Amending O. Reg. 350/06

(Building Code)

1. Subclause 1.1.2.4.(1)(c)(iv) of Division A of Ontario Regulation 350/06 is amended by striking out “medium and low hazard industrial occupancies” and substituting “medium hazard industrial occupancies and low hazard industrial occupancies”.

2. Sentence 1.1.2.7.(1) of Division A of the Regulation is amended by striking out “Article 7.1.2.2. of Division B”.

3. Sentences 1.3.1.2.(1), (2), (3) and (4) of Division A of the Regulation are amended by striking out “National Farm Building Code of Canada” wherever it appears and substituting in each case “CCBFC, “National Farm Building Code of Canada””.

4. (1) The definition of “alternative measure” in Clause 1.4.1.2.(1)(b) of Division A of the Regulation is revoked.

(2) Clause 1.4.1.2.(1)(b) of Division A of the Regulation is amended by adding the following definitions:

Dual vent means a vent pipe that serves two fixtures and connects at the junction of the trap arms.

Residential full flow-through fire sprinkler/standpipe system

means an assembly of pipes and fittings installed in the residential portions of a building containing one or two dwelling units that conveys water from the water service pipe to outlets in the sprinkler and standpipe systems and is fully integrated into the

potable water system to ensure a regular flow of water through all parts of the sprinkler and standpipe systems.

Residential partial flow-through sprinkler/standpipe system means an assembly of pipes and fittings installed in the residential portions of a building containing one or two dwelling units that conveys water from the water service pipe to outlets in the sprinkler and standpipe systems and in which flow occurs during inactive periods of the sprinkler and standpipe systems only through the main header to the water closet located at the farthest point of the sprinkler and standpipe systems.

(3) The definition of “storm building sewer” in Clause 1.4.1.2.(1)(b) of Division A of the Regulation is amended by striking out “building sewer” and substituting “building sewer”.

5. (1) Clause 1.4.1.3.(1)(a) of Division A of the Regulation is amended by adding the following Subclause:

(i.1) section 114 of the City of Toronto Act, 2006 with respect to the approval by the City of Toronto or the Ontario Municipal Board of plans and drawings,

(2) Subclause 1.4.1.3.(1)(a)(xv) of Division A of the Regulation is amended by striking out “municipality” and substituting “municipality”.

(3) Subclause 1.4.1.3.(1)(a)(xvi) of Division A of the Regulation is revoked and the following substituted:

(xvi) section 34 of the Ontario Heritage Act with respect to the consent of the council of a municipality for the demolition of a building,

(4) Subclause 1.4.1.3.(1)(a)(xviii) of Division A of the Regulation is amended by striking out “demolition” and substituting “demolition”.

(5) Subclauses 1.4.1.3.(1)(a)(xix) and (xxi) of Division A of the Regulation are amended by striking out “municipality” wherever it appears and substituting in each case “municipality”.

(6) Clause 1.4.1.3.(1)(a) of Division A of the Regulation is amended by adding the following Subclause:

(xxi.1) Section 42 of the Planning Act with respect to the payment of money or making arrangements satisfactory to the council of a municipality

for the payment of money, where the payment is required under subsection 42 (6) of that Act,

(7) Clause 1.4.1.3.(1)(b) of Division A of the Regulation is amended by adding the following Subclause:

(0.i) subsection 102 (3) of the City of Toronto Act, 2006,

(8) Clause 1.4.1.3.(1)(e) of Division A of the Regulation is revoked and the following substituted:

(e) by-laws made under section 34 or 38 of the Planning Act,

(e.1) subject to clause (e.2), by-laws made under Ontario Regulation 608/06 (Development Permits) made under the Planning Act,

(e.2) by-laws referred to in clause (e.1) in relation to the development of land, but only with respect to the issuance of a development permit if the development of land is prohibited unless a development permit is obtained,

(e.3) by-laws made under Ontario Regulation 246/01 (Development Permits) made under the Planning Act which continue in force despite the revocation of that regulation by reason of section 17 of Ontario Regulation 608/06 (Development Permits) made under that Act,

6. Table 1.4.2.1. of Division A of the Regulation is amended,

(a) by striking out “BOD” in Column 2 of Item 3 and substituting “BOD5”; and

(b) by striking out “CBOD” in Column 2 of Item 4 and substituting “CBOD5”.

7. (1) The heading to Table 1.3.1.2. of Division B of the Regulation is amended by striking out “Ontario”.

10. Clause 3.2.8.2.(1)(c) of Division B of the Regulation is amended by striking out “Sentence 3.2.1.1.(3) or (4)” and substituting “Sentence 3.2.1.1.(3) or (5)”.

11. Clause 3.3.1.2.(1)(b) of Division B of the Regulation is revoked and the following substituted:

(b) the CCBFC, “National Fire Code of Canada”, in the absence of regulations referred to in Clause (a).

12. Sentence 3.3.1.8.(1) of Division B of the Regulation is amended by striking out “Article 3.4.3.6.” and substituting “Article 3.4.3.5.”.

13. Clause 3.3.2.4.(13)(g) of Division B of the Regulation is amended by striking out “floor area” and substituting “floor area”.

14. Sentence 3.3.3.2.(4) of Division B of the Regulation is revoked and the following substituted:

(4) The walls separating sleeping rooms from adjacent rooms and corridors in those parts of a

floor area classified as a Group B, Division 3 occupancy shall be constructed as fire

separations but are not required to have a fire-resistance rating if,

(a) those parts of the floor area contain sleeping accommodation for not more than 10 persons, and

(b) not more than six occupants require assistance in evacuation in case of an emergency.

15. (1) Clauses 3.3.4.2.(2)(a) and (b) of Division B of the Regulation are amended by striking out “floor assembly” wherever it appears and substituting in each case “floor assembly”.

(2) Sentence 3.3.4.2.(3) of Division B of the Regulation is amended by striking out “Floor assemblies” at the beginning and substituting “Floor assemblies”.

16. Subsection 3.3.4. of Division B of the Regulation is amended by adding the following Article:

3.3.4.8. Stud Wall Reinforcement

(1) If wood wall studs or sheet steel wall studs enclose the main bathroom in a dwelling unit, reinforcement shall be installed to permit the future installation of a grab bar on a wall adjacent to,

(a) a water closet in the location required by Clause 3.8.3.8.(1)(d), and

(b) a shower or bathtub in the location required by Clause 3.8.3.13.(1)(f).

17. Clause 3.3.5.2.(1)(b) of Division B of the Regulation is revoked and the following substituted:

(b) the CCBFC, “National Fire Code of Canada”, in the absence of provisions referred to in Clause (a).

18. Sentence 3.4.3.2.(4) of Division B of the Regulation is revoked and the following substituted:

(4) Except as required by Sentence (5), the required exit width need not be cumulative in an exit serving 2 or more

floor areas located one above the other.

19. (1) Sentence 3.5.2.1.(1) of Division B of the Regulation is amended by adding “Except as provided in Sentence (2)” at the beginning.

(2) Article 3.5.2.1. of Division B of the Regulation is amended by adding the following Sentence:

(2) Sentence (1) does not apply to those parts of a floor area

classified as a Group B, Division 3 occupancy if,

(a) those portions of the floor area contain sleeping accommodation for not more than 10 persons, and

(b) not more than six occupants require assistance in evacuating in the case of an emergency.

20. (1) Sentence 3.7.4.2.(7) of Division B of the Regulation is revoked and the following substituted:

(7) The water closet and lavatory provided in the universal toilet room described in Sentence 3.8.3.12.(1) may be counted as part of the plumbing fixtures required for males and females in this Subsection if,

(a) more than one water closet is required for males, and

(b) more than one water closet is required for females.

(2) Sentence 3.7.4.2.(8) of Division B of the Regulation is revoked and the following substituted:

(8) Both sexes are permitted to be served by a single water closet if the occupant load is not more than 10 persons in an assembly occupancy referred to in Article 3.7.4.3. except for,

(a) elementary and secondary schools,

(b) child care facilities,

(c) places of worship,

(d) undertaking premises, and

(e) dining rooms, restaurants, cafeterias and alcoholic beverage establishments.

21. Sentence 3.7.4.7.(2) of Division B of the Regulation is amended by striking out “5 persons” at the end and substituting “10 persons”.

22. Clause 3.7.4.9.(2)(a) of Division B of the Regulation is amended by striking out “9 persons” and substituting “10 persons”.

23. Sentence 3.8.3.8.(1) of Division B of the Regulation is amended by striking out “to barrier-free” in the portion before Clause (a) and substituting “to be barrier-free”.

24. (1) Clause 3.8.3.12.(1)(i) of Division B of the Regulation is revoked and the following substituted:

(i) be designed to permit a wheelchair to turn in an open space not less than 1 500 mm in diameter, and

(2) Sentence 3.8.3.12.(2) of Division B of the Regulation is revoked and the following substituted:

25. Sentence 3.14.1.2.(2) of Division B of the Regulation is amended by striking out “3.14.1.10.” in the portion before Clause (a) and substituting “3.14.1.9.”.

26. Clause 3.16.1.7.(7)(b) of Division B of the Regulation is amended by striking out the formula and substituting the following:

Total Egress Time = (Hp + Vp/0.6 + Hm/1.3 + 10Nlg + 5Nlc ) · 1.5 (in seconds)

27. Sentence 4.1.1.3.(1) of Division B of the Regulation is revoked and the following substituted:

(1) Buildings and their structural members and connections including formwork and falsework shall be designed to have sufficient structural capacity and structural integrity to safely and effectively resist all loads, effects of loads and influences that may reasonably be expected, having regard to the expected service life of buildings, and shall in any case satisfy the requirements of this Section.

28. Clause 4.1.3.1.(1)(a) of Division B of the Regulation is revoked and the following substituted:

(a) “limit states” means those conditions of a building structure that result in the building ceasing to fulfill the function for which it was designed. (Those limit states concerning safety are called ultimate limit states (ULS) and include exceeding the load-carrying capacity, overturning, sliding and fracture; those limit states that restrict the intended use and occupancy of the building are called serviceability limit states (SLS) and include deflection, vibration, permanent deformation and local structural damage such as cracking; and those limit states that represent failure under repeated loading are called fatigue limit states),

35. Sentence 6.3.1.1.(1) of Division B of the Regulation is amended by striking out “Article 6.2.1.5.” at the end and substituting “Article 6.2.1.4.”.

4.1.2.  Transition, July 2007

4.1.2.1.  Transition Rule

(1) Subject to Sentence (2), this Regulation as it read on June 30, 2007 is deemed to continue in force with respect to construction,

(a) for which a permit has been issued before July 1, 2007, or

(b) for which the working drawings, plans and specifications are substantially completed before July 1, 2007 and for which an application for a permit is made before October 1, 2007 under this Code as it read on June 30, 2007.

(2) Sentence (1) does not apply unless the construction is commenced within six months after the permit is issued.

80. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.

(2) Section 16 and subsection 20 (2) come into force on July 1, 2007.
