305/1999 Coll. ACT of 18 November 1999 on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction and amending Act no. 140/1961 Coll., Criminal Code, as amended, Change: 41/2009 Coll. The Parliament passed the Act of the Czech Republic: PART ONE Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction § 1 (1) The ownership, possession and use of all types of antipersonnel mines listed in the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction (hereinafter referred to as "anti-personnel mines") or their components, unless stipulated otherwise. (2) prohibits the development, production, transmission, storage or stockpiling of antipersonnel mines or their components. (3) prohibits the use and transfer of patent rights to manufacture anti-personnel mines or their components and patent rights for technologies designed for the production of antipersonnel mines or their components. § 2 (1) Any person who possesses antipersonnel mines or their components, are obliged to report their numbers to the Ministry of Defence (the "Ministry") within 180 days from the effective date of this Act within 60 days after the announcement of the ministry forward. (2) Owners of patents for the production of antipersonnel mines or their components, and owners of patents on technologies designed for the production of antipersonnel mines or their components are required to report this fact to the Ministry within 90 days from the effective date of this Act. § 3 (1) Within four years from the effective date of this Act, the Ministry will ensure the destruction of all stockpiled anti-personnel mines. (2) The Ministry may hold, or may convert a minimum of landmines absolutely necessary for the development and training of mine detection, mine clearance or destruction. § 4 (1) Any person who possesses antipersonnel mines or their components, subject to the supervision over compliance with this Act. Supervision is carried out by the Ministry. (2) The enforcement surveillance, along with control workers may participate as members of the international fact-finding mission in accordance with its mandate under the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction. (3) Any person who possesses antipersonnel mines or their components, is obliged to allow control staff and members of the international fact-finding mission access to the inspected site. PART TWO canceled § 5 Repealed PART THREE Efficiency Act § 6 of this Act shall take effect on the day of publication, with the exception of the second part, which comes into effect after the expiry of 240 days from the effective date of this Act.
