(REGISTRATIONS UNDER PART II.2 OF THE ACT — PRINTING)

1. The Table to section 2 of Ontario Regulation 349/12 is revoked and the following substituted:

3. Section 5 of the Regulation is revoked and the following substituted:

Activity requirements, s. 20.21 (1) (c) of the Act

5. (1) For the purposes of clause 20.21 (1) (c) of the Act, a person who engages in an activity prescribed by section 3 of this Regulation shall ensure that the requirements set out in subsection (2) and the requirements set out in sections 5.1 and 5.2 of this Regulation that are applicable to the printing process or processes engaged in at the printing facility are complied with.

(2) For any printing process engaged in at the printing facility, the following requirements apply:

1. The following items shall be used, operated and maintained in a manner that satisfies the recommendations of the manufacturer of the item:

i. A printing production assembly that is part of a printing press.

ii. Equipment used or operated in a screen reclamation area.

iii. A noise generating equipment unit.

iv. Equipment used or operated to control the discharge of contaminants from a printing press.

2. Cleaning solutions used to clean and maintain equipment used or operated in a printing process and cleaning supplies that come in contact with the cleaning solutions before disposal shall be stored in sealed containers when not in use.

3. Cyclone dust collectors and paper waste compactors that are used or operated shall be used or operated between the hours of 7 a.m. and 7 p.m.

4. Any structure, equipment, apparatus, mechanism or thing that is used or operated in a printing process shall be used or operated only if all doors to the exterior of the building from the area where the printing process is engaged in are closed, except to allow for the normal ingress and egress of personnel, and if all windows to the area are closed.

5. If the person receives a complaint with respect to the facility and the complaint relates to the natural environment, the district manager of the Ministry for the district in which the facility is located shall be notified of the complaint no later than two business days after the complaint is received.

Activity requirements, s. 20.21 (1) (c) of the Act — individual printing processes

5.1 (1) For digital printing engaged in at the printing facility, either on its own or in combination with other printing, the following requirements apply for the purposes of subsection 5 (1):

1. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 6 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph,

i. the amount of organic solvent based liquid inks used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table, and

ii. the amount of water based liquid inks used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 3 of that Table.

(2) For heatset web lithographic printing engaged in at the printing facility, either on its own or in combination with other printing, the following requirements apply for the purposes of subsection 5 (1):

1. Any fountain solution used shall have a volatile organic compound concentration that is less than 30 per cent by weight, as specified by the manufacturer of the fountain solution.

2. Any ink used after the addition of any reducers shall have a volatile organic compound concentration that is less than 40 per cent by weight.

3. Any coating used shall have a volatile organic compound concentration that is less than 40 per cent by weight, as specified by the manufacturer of the coating.

4. Any adhesive used shall have a volatile organic compound concentration that is less than 40 per cent by weight, as specified by the manufacturer of the adhesive.

5. Each press dryer shall be used or operated at a vacuum at the web slot of at least 1.3 mm of water relative to the press room, or the average capture velocity of the air entering the dryer ports shall be at least 1 metre per second.

6. Each press dryer, when it is used or operated, shall exhaust to equipment that is designed to control the discharge of contaminants and is specified by the manufacturer of the equipment as having a minimum emissions reduction efficiency of 95 per cent.

7. The exhaust stacks associated with the equipment described in paragraph 6 shall be oriented vertically and shall be free of any impediments that would prevent the flow of emissions.

8. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 9 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph, the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table.

(3) For newspaper lithographic printing engaged in at the printing facility, either on its own or in combination with other printing, the following requirements apply for the purposes of subsection 5 (1):

1. Any fountain solution used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the fountain solution.

2. Any ink used shall have a volatile organic compound concentration that is less than five per cent by weight, as specified by the manufacturer of the ink.

3. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 10 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph, the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table.

4. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 11 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph, the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table.

(4) For non-heatset web lithographic printing engaged in at the printing facility, either on its own or in combination with other printing, the following requirements apply for the purposes of subsection 5 (1):

1. Any fountain solution used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the fountain solution.

2. Any ink used after the addition of any reducers shall have a volatile organic compound concentration that is less than 15 per cent by weight.

3. Any coating used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the coating.

4. Any adhesive used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the adhesive.

5. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 14 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph, the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table.

(5) For sheet-fed lithographic printing engaged in at the printing facility, either on its own or in combination with other printing, the following requirements apply for the purposes of subsection 5 (1):

1. Any fountain solution used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the fountain solution.

2. Any ink used after the addition of any reducers shall have a volatile organic compound concentration that is less than 15 per cent by weight.

3. Any coating used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the coating.

4. Any adhesive used shall have a volatile organic compound concentration that is less than 15 per cent by weight, as specified by the manufacturer of the adhesive.

5. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 14 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph, the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table.

(6) For screen printing engaged in at the printing facility, either on its own or in combination with other printing, the following requirements apply for the purposes of subsection 5 (1):

1. The exhaust stacks associated with a screen reclamation area or dryer shall be oriented vertically and shall be free of any impediments that would prevent the flow of emissions.

2. Any organic solvent based liquid ink used shall have a volatile organic compound concentration that is less than or equal to 400 g/L.

3. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 7 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph,

i. the amount of screen printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table, and

ii. the amount of cleaning solutions used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 3 of that Table.

Activity requirements, s. 20.21 (1) (c) of the Act — combinations of printing processes

5.2 (1) If both digital printing and screen printing are engaged in at the printing facility, the following requirements apply for the purposes of subsection 5 (1):

1. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 8 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph,

i. the amount of organic solvent based liquid inks used in digital printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table,

ii. the amount of water based liquid inks used in digital printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 3 of that Table,

iii. the amount of cleaning solutions used in screen printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 4 of that Table, and

iv. the amount of organic solvent based liquid inks used in digital printing in a month at the facility and screen printing materials used in screen printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 5 of that Table.

(2) If both heatset web lithographic printing and newspaper lithographic printing are engaged in at the printing facility, the following requirements apply for the purposes of subsection 5 (1):

1. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 12 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph,

i. the amount of inks used in heatset web lithographic printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table, and

ii. the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 3 of that Table.

2. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 13 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph,

i. the amount of inks used in heatset web lithographic printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table, and

ii. the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 3 of that Table.

(3) If heatset web lithographic printing and one or both of non-heatset web lithographic printing and sheet-fed lithographic printing are engaged in at the printing facility, the following requirements apply for the purposes of subsection 5 (1):

1. If, for the purpose of meeting the criterion set out in paragraph 1 of subsection 15 (2), a distance set out in Column 1 of the Table to that paragraph must be met or exceeded as described in that paragraph,

i. the amount of inks used in heatset web lithographic printing in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 2 of that Table, and

ii. the amount of lithographic printing materials used in a month at the facility shall not exceed the highest amount set out opposite that distance in Column 3 of that Table.

4. The Table to paragraph 1 of subsection 6 (2) of the Regulation is revoked and the following substituted:

14. Section 17 of the Regulation is amended by striking out “the fifth anniversary of the day this Regulation comes into force” and substituting “November 18, 2022”.
