Aviation Safety Agency (2) was incorporated into the present Agreement by Decision of the EEA Joint Committee No 179/2004 of 9 December 2004, with adaptations.

Regulation (EC) No 1643/2003 of the European Parliament and of the Council of 22 July 2003 amending Regulation (EC) No 1592/2002 on common rules in the field of civil aviation and establishing a European Aviation Safety Agency (3) is to be incorporated into the Agreement.

(4)

Commission Regulation (EC) No 1701/2003 of 24 September 2003 adapting Article 6 of Regulation (EC) No 1592/2002 of the European Parliament and of the Council on common rules in the field of civil aviation and establishing a European Aviation Safety Agency (4) is to be incorporated into the Agreement.

(5)

Commission Regulation (EC) No 104/2004 of 22 January 2004 laying down rules on the organisation and composition of the Board of Appeal of the European Aviation Safety Agency (5) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XIII to the Agreement shall be amended as follows:

1.

The following shall be added in point 66n (Regulation (EC) No 1592/2002 of the European Parliament and of the Council):

‘, as amended by:

—

32003 R 1643: Regulation (EC) No 1643/2003 of the European Parliament and of the Council of 22 July 2003 (OJ L 245, 29.9.2003, p. 7),

—

32003 R 1701: Commission Regulation (EC) No 1701/2003 of 24 September 2003 (OJ L 243, 27.9.2003, p. 5).’

The following point shall be inserted after point 66n (Regulation (EC) No 1592/2002 of the European Parliament and of the Council):

‘66o.

32004 R 0104: Commission Regulation (EC) No 104/2004 of 22 January 2004 laying down rules on the organisation and composition of the Board of Appeal of the European Aviation Safety Agency (OJ L 16, 23.1.2004, p. 20).’

Article 2

The texts of Regulations (EC) Nos 1643/2003, 1701/2003 and 104/2004 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 9 February 2005, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (6), or on the day of entry into force of Decision of the EEA Joint Committee No 179/2004 of 9 December 2004, whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
