Interpretation

1 In these Regulations, Act means the Family Orders and Agreements Enforcement Assistance Act.

Application for Licence Denial

2 For the purpose of subsection 67(2) of the Act, an application for licence denial shall be made in the form set out in Schedule 1 and contain the following information:

(a) in respect of a debtor, the debtor’s

(i) surname and given names,
(ii) latest known address,
(iii) date of birth,
(iv) sex,
(v) social insurance number, if known,
(vi) mother’s surname at her birth,
(vii) city and country of birth, if known,
(viii) height, if known,
(ix) eye colour, if known,
(x) employer’s name, if known,
(xi) employer’s address, if known, and
(xii) language of choice for correspondence, if known; and

(b) in respect of the support order or support provision,

(i) the name of the court that issued the support order,
(ii) the date of the support order or support provision,
(iii) the names of the parties set out in the support order or support provision, and
(iv) amount in arrears or payment periods in arrears.

3 An application referred to in section 2 shall be accompanied by an affidavit in the form set out in Schedule 2.

Request to Terminate an Application

4 For the purpose of section 72 of the Act, a request for the termination of a licence denial application shall be made in the form set out in Schedule 3 and shall be made to the Minister of Justice.

Documentation

5 Any document to be given to the Minister of Justice under section 3 or 4 can be sent to the Department of Justice, Family Orders and Agreements Enforcement Assistance Unit, Ottawa, Ontario, K1A 0H8, by mail or by the means of electronic communication that has been agreed upon by the provincial enforcement service and the Department of Justice.

Coming into Force

6 These Regulations come into force on May 1, 1997.
