Regulations Respecting Zoning at Edmonton International AirportShort Title

1 These Regulations may be cited as the Edmonton International Airport Zoning Regulations.

Interpretation

2 In these Regulations,

airport
airport means Edmonton International Airport, in the Province of Alberta; (aéroport)
airport reference point
airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)
approach surface
approach surface means an imaginary inclined plane extending upward and outward from each end of a strip along and at right angles to the projected centre line thereof, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)
Minister
Minister means the Minister of Transport; (ministre)
outer surface
outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)
strip
strip means the rectangular portion of the landing area of the airport, including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)
transitional surface
transitional surface means an imaginary inclined plane extending  upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

Application

4 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport that consist of

(a) the lands within, and
(b) the lands directly under that portion of an approach surface that extends beyond,

the outer limits described in Part VI of the schedule.

General

5 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,

(a) the approach surfaces;
(b) the outer surface; or
(c) the transitional surfaces.

Natural Growth

6 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in section 5, the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

7 No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.

SCHEDULE(sections 2 and 4)

PART I Airport Reference Point

The airport reference point is a point coincidental with Transport Canada coordinate control survey monument No. 710323 located at latitude 53°18′33.9″ N., longitude 113°34′57″ W.
PART II Description of the Approach Surfaces

The approach surfaces, shown on Edmonton International Airport Zoning Plan No. E.1874 dated February 5, 1985, are surfaces abutting each end of the strips associated with the runways designated 01L-19R, 01R-19L, 11L-29R and 11R-29L and are described as follows:

(a) a surface abutting the end of the strip associated with runway approach 01L,
(b) a surface abutting the end of the strip associated with runway approach 19R,
(c) a surface abutting the end of the strip associated with runway approach 01R,
(d) a surface abutting the end of the strip associated with runway approach 19L,
(e) a surface abutting the end of the strip associated with runway approach 11L,
(f) a surface abutting the end of the strip associated with runway approach 29R,
(g) a surface abutting the end of the strip associated with runway approach 11R, and
(h) a surface abutting the end of the strip associated with runway approach 29L,

consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 400 m from the projected centre line; said imaginary horizontal line being 300 m measured vertically above the elevation at the end of the strip.
PART III Description of the Outer Surface

The outer surface, shown on Edmonton International Airport Zoning Plan No. E.1874 dated February 5, 1985, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the assigned elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the imaginary surface is located at 9 m above the surface of the ground.
PART IV Description of the Strips

The strips, shown on Edmonton International Airport Zoning Plan No. E.1874 dated February 5, 1985, are described as follows:

(a) the strip associated with runway 01L-19R, being 300 m in width, 150 m on each side of the centre line of the runway and 2 863 m in length;
(b) the strip associated with runway 01R-19L, being 300 m in width, 150 m on each side of the centre line of the runway and 3 473 m in length;
(c) the strip associated with runway 11L-29R, being 300 m in width, 150 m on each side of the centre line of the runway and 3 229 m in length; and
(d) the strip associated with runway 11R-29L being 300 m in width, 150 m on each side of the centre line of the runway and 3 777 m in length.

PART V Description of Each Transitional Surface

Each transitional surface, shown on Edmonton International Airport Zoning Plan E.1874 dated February 5, 1985, is a surface consisting of an inclined plane having a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip and extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
PART VI Description of the Outer Limits of Lands

The boundary of the outer limits of lands, shown on Edmonton International Airport Zoning Plan No. E.1874 dated February 5, 1985, is described as follows:
Commencing at the northeast corner of the west half of Section 36, Township 50, Range 25, west of the 4th Meridian; THENCE southerly along the easterly limits of the west halves of Sections 36, 25, 24, across the intervening road allowance and along the northwest quarter of Section 13 to the southeast corner thereof; THENCE easterly along the southerly limit of Lot 6, Block 11, Plan 782 1344 to the northwest corner of Lot 7, Block 11 on said Plan; THENCE southerly  along the westerly limits of Lots 7, 8 and 9 of said Block 11, across Derrick Avenue and Lot 1, Block 16 to the north limit of Lot 2, Block 16 on said Plan; THENCE westerly along the northerly limit of said Lot 2 to the northwest corner thereof; THENCE southerly along the westerly limits of Lots 2 and U-3, Block 16, across Sparrow Street and Lots 6, 5, 4, and 2, Block 15 on said Plan 782 1344 and the production thereof to the southerly limit of Plan 802 1634; THENCE westerly along the southerly limit of Plan 802 1634 to its intersection with the easterly limit of the west half of Section 12; THENCE southerly along the easterly limits of the west halves of Sections 12 and 1 of said Township 50, Range 25, west of the 4th Meridian, across the road allowance and along the west half of Section 36, Township 49, Range 25, west of the 4th Meridian, to the southeast corner thereof; THENCE westerly along the southerly limit of the west half of Section 36 and the southeast quarter of Section 35 to an intersection with the westerly limit of Railway Plan C. & E. No. 1; THENCE southerly along the westerly limit of Railway Plan C. & E. No. 1 to the southeast corner of Lot 4, Block 1A, Plan 5882 K.S. being the northerly limit of 50th Avenue; THENCE westerly along the northerly limit of 50th Avenue across intervening roads to an intersection with the easterly limit of Road Plan 5047 J.Y.; THENCE southerly across 50th Avenue and along the easterly limits of 54th Street, Plan 4842 K.S., Road Plans 5047 J.Y. and 618 L.Z. to an intersection with the northerly limit of Railway Plan 3274 E.0.; THENCE westerly along the northerly limit of said Railway Plan 3274 E.0. and across intervening road allowances to the easterly limit of Section 30, Township 49, Range 25, west of the 4th Meridian; THENCE northerly along the easterly limits of Section 30 and the southeast quarter of Section 31 to the northeast corner thereof; THENCE westerly along the northerly limits of said southeast quarter of Section 31 to the northwest corner thereof; THENCE northerly along the easterly limits of the northwest quarter of Section 31, across the intervening road allowance, and along the easterly limits of the west half of Section 6, Township 50, Range 25, west of the 4th Meridian to the southeast corner of the southwest quarter of Section 7; THENCE westerly along the southerly limits of said southwest quarter of Section 7 to the southwest corner thereof; THENCE northerly along the westerly limits of the said southwest quarter of Section 7 to the northwest corner thereof; THENCE easterly along the northerly limits of the said southwest quarter of Section 7 to the northeast corner thereof; THENCE northerly along the easterly limits of the northwest quarter of Section 7, west halves of Sections 18, 19, 30, southwest quarter of Section 31, and intervening road allowances to the northeast corner of said southwest quarter of Section 31; THENCE easterly along the southerly limits of the northeast quarter of Section 31, northwest quarter of Section 32 and intervening road allowance to the southeast corner of said northwest quarter of Section 32; THENCE northerly along the easterly limit of the said northwest quarter of Section 32 to the northeast corner thereof; THENCE easterly along the northerly limits of the northeast quarter of Section 32, Sections 33, 34, 35 and northwest quarter of Section 36, Township 50, Range 25, west of the 4th Meridian and intervening road allowances to the point of commencement.
