Insulator (Heat and Frost) Trade Regulations

made under Section 29 of the
Apprenticeship and Trades Qualifications Act

Citation
1 These regulations may be cited as the Insulator (Heat and Frost) Trade Regulations.

Definitions
2 (1) In these regulations

(a) "Act" means the Apprenticeship and Trades Qualifications Act;

(b) "engaged" means employed or hired for remuneration;

(c) "General Regulations" means regulations made by the Governor in Council under the authority of the Act that apply generally to all designated trades;

(d) “insulator (heat and frost) trade” or "trade" means the work performed in the manufacturing, fabrication, assembling, moulding, handling, erection, spraying, pouring, mixing, hanging, preparation, application, adjusting, alteration, repairing, dismantling, reconditioning, testing, and maintenance of insulating materials and includes

(i) the handling or distribution of insulating materials on job premises,

(ii) the operation of equipment and tools necessary for the trade,

(iii) the application of pipe and boiler coverings,

(iv) the insulation of hot and cold surfaces, ducts, flues, etc.,

(v) the abatement and removal of asbestos, and

(vi) the application of all protective covering required on insulation materials.

(e) “journeyperson” means a person who has acquired the knowledge and skills in the trade as attested to by a provincial or territorial authority.

(2) Unless the context otherwise requires, words defined in the Act have the same meaning when used in these regulations.

Contract of apprenticeship
3 No person shall enter into a contract of apprenticeship either as or with an apprentice in the trade unless the person being apprenticed

(a) is 16 years of age or older;

(b) has successfully completed grade 12 or its equivalent in the course skills required by the trade.

Term of apprenticeship
4 The term of apprenticeship for the trade is 8000 hours (4 years).

Wage schedule
5 The wage of an apprentice shall be no less than is prescribed in the following wage schedule and shall include the increase to which the apprentice is entitled on successful completion of each period:

from 0 - 2000 hours, 45% of the journeyperson’s rate;

from 2001 - 4000 hours, 65% of the journeyperson’s rate;

from 4001 - 6000 hours, 75% of the journeyperson’s rate;

from 6001 - 8000 hours, 85% of the journeyperson’s rate.

Ratio of apprentices to journeypersons
6 (1) Subject to subsection (2), an employer in the trade may employ 1 apprentice in the trade for each certified journeyperson who is employed by the employer.

(2) The ratio of apprentices to journeypersons employed by an employer in the trade may be varied with the prior written approval of the Director of Apprenticeship where the Director has determined that the variation is required because of the employment situation and the availability of certified journeypersons in the trade.

Examination for persons employed
7 A person other than a registered apprentice who

(a) satisfies the requirements of clauses 19(1)(b) and (c) of the General Regulations; and

(b) produces evidence to prove 10 000 hours of practical experience engaged in the trade

is eligible to be examined for a journeyperson’s certificate of qualification in the trade.
