Amending O. Reg. 341/06

(Grants for Student Needs — Legislative Grants for the 2006-2007 School Board Fiscal Year)

1. (1) Subsection 38 (2) of Ontario Regulation 341/06 is revoked and the following substituted:

(2) The amount for the board for board members’ honoraria and expenses and for expenses relating to pupil representation is determined as follows:

1. Multiply the number of members of the board, as determined for the purposes of section 35 of the 2005-2006 grant regulation, by the amount set out opposite the name of the board in Column 2 of Table 1 of Ontario Regulation 357/06 (Honoraria for Board Members) made under the Act.

2. Multiply the amount determined under paragraph 1 by 0.25.

3. Multiply the number of members of the board by $5,000. For the purposes of this paragraph and paragraphs 5, 7, and 15, the number of members of the board is the sum of,

i. the number of members determined for the board under subclause 58.1 (2) (k) (i) of the Act for the purposes of the 2006 regular election or, if a resolution referred to in subsection 58.1 (10.1) of the Act is in effect for the purposes of that election, the number of members specified in the resolution, and

ii. the number of Native representatives determined for the board under subsection 188 (5) of the Act for the term of office beginning in December, 2006.

4. Add $10,000 to the amount determined under paragraph 3.

5. Multiply $7,100 by the number of members of the board.

6. Add $7,500 to the amount determined under paragraph 5.

7. Multiply $1,800 by the number of members of the board if the board has,

i. a board area greater than 9,000 square kilometres, as set out in Table 1 of Ontario Regulation 412/00 (Elections to and Representation on District School Boards) made under the Act, as that regulation reads on January 1, 2006, or

ii. a dispersal factor of greater than 25 as set out in Table 5 of Ontario Regulation 412/00 (Elections to and Representation on District School Boards) made under the Act, as that regulation reads on January 1, 2006.

8. Take the sum of the amounts that would be determined for the members of the board under subsections 6 (2), (3) and (4) of Ontario Regulation 357/06 (Honoraria for Board Members) made under the Act, for the year beginning December 1, 2006, if only pupils of the board were counted in determining the enrolment of the board in section 9 of that regulation.

9. Take the total of the amounts determined under paragraphs 6 and 8 and under paragraph 7, if any.

10. Subtract the amount determined under paragraph 4 from the amount determined under paragraph 9.

11. Multiply the amount determined under paragraph 10 by 0.5.

12. Add the amount determined under paragraph 11 to the amount determined under paragraph 4.

13. Multiply the amount determined under paragraph 12 by 0.75.

14. Add the amount determined under paragraph 13 to the amount determined under paragraph 2 to determine the amount for board members’ honoraria.

15. Multiply the number of members of the board by $5,000 to determine the amount for board members’ expenses.

16. Total the amounts obtained under paragraphs 14 and 15.

17. Add $5,000 to the amount determined under paragraph 16, for expenses relating to pupil representation.

(2) Paragraph 8 of subsection 38 (4) of the Regulation is revoked and the following substituted:

8. Add 1 per cent of the total of the amounts determined for the board under subsection 39 (11) for new pupil places, subsection 39 (12) for primary class size reduction, subsection 39 (14) for growth schools and subsection 39 (16.1) for the construction of facilities described in clauses 234 (1) (b) and (c) of the Act.

(3) Paragraph 5 of subsection 38 (5) of the Regulation is revoked and the following substituted:

5. Add 1 per cent of the total of the amounts determined for the board under subsection 39 (11) for new pupil places, subsection 39 (12) for primary class size reduction, subsection 39 (14) for growth schools and subsection 39 (16.1) for the construction of facilities described in clauses 234 (1) (b) and (c) of the Act.

2. (1) Subsection 39 (2) of the Regulation is amended by adding the following paragraph:

2.1 The amount for urgent and high priority renewal projects.

(2) Subsection 39 (2) of the Regulation is amended by adding the following paragraph:

5.1 The amount for the construction of facilities described in clauses 234 (1) (b) and (c) of the Act.

(3) Paragraph 40 of subsection 39 (3) of the Regulation is amended by striking out “to obtain the amount for the board for school operations” at the end.

(4) Subsection 39 (9) of the Regulation is amended by adding “for the fiscal year” after “The amount for the board” in the portion before paragraph 1.

(5) Paragraphs 40, 41 and 42 of subsection 39 (9) of the Regulation are revoked.

(6) Section 39 of the Regulation is amended by adding the following subsection:

(9.1) The amount for the board for the fiscal year for urgent and high priority renewal projects is determined as follows:

1. Determine the amount of interest that the board has paid or for which it is liable in connection with the financing of urgent and high priority renewal projects described in subsection (10) as follows:

i. Determine the portion of the cost of urgent and high priority renewal projects in Stage 1, set out in Column 2 of Table 15 opposite the name of the board, that was incurred by the board in the 2005-2006 or 2006-2007 school board fiscal year for construction or renovation work other than work that is included under subparagraph 2 i.

ii. Determine the portion of the cost of urgent and high priority renewal projects in Stage 2, set out in Column 3 of Table 15 opposite the name of the board, that was incurred by the board in the 2005-2006 or 2006-2007 school board fiscal year for construction or renovation work that began on or after January 1, 2006.

iii. Add the amounts determined under subparagraphs i and ii.

iv. Determine the portion of the amount determined under subparagraph iii in respect of which the board incurred short-term interest.

v. Take the lesser of,

A. the amount of short-term interest incurred by the board in the 2006-2007 fiscal year in respect of the amount determined under subparagraph iv, and

B. the amount of short-term interest that the board would incur in the 2006-2007 fiscal year in respect of the amount determined under subparagraph iv if each amount borrowed were subject to an annual interest rate of not more than 0.13 per cent greater than the annual interest rate for three-month bankers’ acceptances applicable at the time of borrowing.

vi. Determine the portion of the amount determined under subparagraph iii in respect of which the board did not incur interest.

vii. Determine the amount of short-term interest that the board would incur in the 2006-2007 fiscal year in respect of the portion referred to in subparagraph vi if the amount of each cost making up the portion were borrowed on the date that it was withdrawn from reserves of the board, at the annual interest rate for three-month bankers’ acceptances applicable on September 1, 2006.

viii. Add the amounts, if any, determined under subparagraphs v and vii.

2. Determine the amount that the board has paid or for which it is liable in connection with the financing of urgent and high priority renewal projects described in subsection (10.1) as follows:

i. Determine the portion of the cost of urgent and high priority renewal projects in Stage 1, set out in Column 2 of Table 15 opposite the name of the board, that was incurred by the board in the 2004-2005 or 2005-2006 school board fiscal year for construction or renovation work that began on or after March 18, 2005.

ii. Determine the total of the principal and interest payments incurred by the board in the 2006-2007 fiscal year in respect of the following:

A. Funds that the board borrowed from the Ontario Financing Authority to pay the amount determined under subparagraph i.

B. The lender’s fee charged to the board by the Ontario Financing Authority for the funds borrowed.

3. Total the amounts determined under paragraphs 1 and 2.

(7) Subsection 39 (10) of the Regulation is amended by striking out “paragraph 40 of subsection (9)” in the portion before clause (a) and substituting “paragraph 1 of subsection (9.1)”.

(8) Subsection 39 (10.1) of the Regulation is amended by striking out “paragraph 41 of subsection (9)” in the portion before clause (a) and substituting “paragraph 2 of subsection (9.1)”.

(9) Paragraph 9 of subsection 39 (11) of the Regulation is amended by striking out “in the 2006-2007 fiscal year” and substituting “in the 2005-2006 or 2006-2007 fiscal year”.

(10) Subsection 39 (11) of the Regulation is amended by adding the following paragraph:

9.1 Subtract the amount determined in respect of the board under paragraph 9 of subsection 36 (10) of the 2005-2006 grant regulation from the amount determined under paragraph 9.

(11) Paragraph 10 of subsection 39 (11) of the Regulation is amended by striking out “paragraph 9” and substituting “paragraph 9.1”.

(12) Paragraph 57 of subsection 39 (11) of the Regulation is amended by striking out “in the 2006-2007 fiscal year” and substituting “in the 2005-2006 or 2006-2007 fiscal year”.

(13) Subsection 39 (11) of the Regulation is amended by adding the following paragraph:

57.1 Subtract the amount determined in respect of the board under paragraph 54 of subsection 36 (10) of the 2005-2006 grant regulation from the amount determined under paragraph 57.

(14) Paragraph 58 of subsection 39 (11) of the Regulation is amended by striking out “paragraph 57” and substituting “paragraph 57.1”.

(15) Subparagraph 97 i of subsection 39 (11) of the Regulation is amended by striking out the portion before sub-subparagraph A and substituting the following:

i. debt does not include,

. . . . .

(16) Subparagraph 97 i of subsection 39 (11) of the Regulation is amended by adding the following sub-subparagraph:

B.1 debt relating to the amount determined under subsection (16.1),

(17) Subparagraph 103 i of subsection 39 (11) of the Regulation is amended by striking out the portion before sub-subparagraph A and substituting the following:

i. debt does not include,

. . . . .

(18) Subparagraph 103 i of subsection 39 (11) of the Regulation is amended by adding the following sub-subparagraph:

B.1 debt relating to the amount determined under subsection (16.1),

(19) Subsection 39 (12) of the Regulation is amended by adding the following paragraphs:

4.1 Determine the construction costs for the new elementary pupil places described in paragraph 4.

4.2 Determine the amount that is payable in the 2006-2007 fiscal year if the amount determined under paragraph 4.1 is amortized over 25 years at an annual interest rate of 5.25 per cent, with no compounding.

(20) Subsection 39 (12) of the Regulation is amended by adding the following paragraphs:

5.1 Determine the construction costs for the new elementary pupil places described in paragraph 5.

5.2 Determine the amount that is payable in the 2006-2007 fiscal year if the amount determined under paragraph 5.1 is amortized over 25 years at an annual interest rate of 5.25 per cent, with no compounding.

(21) Subsection 39 (12) of the Regulation is amended by adding the following paragraph:

10.1 Determine the costs for relocating and installing temporary accommodation that provides new elementary pupil places needed for the primary class size reduction, if the costs are incurred in the 2006-2007 fiscal year and reported by August 31, 2007 on a form specified by the Minister, not including amounts determined under paragraph 10 or amounts associated with the initial installation of any temporary accommodation on a school site.

(22) Paragraph 11 of subsection 39 (12) of the Regulation is revoked and the following substituted:

11. Determine the costs for temporary accommodation that provides new elementary pupil places needed for the primary class size reduction, if the costs are incurred in the 2005-2006 or 2006-2007 fiscal year and reported by August 31, 2007 on a form specified by the Minister, not including amounts determined under paragraph 10 or 10.1.

(23) Paragraphs 13 to 25 of subsection 39 (12) of the Regulation are revoked and the following substituted:

13. Subtract the amount determined under paragraph 4.2 from the amount determined under paragraph 5.2.

14. Subtract the number determined under paragraph 7 from the number determined under paragraph 9.

15. Total the amounts determined under paragraphs 13 and 14.

16. Multiply the amount determined under paragraph 15 by 0.37.

17. Total the amounts determined under paragraphs 4.2, 7, 10, 10.1, 12 and 16.

18. Take the lesser of the amounts determined under paragraphs 3 and 17. 

(24) Section 39 of the Regulation is amended by adding the following subsection:

(16.1) The amount for the board for the fiscal year for the construction of facilities described in clauses 234 (1) (b) and (c) of the Act is determined as follows:

1. Determine the costs for the construction of facilities described in clauses 234 (1) (b) and (c) of the Act, that are reported by August 31, 2007 on a form specified by the Minister,

i. for which construction is completed at any time from September 1, 2005 to August 31, 2007,

ii. that are under construction during that period, or

iii. for which a tender for construction is awarded during that period.

2. Determine the amount that is payable in the 2006-2007 fiscal year if the amount determined under paragraph 1 is amortized over 25 years at an annual interest rate of 5.25 per cent, with no compounding.

3. Take the number of child care spaces that,

i. are in schools of the board that provide pupil accommodation for the first time on or after September 1, 2006, and

ii. the Minister confirms have been approved, by a municipality or district social services administration board established under section 3 of the District Social Services Administration Boards Act, as part of a facility described in clause 234 (1) (b) or (c) of the Act.

4. Multiply the number determined under paragraph 3 by the benchmark area requirement per child of 9.7 metres squared.

5. Multiply the number determined under paragraph 4 by the benchmark construction cost of $120.77 per metre squared.

6. Multiply the amount determined under paragraph 5 by the geographic adjustment factor set out in Column 3 of Table 14 opposite the name of the board.

7. Multiply the amount determined under paragraph 6 by 1.4.

8. Take the lesser of the amounts determined under paragraph 2 and paragraph 7.

(25) Subsection 39 (48) of the Regulation is amended by adding “for the fiscal year” after “The amount for the board” in the portion before paragraph 1.

3. (1) Paragraph 5 of subsection 41 (3) of the Regulation is revoked and the following substituted:

5. The sum of the amounts listed in paragraphs 2, 3 and 4 of subsection 35 (1) of the 2005-2006 grant regulation.

(2) Subparagraph 1 vii of subsection 41 (4) of the Regulation is revoked and the following substituted:

vii. the sum of the amounts listed in paragraphs 2, 3 and 4 of subsection 38 (1), and

4. Item 26 of Table 1 of the Regulation is revoked and the following substituted:
