Order Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Potatoes Produced in AlbertaShort Title

1 This Order may be cited as the Alberta Potato Order.

Interpretation

2 In this Order,

Act
Act means The Marketing of Agricultural Products Act of Alberta; (Loi)
Commission
Commission means the Alberta Potato Commission established by the Plan Respecting the Alberta Potato Commission 1966; (Commission)
potatoes
potatoes means potatoes grown in the Province of Alberta and used for human consumption or seed; (pommes de terre)
Provincial Regulations
Provincial Regulations means Regulations Relating to the Implementation of the Plan Respecting the Alberta Potato Commission 1966 made as Alberta Regulation 459/67 by the Agricultural Products Marketing Council and filed on December 8, 1967. (règlement provincial)

Interprovincial and Export Trade

3 The Commission is authorized to regulate the marketing of potatoes in interprovincial and export trade and for such purposes may, with respect to persons and property situated within the Province of Alberta, exercise all or any powers like the powers exercisable by the Commission in relation to the marketing of potatoes locally within that Province under the Provincial Regulations and, subject to subsection 17a(6) of the Act, under the following provisions of the Act:

(a) subsection 14a(5);
(b) paragraphs 14d(1), 1 to 6, 8 to 10, 14 and 15; and
(c) subsection 17a(1).

Levies

4 The Commission may, in relation to the powers granted to it by section 3 with respect to the marketing of potatoes in interprovincial and export trade, by order, fix levies or charges and impose them on and collect them from persons described in section 3 who are engaged in the production or marketing of potatoes and for such purposes classify such persons into groups and fix the levies or charges payable by the members of the different groups in different amounts and the Commission may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of potatoes and the equalization or adjustment among producers of potatoes of moneys realized from the sale thereof during such period or periods of time as it may determine.
