Withdrawal of Energy Resources from the Act Regulations
made under Section 5 of the
Energy Resources Conservation Act

1 These regulations may be cited as the Withdrawal of Energy Resources from the ActRegulations.
2 In these regulations,
(a) “Act” means the Energy Resources Conservation Act;
(b) “offshore area” means the lands and submarine areas within the limitsdescribed in Schedule I to the Canada-Nova Scotia Offshore PetroleumResources Accord Implementation (Nova Scotia) Act.
Energy resources withdrawn from application of Act
3 The following energy resources found in the offshore area are withdrawn from theapplication of the Act:
(a) natural gas and all substances, other than oil, that are produced in associationwith natural gas;
(b) crude petroleum, regardless of gravity, produced at a wellhead in liquid form;
(c) any other hydrocarbons, except coal and coal gas associated with thedevelopment or operation of a coal mine, including hydrocarbons that may beextracted or recovered from surface or subsurface deposits, such as deposits ofoil sand, bitumen, bituminous sand, oil shale and other types of deposits.
