Establishment of rates of legal income

The Regulation is established on the basis of paragraphs 224(1)2) and 250(1)2) of the Aliens Act.

§ 1.  Rates of legal income

 (1) The rate of legal income required upon application for temporary residence permit under an international agreement on the basis of section 201 of the Aliens Act shall be the single rate of the subsistence level established in accordance with subsection 22(11) of the Social Welfare Act during the six months preceding the submission of the application for residence permit, depending on the size of the family.

 (2) The rate of legal income specified in paragraphs 150(1)3) and 4), paragraph 232(1)3) and paragraph 238(1)3) of the Aliens Act shall be the six-fold rate of the subsistence level established in accordance with 22(11) of the Social Welfare Act during the six months preceding the submission of the application for residence permit, depending on the size of the family.

 (3) The rate of legal income required upon application for temporary residence permit for study on the basis of subsections 162(1) to (4) of the Aliens Act and specified in section 139 and paragraph 183(1)1) of the Aliens Act shall be the twelve-fold rate of the subsistence level established in accordance with subsection 22(11) of the Social Welfare Act during the six months preceding the submission of the application for residence permit, depending on the size of the family.

 (4) The rate of legal income required upon application for temporary residence permit for enterprise on the basis of section 161 of the Aliens Act and specified in section 198 of the Aliens Act shall be eighteen-fold average gross salary per calendar month applicable in the Republic of Estonia in total during the six months preceding the submission of the application for residence permit, whereas the calculation of the gross salary shall be based on the average gross monthly salary of the quarter preceding the submission of the application for residence permit calculated by the Statistical Office.

§ 2.  Entry into force of Regulation

  This Regulation shall enter into force on 1 October 2010.
