Parking Meter Regulations - Town of Truro

made under Section 152 of the

Motor Vehicle Act

R.S.N.S. 1989, c. 293

N.S. Reg. 258/83 (November 15, 1983)


Whereas it is necessary to improve facilities for parking vehicles upon the public streets and highways of the Town of Truro;


And whereas it is desirable that the parking of vehicles upon certain public streets and highways be regulated by the installation of parking meters upon such streets and highways or parts thereof;


And whereas Section 152 of the Motor Vehicle Act, Chapter 293, Revised Statutes of Nova Scotia, 1989, provides that the Traffic Authority for the Town of Truro may make regulations prohibiting or restricting the parking or leaving standing of vehicles upon any street or highway or part thereof within the limits of the Town and that such regulations may prohibit or restrict the parking or leaving standing of vehicles except in accordance with a sign or device on a parking meter;


Therefore, in pursuance of the premises and by virtue of the power vested in me under the provisions of Section 152 of the Motor Vehicle Act, I, as the Traffic Authority for the Town of Truro, do hereby make the following regulations:


Application

1     For the purpose of these regulations

 

                (a)    the word “vehicle” has the same meaning as it has in the Motor Vehicle Act of the Province of Nova Scotia;

 

                (b)    the word “street” means any public street, avenue, boulevard, highway or other public place located in the Town of Truro and established for the use of vehicles;

 

                (c)    the word “person” means and includes any individual, firm, co-partnership or corporation;

 

                (d)    the word “operator” means and includes every person who operates a vehicle as the owner thereof and the agent, employee or permittee of the owner.

 

2     The public streets and highways in the Town of Truro and parts thereof to which these regulations apply are those in which parking meters shall have, from time to time, been installed by the authority of the Traffic Authority of the Town of Truro.


Placing of parking meters

3     Each parking meter installed in the Town of Truro shall be placed on the sidewalk, near the curb or edge of the roadway, and shall designate the parking space associated with it as hereinafter set forth and where no curbs are provided at the back of the sidewalks.


Parking spaces

4     The parking space provided with each meter shall be of sufficient size to be accessible and accommodate one standard passenger automobile; the placing of vehicles shall be as follows:

 

                (a)    when parking is parallel to the curb or edge of roadway, the vehicle shall be placed within a space measured along the curb not closer than thirty centimetres to the meter nor more than one metre from the meter;

 

                (b)    when two meters are supported by one standard, a vehicle shall be parked not closer than thirty centimetres nor more than one meter away from the standard.


Indication of time

5     Each parking meter installed shall have thereon an appropriate sign or device stating the parking time permitted, as hereinafter provided, in the individual parking space to which it relates. When in operation, each parking meter shall indicate either by a dial or pointer thereon the period of time acquired by coin deposit during which parking is permitted in the parking space to which such meter relates, or by the words “legal parking” being visible in the observation window of parking meters during the said period. Either type shall, upon the expiration of the period of time permitted for parking, indicate that parking in such parking space is in violation of these regulations.


When in effect

6     Each parking meter shall bear thereon directions indicating the days and hours when the requirement to deposit coins therein shall apply, the value of the coins to be deposited, and the limited period of time for which parking is lawfully permitted in the parking space to which such meter relates.


Coins

7     When used in directions on parking meter[s], the word “nickel” shall mean 5¢, the word “dime” shall mean 10¢ and the word “quarter” shall mean 25¢, all of which is lawful money of Canada.


Failure to deposit coin

8     It shall be an offence and a violation of these regulations for the driver of any vehicle to park or leave the same standing in any parking space and fail to immediately deposit in the parking meter relating to such parking space a coin or coins of lawful money of Canada and of sufficient value to permit the parking or leaving standing of such vehicle in such parking space for any period of time permitted by these regulations and as shown by the direction set forth on such parking meter.


Parking in excess of time allowed

9     It shall be an offence and a violation of these regulations for the driver of any vehicle to park or leave the same standing in any parking space for a period of time in excess of the maximum period allowed by the directions set forth on such parking meter, regardless of the number of coins deposited or whether [or not] the word “violation” or “expired” or “time expired” is visible in the observation window of the parking meter.


Unlawful to permit parking with “violation” visible on meter

10   It shall be an offence and a violation of these regulations for the driver of any vehicle to permit the same to be parked or left standing in any parking space while the words “TIME EXPIRED” or “VIOLATION” [are] visible in the observation window of the parking meter relating to such parking space.


Unlawful to deposit substitutes for coins

11   It shall be an offence and [a] violation of these regulations for any person to deposit or cause to be deposited in any parking meter installed in the Town of Truro any device, slug, dice, metallic substance, or other substitute for the coins permitted to be deposited in accordance with these regulations.


Authority to be in charge of parking meters

12   The operation, maintenance, regulation and use of all parking meters installed in the Town of Truro shall be under [the] management, supervision and direction of the Traffic Authority for the Town of Truro.


Enforcement

13   It shall be the duty of any police officer of the Town of Truro, or special constable appointed for the purpose, to inspect and examine all parking meters installed and all parking spaces in the Town of Truro and to report all violations of these regulations.

 

14   A person who is alleged to have violated the regulations and is given notice of the alleged violations may pay a penalty in the amount of Ten Dollars ($10.00) to the Truro Police Department, provided that if the said payment is made within a period of seven (7) days following the day on which [the] alleged violation was committed, then the said payment shall be reduced to Five Dollars ($5.00) and in either case such payment shall be on full satisfaction releasing and discharging all penalties and imprisonments incurred by the person for the violation.

 

15   Any person convicted of violating these regulations shall be liable for a first offence to a penalty of not more than Ten Dollars ($10.00) and in default [of payment] to imprisonment for a term of not more than two (2) days and for a subsequent offence to a penalty of not more than Fifteen Dollars ($15.00) and in default of payment to imprisonment for a term of not more than four (4) days.

 

16   These regulations shall remain in force until repealed thereof by the Traffic Authority or the date of revocation by the Minister of Transportation.

 

17   These regulations do not apply to stopping, parking or leaving standing of vehicles in respect of which identification permits have been issued pursuant to Section [subsection] 145(1) of the Motor Vehicle Act.
