Regulations Respecting Employment Related to Mines at the Donkin Coal Block

Marginal note:Definition

1 In these Regulations, Nova Scotia laws means the Acts and regulations of Nova Scotia, as amended from time to time, set out in Schedule 1 and, for greater certainty, includes regulations made under one or more of those Acts after the coming into force of these Regulations, unless otherwise provided.

Marginal note:Nova Scotia Interpretation Act

2 The Nova Scotia Interpretation Act (R.S.N.S. 1989, c. 235), as amended from time to time, applies to the interpretation of the Nova Scotia laws, with the adaptations set out in Schedule 2.

Marginal note:Canada Labour Code

3 The employment in or in connection with the operation of a mine that is wholly or partly at the Donkin coal block is excluded from the application of Parts I, II and III of the Canada Labour Code.

Marginal note:Incorporation of Nova Scotia laws

4 The Nova Scotia laws are incorporated by reference and apply, with the adaptations set out in Schedule 2, to the employment in or in connection with the operation of a mine that is wholly or partly at the Donkin coal block.

5 These Regulations come into force on the day on which they are registered.

Occupational Health Regulations (N.S. Reg. 112/76), other than section 10

Trade Union Act (R.S.N.S. 1989, c. 475) and its regulations

PART 1 Adaptation of the Labour Standards Code

Marginal note:Pregnancy and parental leave

1 In subsections 59A(2) and 59G(3), a reference to the Human Rights Act (R.S.N.S. 1989, c. 214) shall be read as a reference to the Canadian Human Rights Act.

Marginal note:Death of common-law partner

2 An employee is also entitled to leave under clause 60A(a) on the death of the employee’s common-law partner as defined in clause 60E(1)(a).

PART 2 Adaptation of the Trade Union Act

3 For the purposes of subsection 4(1), the Act applies to Her Majesty in right of the Province and to employees of Her Majesty.
