COUNCIL JOINT ACTION 2004/532/CFSP

of 28 June 2004

extending and amending the mandate of the Special Representative of the European Union for the South Caucasus

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Articles 14, 18(5) and 23(2) thereof,

Whereas

(1)

On 8 December 2003 the Council adopted Joint Action 2003/872/CFSP (1) amending and extending until 30 June 2004 the mandate of the Special Representative of the European Union for the South Caucasus (EUSR).

(2)

On the basis of a review of that Joint Action, the mandate of the Special Representative should be extended.

(3)

On 28 June 2004, the Council adopted Joint Action 2004/523/CFSP on the European Union Rule of Law Mission in Georgia, EUJUST THEMIS (2). That Joint Action foresees a specific role for the EUSR for the South Caucasus. The mandate of the EUSR should therefore be amended accordingly.

On 17 November 2003 the Council adopted guidelines on the appointment, mandate and financing for European Union Special Representatives.

The EUSR will implement his mandate in the context of a situation which may deteriorate and could harm the objectives of the CFSP as set out in Article 11 of the Treaty on European Union,

HAS ADOPTED THIS JOINT ACTION:

Article 1

The mandate of Mr Heikki TALVITIE as the European Union Special Representative (EUSR) for the South Caucasus, as set out in Common Position 2003/872/CFSP, is hereby extended until 28 February 2005.

Article 2

Joint Action 2003/872/CFSP is amended as follows:

(a)

in Article 3 the following point shall be added:

‘(g)

have political oversight of the Rule of Law Mission in Georgia, EUJUST THEMIS, established by Joint Action 2004/…/CFSP, to give guidance to the Head of the Mission (in line with the SG/HR), and to report to the Council (through the SG/HR) on the activities of this Mission;’

(b)

Article 5(1) shall read as follows:

‘1.   The financial reference amount intended to cover the expenditure related to the mandate of the EUSR shall be EUR 396 000.’

Article 3

This Joint Action shall enter into force on 1 July 2004.

Article 4

This Joint Action shall be published in the Journal of the European Union.
