Amending O. Reg. 199/07

(COMMERCIAL MOTOR VEHICLE INSPECTIONS)

1. (1) Subsection 1 (1) of Ontario Regulation 199/07 is amended by adding the following definition:

“inter-city bus” means a bus commonly known as a motor coach that has,

(a) motive power mounted to the rear of the front axle,

(b) air-ride or torsion-bar suspension,

(c) a baggage area that is separate from the passenger cabin, and

(d) a passenger cabin with reclining seats for passengers;

(2) The definition of “motor coach” in subsection 1 (2) of the Regulation is revoked.

(3) Clause (b) of the definition of “school purposes bus” in subsection 1 (2) of the Regulation is revoked and the following substituted:

(b) a bus, other than an inter-city bus, operated by or under contract with a school board or other authority in charge of a school;

(4) The definition of “school purposes vehicle” in subsection 1 (2) of the Regulation is revoked and the following substituted:

“school purposes vehicle” means a passenger vehicle, other than a bus, that is operated by or under a contract with a school board or other authority in charge of a school for the transportation of six or more adults with a developmental disability, six or more children or six or more persons from both categories.

2. (1) Paragraph 2 of subsection 4 (2) of the Regulation is amended by striking out “or” at the end of subparagraph i, by adding “or” at the end of subparagraph ii and by adding the following subparagraph:

iii. carrying animals or non-commercial tools, equipment or vehicles that occupy one-half or more of its floor space.

(2) Paragraph 3 of subsection 4 (2) of the Regulation is amended by striking out “or” at the end of subparagraph i, by adding “or” at the end of subparagraph ii and by adding the following subparagraph:

iii. carrying animals or non-commercial tools, equipment or vehicles that occupy one-half or more of its floor space.

3. (1) Subparagraphs 2 i and ii of subsection 5 (1) of the Regulation are revoked and the following substituted:

i. buses, including inter-city buses but excluding school purposes buses, and

ii. trailers drawn by a bus, including an inter-city bus or a school purposes bus.

(2) Paragraph 3 of subsection 5 (1) of the Regulation is revoked and the following substituted:

3. Schedule 3 applies to inter-city buses.

(3) Subsection 5 (2) of the Regulation is amended by striking out “a motor coach” and substituting “an inter-city bus”.

4. Subsection 6 (4) of the Regulation is revoked and the following substituted:

(4) Despite subsection (3), a daily inspection of an inter-city bus in accordance with Schedule 3 is not valid unless an under-vehicle inspection of the inter-city bus has been conducted in accordance with Part III and is still valid.

5. (1) Subsection 11 (1) of the Regulation is amended by striking out “a motor coach” at the end and substituting “an inter-city bus”.

(2) Subsection 11 (4) of the Regulation is amended by striking out “the motor coach” wherever it appears and substituting in each case “the inter-city bus”.

(3) Subsection 11 (7) of the Regulation is amended by striking out “the motor coach” and substituting “the inter-city bus”.

6. (1) Paragraph 1 of subsection 12 (1) of the Regulation is revoked and the following substituted:

1. The licence plate number and the vehicle identification number or unit number of the inter-city bus.

(2) Paragraph 6 of subsection 12 (1) of the Regulation is amended by striking out “the motor coach” and substituting “the inter-city bus”.

(3) Paragraph 7 of subsection 12 (1) of the Regulation is amended by striking out “the motor coach” and substituting “the inter-city bus”.

(4) Subsection 12 (3) of the Regulation is amended by striking out “each motor coach” and substituting “each inter-city bus”.

7. Paragraph 6 of subsection 16 (1) of the Regulation is revoked and the following substituted:

6. In the case of an inter-city bus, every under-vehicle inspection report for the inter-city bus submitted to the operator under section 13.

8. Subsection 18 (5) of the Regulation is amended by striking out “the report or document” and substituting “the record or document”.

9. (1) Schedule 1 to the Regulation is amended by striking out “(a) any door fails to close securely” under Column 3 opposite “Part 2. Cab” under Column 1 and substituting “(a) any cab or sleeper door fails to close securely”.

(2) Schedule 1 to the Regulation is amended by striking out “(b) parking brake is inoperative” under Column 2 opposite “Part 17. Hydraulic Brake System” under Column 1 and by adding “(f) parking brake is inoperative” under Column 3.

(3) Schedule 1 to the Regulation is amended by striking out “(a) damaged or deflated air bag” under Column 3 opposite “Part 20. Suspension System” under Column 1 and substituting “(a) damaged (patched, cut, bruised, cracked to braid or deflated) air bag or insecurely mounted air bag”.

(4) Schedule 1 to the Regulation is amended by striking out “(b) tire leaking” under Column 2 opposite “Part 21. Tires” under Column 1 and substituting “(b) tire leaking, if leak cannot be heard” and by adding “(a.1) tire leaking, if leak can be felt or heard” under Column 3.

10. (1) Schedule 2 to the Regulation is amended by striking out “(b) parking brake is inoperative” under Column 2 opposite “Part 18. Hydraulic Brake System” under Column 1 and by adding “(f) parking brake is inoperative” under Column 3.

(2) Schedule 2 to the Regulation is amended by striking out “(a) damaged or deflated air bag” under Column 3 opposite “Part 22. Suspension System” under Column 1 and substituting “(a) damaged (patched, cut, bruised, cracked to braid or deflated) air bag or insecurely mounted air bag”.

(3) Schedule 2 to the Regulation is amended by striking out “(b) tire leaking” under Column 2 opposite “Part 23. Tires” under Column 1 and substituting “(b) tire leaking, if leak cannot be heard” and by adding “(a.1) tire leaking, if leak can be felt or heard” under Column 3.

11. (1) The heading to Schedule 3 to the Regulation is revoked and the following substituted:

(2) Schedule 3 to the Regulation is amended by striking out “(a) damaged or deflated air bag” under Column 3 opposite “Part 18. Suspension System” under Column 1 and substituting “(a) damaged (patched, cut, bruised, cracked to braid or deflated) air bag or insecurely mounted air bag”.

(3) Schedule 3 to the Regulation is amended by striking out “(b) tire leaking” under Column 2 opposite “Part 20. Tires” under Column 1 and substituting “(b) tire leaking, if leak cannot be heard” and by adding “(a.1) tire leaking, if leak can be felt or heard” under Column 3.

12. (1) The heading to Schedule 4 to the Regulation is revoked and the following substituted:

UNDER-VEHICLE INSPECTION OF INTER-CITY BUSES

(2) Schedule 4 to the Regulation is amended by striking out “(m) DD3 brake chamber fails to hold vehicle in place during tug test, when all air reservoirs are drained” under Column 2 opposite “Part 1. Air Brake System” under Column 1.

13. (1) Schedule 5 to the Regulation is amended by adding “(a) a lamp is missing or inoperative (b) lamps do not alternate (c) a lamp is not of the proper colour” under Column 2 opposite “Part 2. Alternating Overhead Lamps” under Column 1 and by adding “When use of lamp is required:” above clause (a) under Column 3.

(2) Schedule 5 to the Regulation is amended by striking out “(f) inoperative service brake or ineffective parking brake” under Column 3 opposite “Part 15. Hydraulic Brake System” under Column 1 and substituting “(f) inoperative service or parking brake”.

(3) Schedule 5 to the Regulation is amended by adding “(b) stop arm or stop sign is missing (c) stop arm or stop sign is damaged so as to significantly affect visibility (d) will not extend fully or stay fully extended (e) either light on stop arm is inoperative or lights do not alternate or lights are not red” under Column 2 opposite “Part 25. Stop Arm” under Column 1 and by adding “When use of stop arm or stop sign is required:” above clause (a) under Column 3.

(4) Schedule 5 to the Regulation is amended by striking out “(a) damaged or deflated air bag” under Column 3 opposite “Part 26. Suspension System” under Column 1 and substituting “(a) damaged (patched, cut, bruised, cracked to braid or deflated) air bag or insecurely mounted air bag”.

(5) Schedule 5 to the Regulation is amended by striking out “(b) tire leaking” under Column 2 opposite “Part 27. Tires” under Column 1 and substituting “(b) tire leaking, if leak cannot be heard” and by adding “(a.1) tire leaking, if leak can be felt or heard” under Column 3.

14. (1) Schedule 6 to the Regulation is amended by striking out “(a) damaged or deflated air bag” under Column 3 opposite “Part 17. Suspension System” under Column 1 and substituting “(a) damaged (patched, cut, bruised, cracked to braid or deflated) air bag or insecurely mounted air bag”.

(2) Schedule 6 to the Regulation is amended by striking out “(b) tire leaking” under Column 2 opposite “Part 18. Tires” under Column 1 and substituting “(b) tire leaking, if leak cannot be heard” and by adding “(a.1) tire leaking, if leak can be felt or heard” under Column 3.

Commencement

15. This Regulation comes into force on the later of January 1, 2015 and the day it is filed.
