Regulations Respecting Zoning at Kenora Airport
P.C. 1993-1936 1993-12-02Whereas, pursuant to section 5.5 of the Aeronautics Act, a copy of the proposed Regulations respecting zoning at Kenora Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I, on June 19th and 26th, 1993, and in two successive issues of The Daily Miner and News on July 21st and 22nd, 1993, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Kenora Airport.Short Title
1 These Regulations may be cited as the Kenora Airport Zoning Regulations.
Interpretation
2 (1) In these Regulations,
airport
airport means the Kenora Airport, in the Town of Jaffray and Melick, in the Province of Ontario; (aéroport)
airport reference point
airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)
approach surfaces
approach surfaces means the imaginary inclined planes that extend upward and outward from each end of a strip, which planes are more particularly described in Part II of the schedule; (surfaces d’approche)
outer surface
outer surface means an imaginary plane located above and in the immediate vicinity of the airport, which plane is more particularly described in Part III of the schedule; (surface extérieure)
strip
strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which portion is more particularly described in Part IV of the schedule; (bande)
transitional surfaces
transitional surfaces means the imaginary inclined planes that extend upward and outward from the lateral limits of a strip and its approach surfaces, which planes are more particularly described in Part V of the schedule. (surfaces de transition)
(2) For the purposes of these Regulations, the elevation of the airport reference point is 403.8 m above sea level.
Application
3 These Regulations apply to all the land, including public road allowances, that is adjacent to or in the vicinity of the airport, which land is more particularly described in Part VI of the schedule.
General
4 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point
(a) the approach surfaces;
(b) the outer surface; or
(c) the transitional surfaces.
Aeronautical Facilities
5 No owner or lessee of any land to which these Regulations apply shall permit any part of that land to be used or developed in a manner that causes interference with any signals or communications to and from any aircraft or to and from any facilities used to provide services relating to aeronautics.
Natural Growth
6 Where an object of natural growth that is on any land to which these Regulations apply grows to a height that exceeds in elevation at the location of the object any of the surfaces referred to in section 4, the Minister may require that the owner or lessee of the land remove the excessive growth.
Disposal of Waste
7 No owner or lessee of any land to which these Regulations apply shall permit any part of that land to be used for the disposal of any waste that is edible by or attractive to birds.
SCHEDULE(Sections 2 and 3)
PART I Description of the Airport Reference Point
The airport reference point, shown on Kenora Airport Zoning Plan No. 60-014 89-021, Sheet 10, dated 4 December l990, is a point which may be located by:
COMMENCING at the threshold of runway 07 being the westerly end of runway 07-25 at Kenora Airport, having the Universal Transverse Mercator coordinates of 401 029.18 E and 5 515 592.14 N;
THENCE easterly along the centre line of said runway 07-25, 1 016.25 m to a point;
THENCE northerly and perpendicular to the centre line of the said runway 07-25, 81.08 m to the airport reference point, which point has the Universal Transverse Mercator coordinates of 402 008.73 E and 5 515 873.71 N.
PART II Description of the Approach Surfaces
The approach surfaces, shown on Kenora Airport Zoning Plan No. 60-014 89-021, Sheets 1, 2, 3, 4, 5, 9, 10, 11, 15 and 16, dated 4 December 1990, are planes abutting each end of the strip associated with runway 07-25, and are described as follows:
(a) an inclined plane abutting the end of the strip associated with the approach to runway 07 having a ratio of l m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m above the elevation at the end of the strip; and
(b) an inclined plane abutting the end of the strip associated with the approach to runway 25 having a ratio of l m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant l5 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m above the elevation at the end of the strip.
PART III Description of the Outer Surface
The outer surface, shown on Kenora Airport Zoning Plan No. 60-014 89-021, Sheets 6, 7, 8, 9, 10, 11, 12, 13 and 14, dated 4 December 1990, is an imaginary plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that plane is less than 9 m above the surface of the ground, the outer surface is located at 9 m above the surface of the ground.
PART IV Description of the Strip
The strip, shown on Kenora Airport Zoning Plan No. 60-014 89-021, Sheet 10, dated 4 December 1990, is described as follows:
(a) the strip associated with runway 07-25 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1 888 m in length.
PART V Description of Each Transitional Surface
Each transitional surface, shown on Kenora Airport Zoning Plan No. 60-014 89-021, Sheets 9, 10 and 11, dated 4 December 1990, is an inclined plane rising at a ratio of l m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip, extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface.
PART VI Description of the Lands to Which These Regulations Apply
The outer boundary of the land to which these Regulations apply, shown on Kenora Airport Zoning Plan No. 60-014 89-021, Sheets 1, 2, 3, 4, 5, 6, 7, 8, 9, 11, 12, 13, 14, 15 and 16 dated 4 December 1990, is described as follows:
ALL AND SINGULAR those parcels or tracts of land in the Town of Jaffray and Melick, the Townships of Haycock, Coyle, Jackson and Pettypiece, and the Towns of Kenora and Keewatin, in the District of Kenora;
COMMENCING at the southwest corner of Location 555P in the Geographic Township of Jaffray now in the Corporation of the Town of Jaffray and Melick;
THENCE northerly along the western boundary of Location 555P to the northwest corner thereof, being also a point of the boundary between Concessions 3 and 4;
THENCE westerly along the boundary between Concessions 3 and 4 to the southwestern corner of Lot 14, Concession 4;
THENCE northerly along the western boundary of the said Lot 14, Concession 4 to the intersection thereof with the southern boundary of Location K101;
THENCE westerly along the southern boundary of said Location K101 to the southwestern corner thereof;
THENCE northerly along the western boundary of said Location K101 to the northeastern corner of Lot 13, Concession 4;
THENCE westerly along the northern boundary of said Lot 13, Concession 4 to the southwestern corner of Lot 13, Concession 5;
THENCE northerly along the western boundary of said Lot 13, Concession 5 to the intersection thereof with the southern limit of the approach surface for runway 07;
THENCE southwesterly along the said southern limit of approach surface for runway 07 to the southerly corner thereof, the Universal Transverse Mercator (UTM) coordinates of which are 386 752.68 E and 5 510 245.72 N;
THENCE northerly along the western limit of said approach surface for runway 07 to the most northerly corner thereof, the UTM coordinates of which are 385 798.03 E and 5 514 948.13 N;
THENCE easterly along the northern limit of said approach surface for runway 07 to the intersection thereof with the western limit of Location 264P;
THENCE northerly along the western boundary of said Location 264P to the intersection thereof with the southern boundary of Location K104;
THENCE easterly along the southern boundary of said Location K104 to the southeastern corner thereof;
THENCE northerly along the western boundaries of Locations 264P, 263P and JA3 to the northwestern corner of said Location JA3;
THENCE easterly along the northern boundary of said Location JA3 to the southwestern corner of Lot 11, Concession 7;
THENCE northerly along the western boundaries of said Lot 11, Concession 7 and Lot 11, Concession 8 to the northwestern corner of said Lot 11, Concession 8, being also a point in the boundary between the Geographic Townships of Jaffray and Melick;
THENCE easterly along the northern boundary of said Lot 11, Concession 8 to the intersection thereof with the water’s edge on the western shore of a bay of one of the Black Sturgeon Lakes;
THENCE easterly in a straight line across the said bay of one of the Black Sturgeon Lakes to the intersection of the boundary between the Geographic Townships of Jaffray and Melick with the water’s edge on the eastern shore of the said bay;
THENCE easterly along the northern boundary of Lot 12, Concession 8 to the intersection thereof with the western limit of the road allowance for Highway 659;
THENCE easterly in a straight line continuing on the northern boundary of Lot 12, Concession 8, across the said road allowance for Highway 659 to the eastern limit thereof;
THENCE northerly along the said eastern limit of Highway 659 to the intersection thereof with the water’s edge on the southern shore of one of the Black Sturgeon Lakes;
THENCE in a general easterly direction following the water’s edge of the southern shore of the Black Sturgeon River and one of the Black Sturgeon Lakes to a point in front of the eastern limit of Location FM66 to the intersection with a circular arc having a radius of 4 000 metres measured from the Airport Reference Point, the UTM Coordinates of which are 402 008.73 E and 5 515 873.71 N;
THENCE southeasterly along the said arc across the Black Sturgeon Lakes to a point where it intersects the water’s edge of the southern shore of the said Lake on the northern boundary of Lot 11, Concession 6 in the Township of Haycock;
THENCE northeasterly along the water’s edge of the southern shore of one of the Black Sturgeon Lakes to the northeastern corner of Lot 11, Concession 6 in the Township of Haycock;
THENCE southerly along the eastern boundary of said Lot 11, Concession 6 to the intersection thereof with the water’s edge on the northern shore of Island Lake;
THENCE easterly and southeasterly along the said water’s edge on the northern shore of Island Lake to the intersection thereof with the said circular arc;
THENCE southerly along the said circular arc to the intersection thereof with the northern limit of the approach surface for runway 25;
THENCE northeasterly along the said northern limit of the approach surface for runway 25 to the northerly corner thereof, the UTM coordinates of which are 417 037.74 E and 5 521 290.19 N;
THENCE southerly along the eastern limit of the said approach surface for runway 25 to the southeasterly corner thereof, the UTM coordinates of which are 417 992.39 E and 5 516 587.78 N;
THENCE westerly along the southern limit of the said approach surface for runway 25 to the intersection thereof with the western boundary of Lot 9, Concession 4 in the Township of Haycock;
THENCE southerly along the western boundary of Lot 9, Concession 4 to the intersection thereof with the northern boundary of Location E180;
THENCE westerly along the northern boundary of Location E180 to the northwestern corner thereof;
THENCE southerly along the western boundary of Location E180 to the southwestern corner thereof;
THENCE southwesterly in a straight line across part of the annulled portion of the Township of Haycock to the northeastern corner of Location E4;
THENCE southerly along the eastern boundary of Location E4 to the southeastern corner thereof;
THENCE westerly along the southern boundary of Location E4 to the northeastern corner of Location P349;
THENCE southerly along the eastern boundary of Location P349 to the southeastern corner thereof;
THENCE westerly along the southern boundary of said Location P349 to the southwestern corner thereof;
THENCE southwesterly in a straight line across part of the annulled portion of the Township of Haycock and continuing across Breakneck Lake to the intersection of the water’s edge on the western shore of the said Breakneck Lake and the boundary between the Township of Haycock and the Township of Jaffray being also the intersection of the northerly limit of Location 416P and the said water’s edge;
THENCE westerly along the said northerly limit of Location 416P (being also the boundary between the Township of Haycock and the Geographic Township of Jaffray) to the northwestern corner of the said Location 416P;
THENCE southerly along the westerly limit of Location 416P (being also the boundary between the Township of Haycock and the Geographic Township of Jaffray) to the intersection thereof with the northern boundary of Location 304P in the Geographic Township of Jaffray;
THENCE westerly along the said northern boundary of Location 304P to the northwestern corner thereof;
THENCE southerly along the western boundary of Location 304P to the northeastern corner of Location 337P;
THENCE westerly along the northern boundary of Location 337P to the northwestern corner thereof;
THENCE southerly along the western boundary of Location 337P to the northeastern corner of Lot 21, Concession 1 in the Geographic Township of Jaffray;
THENCE westerly along the northern boundary of Lot 21, Concession 1 to the northwestern corner thereof, being also a point on the eastern boundary of Location 436P;
THENCE northerly along the eastern boundary of the said Location 436P to the northeastern corner thereof;
THENCE westerly along the northern boundary of the said Location 436P and its projection to the water’s edge of the eastern shore of Hilly Lake;
THENCE southerly and westerly following the water’s edge on the southern shore of Hilly Lake in a general westerly direction to a point on the water’s edge of the western shore of Hilly Lake, where it is intersected by the easterly projection of the southern boundary of lands designated as Part 1 on a plan of survey deposited in the Land Registry Office for the Land Titles Division of Kenora as Plan KR-968;
THENCE westerly along the said eastern projection of the southern limit of Part 1, Plan KR-968 and continuing westerly along the southern limit of Part 1 and Part 2, Plan KR-968 to the intersection thereof with the eastern boundary of Lot 18, Concession 1 in the Geographic Township of Jaffray;
THENCE northerly along the said eastern boundary of Lot 18, Concession 1 to the northeastern corner thereof, being also an angle in the southern boundary of Location 432P;
THENCE westerly along the said southern boundary of Location 432P and the southern boundary of Location 555P to the southwestern corner of said Location 555P, being the POINT OF COMMENCEMENT.
