Amending O. Reg. 167/97

(General)

1. (1) Subsection 2 (1) of Ontario Regulation 167/97 is revoked and the following substituted:

(1) For the purposes of clause 8 (2) (d) and subsection 8 (3) of the Act, notice of the death of the child entitled to support under a support order or of the payor’s death shall be,

(a) given in writing; and

(b) accompanied by a copy of the death certificate, a funeral notice, a copy of the certificate of appointment of estate trustee, a letter from the solicitor for the estate of the deceased person or any other supporting documentation providing satisfactory proof of the death of the deceased person.

(2) Subsection 2 (2) of the Regulation is amended by striking out “the deceased person as the payor” and substituting “the deceased person as the child entitled to support under a support order or, as the case may be, the payor”.

(3) Subsection 2 (3) of the Regulation is amended by striking out “of the payor’s death” in the portion before clause (a).

2. Section 3 of the Regulation is amended by striking out “clause 8 (4) (a)” in the portion before clause (a) and substituting “clause 8 (2) (a)”.

3. Subsection 4 (1) of the Regulation is amended by striking out “subsection 8 (5)” in the portion before paragraph 1 and substituting “subsection 8 (4)”.

4. (1) Subsection 5 (1) of the Regulation is amended by striking out “subsection 8 (5)” and substituting “subsection 8 (4)”.

(2) Subsection 5 (6) of the Regulation is amended by striking out “subsection 8 (5)” and substituting “subsection 8 (4)”.

5. This Regulation comes into force on the later of January 1, 2011 and the day subsection 2 (4) of Schedule 8 to the Good Government Act, 2009 comes into force.
