Amending Reg. 909 of R.R.O. 1990

(GENERAL)

1. Subparagraphs 2 ii and iii of subsection 5.6 (7) of Regulation 909 of the Revised Regulations of Ontario, 1990 are revoked and the following substituted:

ii. unless the plan is a successor pension plan described in section 81 of the Act and the original pension plan was registered before that day, or

iii. unless the plan was formed by the merger of two or more plans and at least one of the original pension plans was registered before that day.

2. Subparagraphs 2 ii and iii of subsection 5.6.1 (8) of the Regulation are revoked and the following substituted:

ii. unless the plan is a successor pension plan described in section 81 of the Act and the original pension plan was registered before that day, or

iii. unless the plan was formed by the merger of two or more plans and at least one of the original pension plans was registered before that day.

3. (1) Subsection 14 (4) of the Regulation is amended by striking out “except where the plan is a successor plan as described in subsection 80 (2) or section 81 of the Act” at the end and substituting “except where the plan is a successor pension plan as described in subsection 80 (5) or section 81 of the Act”.

(2) Subsection 14 (11) of the Regulation is revoked and the following substituted:

(11) A report under this section is a prescribed document for the purposes of paragraph 1 of subsection 105 (2) of the Act (extension of time).

4. Section 24.5 of the Regulation is amended by striking out “An order under subsection 80 (6) or 81 (6) of the Act” at the beginning and substituting “An order under subsection 79.2 (15) of the Act”.

5. Subsection 37 (13) of the Regulation is amended by striking out “other than a pension plan that is a successor plan as described in subsection 80 (2) or section 81 of the Act” at the end and substituting “other than a pension plan that is a successor pension plan as described in subsection 80 (5) or section 81 of the Act”.

Commencement

6. (1) Subject to subsection (2), this Regulation comes into force on the later of the following days:

1. The day section 68 of the Pension Benefits Amendment Act, 2010 comes into force.

2. The day this Regulation is filed.

(2) Subsection 3 (2) comes into force on the later of the following days:

1. The day section 44 of the Securing Pension Benefits Now and for the Future Act, 2010 comes into force.

2. The day this Regulation is filed.
