Interpretation

Marginal note:Definitions

1 The following definitions apply in these Regulations.

Act
Loi

Act means the Export and Import Permits Act. (Loi)

board foot
pied-planche

board foot has the same meaning as in section 2 of the Softwood Lumber Products Export Charge Act, 2006. (pied-planche)

date of shipment
date d’expédition

date of shipment, in respect of a softwood lumber product, means the time at which the product is considered to be exported under section 5 of the Softwood Lumber Products Export Charge Act, 2006. (date d’expédition)

permit
licence

permit means an export permit issued under the Act. (licence)

region
région

region means Nova Scotia, New Brunswick, Prince Edward Island, Newfoundland and Labrador, Yukon , Northwest Territories or Nunavut, and includes a region as defined in subsection 6.3(1) of the Act. (région)

region of first primary processing
région de première transformation

region of first primary processing, in respect of a softwood lumber product, means the region where the product undergoes its first “primary processing”, as defined in section 2 of the Softwood Lumber Products Export Charge Act, 2006. (région de première transformation)

softwood lumber products
produits de bois d’œuvre

softwood lumber products means goods included in item 5104 of Group 5 of the schedule to the Export Control List. (produits de bois d’œuvre)

Application for a Permit

2 (1) An exporter or their agent or mandatary who applies for a permit to export softwood lumber products to the United States must submit to the Minister the following information, together with a statement that the information is true, correct and complete:

(a) the name and address of the exporter and, if applicable, of the agent or mandatary;
(b) the exporter’s identifier number assigned by the Minister;
(c) the official language selected for communications with the exporter;
(d) whether or not the exporter and, if applicable, the agent or mandatary are residents of Canada;
(e) a detailed description of the softwood lumber products;
(f) the tariff classification of the softwood lumber products set out in the List of Tariff Provisions under the Customs Tariff ;
(g) the quantity of the softwood lumber products, expressed in board feet;
(h) the name of the region of first primary processing;
(i) the name and business number assigned by the Minister of National Revenue of the mill that carried out the first primary processing of the softwood lumber products;
(j) the export price in Canadian or United States dollars of the softwood lumber products;
(k) the date of shipment of the softwood lumber products;
(l) the mode of transportation of the softwood lumber products;
(m) the port of entry of the softwood lumber products into the United States;
(n) the date of entry of the softwood lumber products into the United States; and
(o) the name and address of the importer or consignee.

(2) If the softwood lumber products originate from Nova Scotia, New Brunswick, Prince Edward Island or Newfoundland and Labrador, the application must include the Maritime Lumber Bureau Certificate of Origin number for those products.

3 If the exporter is not a resident of Canada, the application must be made by an agent or mandatary who is a resident of Canada.

Information in Respect of Certain Products that Do Not Require a Permit

4 A person who exports to the United States a single family home package or kit that is expressly excluded from the Export Control List under item 5104 of that list must retain the following documents and provide them to U.S. Customs and Border Protection on request:

(a) a copy of the appropriate home design plan, or of a blueprint matching the customs entry in the United States;
(b) a purchase contract from a retailer of home packages or kits, signed by a customer not affiliated with the person who imports the packages or kits into the United States;
(c) a listing of inventory of all parts of the package or kit entering the United States that conforms to the home design package; and
(d) in the case of multiple shipments on the same contract, a listing of inventory described in paragraph (c) that indicates the items that are included in the shipment at issue.
