This regulation is established pursuant to § 64 (1) of the European Union Common Agricultural Policy Implementation Act.

Chapter 1 GENERAL PROVISIONS 

§ 1.  Scope of application

  This Act establishes the Estonian Rural Development Plan 2007–2013 (hereinafter Development Plan) monitoring and evaluation procedure and the organisation of monitoring and evaluation cooperation between the Ministry of Agriculture, the Agricultural Registers and Information Board (hereinafter ARIB), the Agricultural Research Centre (hereinafter ARC), the Agricultural Board, the Rural Economy Research Centre, the Estonian University of Life and the person who has been awarded a contract by ARIB according to § 57 (4) of the European Union Common Agricultural Policy Implementation Act in conformity with the rural development programme approved according to Article 18 (4) of Council Regulation (EC) No 1698/2005 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) (OJ L 277, 21.10.2005, p. 1–40).

Chapter 2 DEVELOPMENT PLAN MONITORING  

§ 2.  Monitoring report

  In cooperation with the authorities and the person referred to in §1, the Ministry of Agriculture shall prepare a monitoring report (hereinafter monitoring report) for the period 1 January – 31 December (hereinafter accounting year), which includes the information referred to in Article 82 (2) of Council Regulation (EC) No 1698/2005 and in Annex VII of Commission Regulation (EC) No 1974/2006, laying down detailed rules for the application of Council Regulation (EC) No 1698/2005 (on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) (OJ L 368, 23.12.2006, p.15–73).

§ 3.  Data provision

 (1) By 15 March of the year following the accounting year, ARIB shall provide the Ministry of Agriculture with the following information about rural development support (hereinafter support) granted under the Development Plan implemented within the accounting year necessary for the preparation of the monitoring report:
 1) data on support implementation scope, incl. data on input, output and agreed result indicators, incl. monitoring tables among others, considering the objectives set in the Development Plan;
 2) data on the usage of the financial resources foreseen in the Development Plan budget for support implementation, incl. data on disbursements made to beneficiaries;
 3) data on the reuse of refunded support payments;
 4) overview of onsite checks made on applicants by supports, and an overview of the audits carried out;
 5) overview of the main problems discovered while applying for support and of the measures taken to solve those problems;
 6) overview of the activities related to publicity and of the use of technical assistance (hereinafter technical assistance) given under the Development Plan;
 7) if necessary, other information for the more efficient implementation of supports.

 (2) By 1 April of the year following the accounting year, ARC shall provide the Ministry of Agriculture with the following information about the supports implemented within the accounting year, necessary for the preparation of the monitoring report:
 1) overview of Axis II supports of the Development Plan, incl. data on result and impact indicators, considering the objectives set in the Development Plan and input and output indicators;
 2) overview of Axis II ongoing evaluation activities;
 3) overview of the activities related to publicity and of the use of technical assistance;
 4) if necessary, other information for the more efficient implementation of supports.

 (3) By 15 March of the year following the accounting year, the Rural Economy Research Centre shall provide the Ministry of Agriculture with the following information necessary for the preparation of the monitoring report:
 1) report on the fulfilment during the accounting year of the objectives and tasks described in Chapter 16.2 of the Development Plan, incl. an overview of trainings, the activities related to publicity and international cooperation and the use of technical assistance;
 2) if necessary, other information for the more efficient implementation of supports.

 (4) By 15 March of the year following the accounting year, the person who has been awarded a contract by the ARIB according to § 57 (4) of the European Union Common Agricultural Policy Implementation Act shall provide the Ministry of Agriculture with the following information about the supports implemented within the accounting year, necessary for the preparation of the monitoring report:
 1) overview of the main problems discovered while applying for support and of the measures taken to solve those problems;
 2) overview of the activities related to publicity and of the use of technical assistance;
 3) if necessary, other information for the more efficient implementation of supports.

 (5) By 1 April of the year following the accounting year, the Estonian University of Life Sciences shall provide the Ministry of Agriculture with the following information about the supports implemented within the accounting year, necessary for the preparation of the monitoring report:
 1) overview of Axes I, III and IV supports of the Development Plan, incl. data on result and impact indicators, considering the objectives set in the Development Plan and input and output indicators;
 2) overview of Axes I, III and IV ongoing evaluation activities;
 3) if necessary, other information for the more efficient implementation of supports.

 (6) According to the inquiry made, ARIB shall provide ARC electronically with data on the input, output and result indicators of Axis II supports and the estonian University of Life Sciences with data on the input, output and result indicators of Axes I, II, III and IV supports of the Development Plan and shall enable them access to support application documents and relevant register data, if necessary.

 (7) The Agricultural Board shall enable ARC access to the organic farming register data, if necessary, or shall provide ARC with relevant data electronically.

 (8) According to the inquiry made, ARIB shall provide the Ministry of Agriculture electronically with data on Axes I, II, III and IV supports.

§ 4.  Preparation and approval of the monitoring report

 (1) According to Article 82 (1) of Council Regulation (EC) No 1698/2005, the Ministry of Agriculture shall prepare a monitoring report which in addition to the information referred to in § 3 shall also include the following information conforming to Article 82 (2) of Council Regulation (EC) No 1698/2005:
 1) amendments to general terms and conditions having direct impact on the terms and conditions of the Development Plan implementation, as well as changes in the EU and national policy which have impact on the consistency of EAFRD and other financial instruments;
 2) overview of the progress of the Development Plan in connection with set objectives on the basis of output and result indicators;
 3) summary of ongoing evaluation activities;
 4) description of the use of technical assistance and the activities related to information given to applicants and the public;
 5) data on the conformity of supports with the EU policy.

 (2) To fulfil the tasks referred to in Article 78 of Council Regulation (EC) No 1698/2005 and in Chapter 12.2 of the Development Plan, the Ministry of Agriculture shall submit the monitoring report for approval to the Monitoring Committee established by the Minister of Agriculture by 31 May of the year following the accounting year.

 (3) The Ministry of Agriculture shall publicize information about the monitoring report approved by the Monitoring Committee on its website.

 (4) The Ministry of Agriculture shall submit the monitoring report approved by the Monitoring Committee to the European Commission by the term provided in Article 82 (1) of Council Regulation (EC) No 1698/2005.

Chapter 3 DEVELOPMENT PLAN EVALUATION  

§ 5.  Development Plan evaluation

 (1) The Development Plan shall be subject to evaluations, incl. mid-term and ex post evaluations in accordance with Articles 84 and 86 of Council Regulation (EC) No 1698/2005 and Article 61 of Commission Regulation (EC) No 1974/2006.

 (2) The Ministry of Agriculture coordinates the activities necessary for the Development Plan evaluation, incl. the organisation of public procurement for the selection of mid-term and ex ante evaluators, and the work of the Development Plan Evaluation Committee established by the Minister of Agriculture for the performance of the duties referred to in Chapter 12.4 of the Development Plan.

 (3) According to Chapter 12.3 of the Development Plan, ARC performs ongoing evaluation of Axis II supports and transmits the summary of evaluation results to the mid-term and ex post evaluators of the Development Plan.

 (4) According to Chapter 12.3 of the Development Plan, the Estonian University of Life Sciences performs ongoing evaluation of Axes I, III and IV supports and transmits the summary of evaluation results to the mid-term and ex post evaluators of the Development Plan.

 (5) ARC shall transmit to the Ministry of Agriculture the information which has come to its knowledge as a result of Axis II ongoing evaluation and which has not been transmitted according to § 3 (2).

 (6) The Estonian University of Life Sciences shall transmit to the Ministry of Agriculture the information which has come to its knowledge as a result of the ongoing evaluation activities performed under the contract concluded between the Estonian University of Life Sciences and the Ministry of Agriculture, incl. an overview of the performance and efficiency of the Development Plan implementation, and the information which has not been transmitted according to § 3 (5). The Estonian University of Life Sciences makes motions to the Ministry of Agriculture to amend the Development Plan and its implementation, if necessary.

§ 6.  Submission of the Development Plan mid-term and ex ante evaluation data and mid-term and ex ante evaluation reports

 (1) ARIB, the Estonian University of Life Sciences, ARC, the person who has been awarded a contract by ARIB according to § 57 (4) of the European Union Common Agricultural Policy Implementation Act, the Rural Economy Research Centre and the Ministry of Agriculture shall transmit the Development Plan implementation related data necessary for the Development Plan mid-term and ex post evaluators in ten working days after mid-term and ex post evaluators’ inquiry and enable them access to the documents submitted to get support and to databases and to other information necessary for evaluation.

 (2) The Ministry of Agriculture shall submit the mid-term and ex post evaluation reports referred to in Article 61 of Commission Regulation (EC) No 1974/2006 and in Article 86 (4) and (5) of Council Regulation (EC) No 1698/2005 to the European Commission by the dates provided in Article 61 of Commission Regulation (EC) No 1974/2006.

 (3) The Ministry of Agriculture shall submit the mid-term and ex post evaluation reports to the Monitoring Committee for information.

 (4) The Ministry of Agriculture shall publicize information about the mid-term and ex post evaluation reports on its website.

Chapter 4 IMPLEMENTING PROVISIONS  

§ 7.  Implementing provision

  Regulation No 3 of the Minister of Agriculture, 7 January 2009, Estonian Rural Development Plan 2007–2013 monitoring and evaluation procedure (RTL 2009, 8, 93; 2009, 96, 1421 ) shall be repealed.
