ADMINISTRA nON OF ESTATES BY CONSULAR OFFICERS ACT
AN ACT to give effect to the provisions of certain treaties of com- 1961Ed. d 't' Cap 208.merce an navlga IOn. 1of 1940.
1. This Act may be cited as the- ADMINISTRATION OF ESTAlES BY
CONSULAR OFFICERS ACT.
2. Whenever any subject or citizen of any country mentioned in Administrationof estates by
the first column of the Schedule - consularofficers. Sdtedule.(a) dies within the State; or
(b) dies outside the State, leaving property within the State,
and no person is present in the State at the time of his death who is rightfully entitled to administer the estate of the deceased person, the consul, vice-consul, or consular agent of the country within the State may take possession and have the custody of the property of the deceased person, and may apply the same in payment of his debts and funeral expenses, and may retain the surplus for the benefit of the persons entitled thereto; but the consul, vice-consul, or consular agent shall immediately apply for, and shall be entitled to obtain from the Court, letters of administration of the property of the deceased person, limited in such manner and for such time as to the Court seems fit.
3. The President may by Order vary the Schedule - Variation of Sdtedule.
(a) by deleting therefrom any country when the provision of the treaty with that country mentioned in the Sched- ule has ceased to have effect;
(b) by adding thereto any country with whom the State shall make a treaty of commerce and navigation con- taining provision similar to any of the provisions mentioned in the Schedule.
