Amending O. Reg. 533/98

(REGISTRATION)

Note: Ontario Regulation 533/98 has not previously been amended.

1. Subsections 1 (2), (3), (4) and (5) of Ontario Regulation 533/98 are revoked.

2. (1) Subsection 3 (1) of the Regulation is amended by adding “required under the by-laws” at the end.

(2) Subsection 3 (3) of the Regulation is revoked.

3. Paragraph 3 of section 4 of the Regulation is amended by striking out “Immigration Act (Canada)” and substituting “Immigration and Refugee Protection Act (Canada)”.

4. (1) Subsections 5 (4) and (5) of the Regulation are revoked.

(2) Subsection 5 (6) of the Regulation is amended by striking out “an applicant, other than an applicant described in subsection (4), must” in the portion before paragraph 1 and substituting “an applicant must”.

(3) Subsection 5 (8) of the Regulation is revoked.

(4) Subsection 5 (9) of the Regulation is amended by striking out “an applicant, other than an applicant described in subsection (4), must” in the portion before paragraph 1 and substituting “an applicant must”.

5. The Regulation is amended by adding the following section:

5.1 (1) Where section 22.18 of the Health Professions Procedural Code applies to an applicant for a certificate of registration, the applicant is deemed to have met the requirements of,

(a) subsection 5 (1), in the case of an applicant for a certificate of registration for a psychologist authorizing autonomous practice;

(b) subsection 5 (2), in the case of an applicant for a certificate of registration for a psychologist authorizing interim autonomous practice;

(c) paragraph 1 of subsection 5 (3), in the case of an applicant for a certificate of registration for a psychologist authorizing supervised practice;

(d) subsection 5 (6), in the case of an applicant for a certificate of registration for a psychological associate authorizing autonomous practice;

(e) subsection 5 (7), in the case of an applicant for a certificate of registration for a psychological associate authorizing interim autonomous practice; or

(f) paragraphs 1 and 2 of subsection 5 (9), in the case of an applicant for a certificate of registration for a psychological associate authorizing supervised practice.

(2) It is a non-exemptible registration requirement that an applicant referred to in subsection (1) provide a certificate, letter or other evidence satisfactory to the Registrar or a panel of the Registration Committee confirming that the applicant is in good standing as a psychologist or psychological associate, as the case may be, in every jurisdiction where the applicant holds an out-of-province certificate.

(3) Where an applicant to whom clause (1) (a), (b), (d) or (e) applies is unable to satisfy the Registrar or a panel of the Registration Committee that the applicant practised the profession of psychology to the extent that would be permitted by a certificate of registration of the class for which the applicant is applying in the preceding two years immediately before the date of that applicant’s application, the applicant must meet any further requirement to undertake, obtain or undergo material additional training, experience, examinations or assessments that may be specified by a panel of the Registration Committee.

(4) An applicant referred to in subsection (1) is deemed to have met the requirements of paragraph 2 of section 4 where the requirements for the issuance of the applicant’s out-of-province certificate included language proficiency requirements equivalent to those required by that paragraph.

(5) Despite subsection (1), an applicant is not deemed to have met a requirement if that requirement is described in subsection 22.18 (3) of the Health Professions Procedural Code.

6. Subsections 6 (4) and (5) of the Regulation are revoked and the following substituted:

(4) Subject to subsection (1), a certificate of registration for a psychologist authorizing supervised practice or certificate of registration for a psychological associate authorizing supervised practice expires on the date specified in the certificate, which shall be no earlier than one year and no later than two years after the Registrar issues it.

7. (1) Clause 7 (1) (d) of the Regulation is revoked and the following substituted:

(d) pays the applicable fee required under the by-laws.

(2) Clause 7 (2) (e) of the Regulation is revoked and the following substituted:

(e) the member pays the applicable fee required under the by-laws.

8. (1) Clause 8 (1) (e) of the Regulation is revoked and the following substituted:

(e) pays the applicable fee required under the by-laws.

(2) Clause 8 (2) (d) of the Regulation is revoked and the following substituted:

(d) pays the applicable fee required under the by-laws.

9. (1) Clause 9 (1) (d) of the Regulation is revoked and the following substituted:

(d) pays the applicable fee required under the by-laws.

(2) Subsection 9 (2) of the Regulation is revoked.

(3) Clause 9 (3) (d) of the Regulation is revoked and the following substituted:

(d) pays the applicable fee required under the by-laws.

10. Paragraph 1 of subsection 10 (1) of the Regulation is revoked and the following substituted:

1. A conviction for any offence.

11. Section 11 of the Regulation is revoked and the following substituted:

11. If the Registrar suspends a member’s certificate of registration pursuant to section 24 of the Health Professions Procedural Code for failure to pay a fee, the Registrar may lift the suspension within two years from the date of suspension on the payment of,

(a) the fee the member failed to pay; and

(b) all applicable fees and penalties required under the by-laws.

Commencement

12. This Regulation comes into force on the day it is filed.
