Automotive Service Technician Trade Regulations
made under Section 29 of the
Apprenticeship and Trades Qualifications Act

1 In these regulations
(a) "Act" means the Apprenticeship and Trades Qualifications Act:
(b) "Director" means the Director of Apprenticeship and Trades Qualifications;
(c) "engaged" means employed for hire or remuneration;
(d) "General Regulations" means regulations made by the Governor in Council under authority of the Apprenticeship and Trades Qualifications Act that apply generally to all designated trades;
(e) "Minister" means the Minister of Labour and Advanced Education;
[Note: the Department name has been updated in accordance with Order in Council 2011-15 under the Public Service Act, R.S.N.S. 1989, c. 376, effective January 11, 2011.](f) "automotive service technician trade" or "trade" means the repair and maintenance of all mechanical and electrical devices on automobiles and light trucks as listed in Appendix I;
(g) "service station mechanic" means a person who is qualified to make repairs to motor vehicles as listed in Appendix II.
2 No person shall enter into a contract of apprenticeship either as or with an apprentice in the trade unless the person being apprenticed has successfully completed grade twelve or its equivalent in the course skills required by the trade/occupation.
Section 2 replaced: O.I.C. 96-268, N.S. Reg. 75/96.3 The trade is hereby designated as a certified trade.
4 The term of apprenticeship for the trade is four (4) years.
5 The wage of an apprentice shall be no less than is prescribed in the following wage schedule and shall include the increases to which the apprentice is entitled on successful completion of each six month period:
during the first six months at 50% of the journeyman's rate;
during the second six months at 55% of the journeyman's rate;
during the third six months at 60% of the journeyman's rate;
during the fourth six months at 65% of the journeyman's rate;
during the fifth six months at 70% of the journeyman's rate;
during the sixth six months at 75% of the journeyman's rate;
during the seventh six months at 85% of the journeyman's rate;
during the eighth six months at 90% of the journeyman's rate.6 (a) An employer in the trade may employ one apprentice for each certified journeyman in his employ.
(b) Notwithstanding subsection (a) the ratio of apprentices to journeymen employed by an employer in the trade may be varied from time to time with the approval of the Minister, after consideration of the employment situation and the availability of certified journeymen in the trade.
7 (1) A person who
(a) satisfies the requirements of Section 19 of the General Regulations; and
(b) produces evidence to prove five years of practical experience engaged in the trade, or four years if the applicant has successfully completed a vocational training course approved by the Director,
is eligible to be examined for a journeyman's certificate of qualification.
(2) A person may be examined for a certificate of qualification as a service station mechanic if the mechanic satisfies the requirement of Section 19 of the General Regulations and proves a minimum of three (3) years of practical experience engaged in the trade.
8 A certificate of qualification as a service station mechanic may be issued to an apprentice who
(i) has successfully completed a minimum period of three years related practical experience;
(ii) has passed the required examinations; and
(iii) makes application to be examined.
9 (a) Certificates of qualification and special certificates shall be valid for a period of five (5) years from the date of issue or renewal.
(b) Applications for renewal of certificates shall be made to the Director before the end of each five year period.
